Has there been any progress on this claim at all? I have been trying to work this through for months and months now and I have to say I am hoping someone will please take this over
and let’s come to a resolution. I have provided all evidence of a mistake by the City of Palm Desert and the water district and if there are any further questions or something that
is not understood, I am available by phone and email at all times. The evidence of a non-recording of the city notice that this property still had a septic tank is there in the public
record, and I did include a copy of that notice showing our property was not noticed. I am not sure what else the city needs to confirm this, but I am more than happy to provide anything
required.
I appreciate your help and I appreciate someone please moving forward on this.

I wanted to notify you as the Mayor/ Mayor Pro Tem and City Council of the claim the city has denied based on “late submission”. I think its important that the council take a look at
the claim and review due to the fact that a denial to even LOOK at the claim doesn’t negate the fact the this property has been charged and has been paying sewer connection fees back
to the 1990’s when in fact there was NEVER a sewer connected.
Rather than re-hash the entire situation in this email, please review the claim and all required paperwork and emails (where the city acknowledges “mistakes were made”) that we provided
in January. The Carl Warren company denied our first claim, told us to submit a “request for waiver of late claim” (late claim due a sudden tragic death of our grandson in the middle
of this claim, also explained in our letter) which they promptly again denied. Did the city actually deny our request for a late submission or was this Carl Warren company making that
decision?
In any case, our claim is approximately $10,000.00 for the cost of installing a sewer connection and removing a septic tank that the city and the water company and tax bills stated was
NOT there. They also mentioned mistakes were made by NOT recording on our lot the required notice to all new homeowners so we would have known there was a septic when we bought this
property – but with a tax bill showing years of sewer connection charges back to the 1990’s and with no legal notice recorded against the property, we had no idea there was a septic
tank on this property until it overflowed and we had a major flood in our home – and it took a week to figure out why. The property was never connected to sewer like all the records
of the city and water company told us it was. The previous owner ALSO paid these illegal collections fee as they never knew it was not connected as well.
In any case, we would appreciate the council taking a look at this claim. I think this is a very important topic as I’m sure the council and the city, regardless of the “technicalities”
in timing on filing a claim, doesn’t want to be known for misleading homeowners and collecting illegal city services fees FOR YEARS. If it happened to me, I’m sure it could still be
happening to other taxpayers/homeowners in the city.

dealing with the whole house sewage backup into our home and what we had to deal with. We are not that type of people and we are only asking for what is fair and just. Please review
