HomeMy WebLinkAboutWall at Rancho Grande and Town Center INTEROFFICE MENERA DU4 City of Palm Desert TO: City Manager and City Council FROM: Assistant City Manager/Director of Community Development DATE: September 22, 1988 SUBJECT: Wall at Rancho Grande/Town Center After discussions with all parties involved and a meeting with representatives of the Town Center and Mr. Pickel, it must be reported that we are at an apparent impasse. The Town Center has stated, after reviewing the situation with legal counsel, that they will remove the wall subject to the city accepting an easement and constructing a public sidewalk. The possibility of creating an assessment district to construct the sidewalk improvement was discussed. Mr. Pickel stated that this alternative was not acceptable. The Town Center stated that they would not pay for the construction of the sidewalk. To clarify once again, all of the property in question is private property and the city is presently not legally obligated to remove the wall in question. The position of the Board of Realtors continues to be that if a sidewalk is constructed that a wall be built adjacent to their property. Staff recommendation also remains the same. If it is the determination of the council that the city became involved in this matter, that a sidewalk be constructed to public street standards be built. RAMON A.
