Good afternoon,
We received a letter last week from the Carl Warren Company denying our claim for sewer
connection mistakes on the above referenced property on the basis it was filed “too late”.
Mr. Timothy Varon from the Warren Company cited Government Code Section 911.2 which
states we should have filed our claim by early November 2021, instead of the date of January
27, 2022, which was the date we submitted the paperwork to the city. He also advised we can
file a petition for a late claim with an explanation evidencing why we could not meet the
deadline. We are writing this email to serve that purpose.
We were originally unable to file this claim earlier due to COVID restrictions, which everyone is
aware, were a complete nightmare for all us with closed government offices, illnesses,
moving from an office working environment to home offices, restrictions regarding meeting in
person, etc. When we were able to finally research and arrange all the details and to begin
the claim process last summer, we were hit with a major tragedy in our family in August of
2021. Our grandson, who was just beginning his senior year at Southern Oregon University,
was killed by a hit and run driver walking back to his house one evening. I imagine all of you
can understand how this horrible incident can immediately and absolutely take over your
entire life and focus. It took a few months for us to even begin to acknowledge and start to
recover after spending so much time trying to understand what happened, uncover details,
and of course to lay him to rest. His name is Hunter Roberson, and he was an amazing
student athlete.

It wasn’t until January when we were able to finally gather our thoughts and the strength to
move forward with this claim for reimbursement for costs and expenses as brought forth in all
our paperwork that you now have.
