VEHICLE IMPOUND COST RECOVERY (VICR) FEES

RECOMMENDATION:
Recommend that the City Council adopt a Resolution entitled, “A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, AMENDING THE AMOUNT OF THE DUI DRIVER AND
VEHICLE IMPOUND COST RECOVERY FEE PURSUANT TO CHAPTER
10.25 OF THE PALM DESERT MUNICIPAL CODE AND RESCINDING
RESOLUTION NO. 2014-95,” to revise the Vehicle Impound Cost Recovery
(VICR) fees, setting the standard impound fee at $275 and increasing the
DUI-related impound fee to $1,190.00.

California Electric Bike Laws:
Everything You Need to Know
Electric bikes (e-bikes) are gaining popularity across California as an environmentally
friendly and efficient mode of transportation. However, e-bike laws can be confusing as

regulations vary by class and local jurisdictions. This article provides an overview of
California Electric Bike Laws so you can ride informally and legally. The Riverside
County Sheriff’s Department has been in the education phase of e-bike enforcement.
They will be transitioning to the enforcement of California Laws and local regulations
relating to e-bikes soon.
There are 3 classes of e-bikes:
• Class 1: The motor provides assistance only while the rider is pedaling, up to
20mph
• Class 2: These have a throttle for motor-assisted riding without pedaling, up to
20mph
• Class 3: The motor provides assistance only while pedaling, up to 28mph
• Pedals are required to be on the bike
California law prohibits anyone under the age of 16 from riding a Class 3 electric bike,
which can reach speeds of up to 28 mph. Class 3 e-bikes are restricted to use by
persons aged 16 and older. However, there are no age restrictions for riding Class 1
and 2 e-bikes in California, which have lower maximum speeds.
You do not need a driver’s license, permit, or vehicle registration to operate an electric
bike in California. E-bikes are classified similarly to regular bicycles under California
vehicle codes. No special endorsement or age limit is required. However, many of the
same traffic laws apply.
You are required by law to wear an ANSI-approved bicycle helmet when riding an e-
bike if you are under 18 years old. It’s highly recommended to always wear a helmet
for safety.
California prohibits carrying passengers on electric bikes. E-bikes are designed and
intended for one rider only.

A 1000-watt e-bike would not be street-legal in California. Electric bikes are limited to
750-watt motors under state law. Anything above 750 watts is considered a motorized
vehicle and needs to be registered and insured. Surron, or similar E-motorcycles are
not street legal in the State of California. Riders may be issued citations and have
their e-motorcycles impounded. This may impact a teen from receiving their driver’s
license.
Surron E-motorcycle (or similar) are currently not street
legal in California.

Background
•E‐bikes are pedal driven bicycles with electronic motors with less than 750 watts
(CVC 312.5).
•Popularity of e‐bikes has increased by 900% since 2020.
•There are 3 types of e‐bikes (Class 1, 2, and 3).
•All e‐bikes come with a sticker on the frame stating their classification.
•E‐bikes are considered bicycles, so no driver license or permit is necessary to
ride.
•**To be considered an e‐bike , the bicycle must have functional pedals!**

Subject: Automated License Plate Reader Shared Network Information
On June 2, 2022, Flock Safety was awarded a contract for a fixed location of the Automated
License Plate Readers (ALPR) system. The system became operational in October 2022.
The City has a contract with the Riverside County Sheriff's Department (RCSD) for law
enforcement services and participates in the RCSD ALPR program. Therefore, the ALPR
program and RCSD’s operator, Flock, are bound by Federal and State law, RCSD policy, and
the requirements of the City's agreement with Flock.
Palm Desert Shared Networks
The City of Palm Desert is the owner of the data and RCSD manages it on its behalf according
to state law, RCSD Policy 412, and the City’s agreement with Flock Safety.
During a reporting period, the data is retrieved from RCSD which includes a review of the
shared networks for the reporting period. Palm Desert data is shared only with other
California agencies as is allowed by state law, SB 34 (2015).
Flock by default deletes the data every 30 days. Once the data is deleted, it cannot be
retrieved. Flock is among the shortest of all the state statutes on data retention.
Flock does not share with 3rd parties. Flock requires an investigative reason to search, and
they provide an audit report to system administrators.
Reporting
In accordance with state law, City staff monitors the list of agencies with which Palm Desert
data is shared. Beginning in December 2023, the City has published its shared networks list.
The following is the February 2025, shared network report with 371 California Agencies.

RECOMMENDATION:
Adopt a Resolution entitled, “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING THE AMOUNT OF THE DUI DRIVER AND VEHICLE
IMPOUND COST RECOVERY FEE PURSUANT TO CHAPTER 10.25 OF THE PALM DESERT
MUNICIPAL CODE AND RESCINDING RESOLUTION NO. 2014-95,” to revise the Vehicle
Impound Cost Recovery (VICR) fees, setting the standard impound fee at $2 75 and increasing
the DUI-related impound fee to $1,190.00.
BACKGROUND/ANALYSIS:
Vehicle Impound Cost Recovery (VICR) fees are charges imposed by the City to recover the
costs associated with impounding vehicles. These costs typically include law enforcement
resources, administrative processing, and storage fees incurred during vehicle impounds,
particularly for violations such as DUIs. The fees aim to ensure that the City recovers its
expenses. By aligning these fees with actual operational costs, VICR fees also serve as a
deterrent to unsafe driving behaviors, such as driving under the influence, and support public
safety efforts.
The City of Palm Desert's VICR fees were last updated in 2014. A review of current
administrative and enforcement costs, as well as a comparison of VICR fees across neighboring
Coachella Valley cities, indicates a need for an update. The City of Palm Desert applies a single,
standard fee for all vehicles.

The City of Palm Desert contracts with the Riverside County Sheriff's Department for law
enforcement services. The City receives direct bills for deputies' and supervisors’ time, ma king
it essential to align VICR fees with actual costs.

The DUI-related fee increase to $1,190 accounts for inflation and rising personnel and
administrative costs over the past decade. This updated fee will enable the City to recover its
actual expenses for processing DUI-related impounds, which require extensive law enforcement
time and resources.
Palm Desert’s VICR fees will be structured on a sliding scale of up to five percent based on the
contract rate. This approach ensures continuous alignment wit h fluctuations in operational
expenses and inflation, eliminating the need for frequent fee adjustments.
Justification for Fee Adjustment:
1. Deputy and Supervisor Time:
Processing vehicle impounds requires law enforcement resources, including
deputy labor and supervisor oversight.
For DUI-related impounds, additional time is required for investigations, field
sobriety tests, evidence collection, and administrative follow-up. The fee increase
accounts for these costs, ensuring the Sheriff’s Department's time (representing
City resources) is fully recovered.
2. Consistency in Fee Structure:
Palm Desert applies a standard impound fee across all vehicle types, unlike other
jurisdictions that vary fees based on vehicle size or specialized handling.
3. Cost Recovery Goal:
VICR fees are structured to recover the actual costs incurred by the City in
contracting with the Sheriff’s Department. The DUI fee increase ensures alignment
with current operational costs while avoiding a subsidy from the General Fund.
4. Discouraging Drunk Driving:
The DUI-related fee increase from $705 to $1,190.00 reinforces the City’s
commitment to public safety. This higher fee serves as a financial deterrent to
individuals engaging in dangerous behaviors.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, AMENDING THE AMOUNT OF THE DUI DRIVER
AND VEHICLE IMPOUND COST RECOVERY FEE PURSUANT TO
CHAPTER 10.25 OF THE PALM DESERT MUNICIPAL CODE AND

WHEREAS, the Riverside County Sheriff's Department, acting as the Palm
Desert Police Department, impounds and/or stores vehicles from highways, public
property, or private property within the City of Palm Desert during the normal course
of duty; and
WHEREAS, the Riverside County Sheriff's Department, acting as the Palm
Desert Police Department, impounds and/or stores vehicles pursuant to its authority
under California Vehicle Code Sections 22650 through 22669 and 23152 through
23273; and
WHEREAS, Vehicle Code Section 22850.5, added by Assembly Bill 481
(Chapter 614, Statutes of 1993), specifically authorizes cities, by ordinance or
resolution, to establish an administrative charge related to the removal, impound,
storage, or release of vehicles; and
WHEREAS, Vehicle Code Section 53150 specifies that any person who is
under the influence of an alcoholic beverage or any drug, whose negligent operation
of a motor vehicle caused by that influence proximately causes any incident
resulting in an appropriate emergency response, to be liable for the expense of an
emergency response by a public agency to the incident.
WHEREAS, Chapter 10.25 of the Palm Desert Municipal Code imposes an
administrative charge relating to the removal, impound, storage, or release of
vehicles, the amount of which fee is to be set
WHEREAS, the City Council of the City of Palm Desert established the DUI
Driver Vehicle Impound Cost Recovery Fee by adopting Resolution No. 2014-95 on
December 11, 2014; and
WHEREAS, the City Council of the City of Palm Desert now desires and
intends to update the Vehicle Impound Cost Recovery and fees to reflect actual
costs incurred, ensure full cost recovery, and align with inflation and operational
expenses since 2014; and
WHEREAS, the calculation of actual costs to the City for processing the
Vehicle Impound Program and DUI-related impounds are set forth in “Exhibit A” and
“Exhibit B” attached hereto.

of the assessed VICR fees by contacting the Palm Desert Sheriff’s Station within
thirty (30) days of the acquittal date. Requests received after this period may be
considered with City Manager approval.

FEE
The City of Palm Desert contracts with the Riverside County Sheriff's Department for police
services. For Fiscal Year 2024-25, the Sheriff’s Department established a patrol rate of $229.55
per hour. This rate includes deputy salaries, fringe benefits, insurance, and various support
systems necessary for operations.
The City estimates that the process of impounding or storing nuisance vehicles requires a
minimum of 1.25 hours of combined officer and support staff time. This process typically
involves the following sequence of events:

Receive and file the Public Safety Committee’s 2025 Work Plan, which identifies the
Committee’s priorities for the year
BACKGROUND/ANALYSIS:
At its regular meeting on February 11, 2025, the Public Safety Committee convened to identify
and establish key focus areas for the 2025 calendar year. After thoughtful discussion and input
from Committee members, the Committee identified three primary priorities to guide its
collaboration with City staff throughout the year.
1. Community Policing
The Committee will work closely with the Riverside County Sheriff’s Department to enhance
community policing initiatives. This effort will focus on fostering stronger relationships between
law enforcement and residents, imp roving transparency and communication, and addressing
safety concerns unique to the community.
Action Item:
- Review periodic updates from the Sheriff’s Department regarding community policing
strategies, programs, and outcomes.
2. Public Safety Budget, Emergency Preparedness, and Fire Inspections for Businesses
and Buildings
The Committee will actively review and monitor public safety budget updates to ensure they
align with community safety priorities. Additionally, the Committee will evaluate and recommend
improvements to the City’s emergency preparedness efforts and review the effectiveness of fire
inspection services provided to local businesses and buildings. These efforts will be conducted
in partnership with City staff and relevant public safety agencies.

- Review regular FY 25-26 proposed budget, including funding allocations and
expenditures.

Technology Subcommittee responsible for researching, evaluating, and prioritizing technology
solutions. This subcommittee will collaborate with City staff, public safety personnel, and industry
experts to ensure all recommendations align with the City’s operational needs, community
priorities, and available fiscal resources.
Action Items:
- Meet with representatives from the Riverside County Sheriff’s Department to review the
City’s existing FLOCK camera system, including potential system upgrades, expanded
functionality, and the feasibility of adding new camera locations.
- Monitor advancements in public safety technology and assess their relevance and
feasibility for the City through ongoing review and analysis.
- Ensure all technology recommendations consider operational benefits and align with the
City’s long-term public safety goals.
