HomeMy WebLinkAboutRes 2025-064RESOLUTION NO. 2025-064 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ADOPTING A SCHEDULE OF USER AND REGULATORY FEES FOR VARIOUS CITY SERVICES WHEREAS, user and regulatory fees are established by the City Council; and WHEREAS, the City recently completed a study to identify the cost of providing various user and regulatory fee-related services; and WHEREAS, the study examined fee-related services provided by the City, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, the City Council finds that providing these services is of special benefit to applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these services from applicants who have sought or require the City's services by revising its schedule of fees; and WHEREAS, the City Council hereby finds that the study provides adequate evidence to conclude that the revised fees do not exceed the cost to provide the services for which the fees are charged; and WHEREAS, fee adjustments are proposed over a multi-year time frame; and WHEREAS, initial fee adjustments will be effective 60 days from the date of adoption, and subsequent adjustments shall be effective July 1, 2026, and July 1, 2027; and WHEREAS, the City’s current fee schedule methodology has remained unchanged since its inception and relies on complex software-based calculations; and WHEREAS, this system is difficult for the public to understand and lacks transparency; and WHEREAS, adopting an updated fee calculation model with a blended staff rate aligns with current industry standards and improves cost recovery and clarity; and WHEREAS, subsequent to the adjustments prescribed above, the City Council desires that annually the City Manager may update the various fees based on the annual percentage change in the all-urban Consumer Price Index for Riverside-San Bernardino- Ontario (CPI) as published for the month of March in the given year; and WHEREAS, if the CPI does not increase or decreases in a given year, no adjustment shall be made to the fee schedule for that year; and Docusign Envelope ID: D61B6E48-0E17-4DF6-847E-7B027D818776 Resolution No. 2025-064 Page 2 WHEREAS, in compliance with all applicable regulations and procedural requirements related to public notification and transparency, the City has ensured that proper notice of the upcoming public hearing has been provided, including: (1) publication of the Notice of Public Hearing in the Desert Sun newspaper on two separate occasions, with the first publication occurring no less than ten (10) days before the hearing date (August 15, 2025) and the second publication made at least five (5) days apart from the first (August 21, 2025), thereby satisfying legal posting intervals; (2) issuance of written notices to all interested parties who requested notification, with such notices delivered at least fourteen (14) days in advance of the hearing to allow sufficient time for preparation; (3) public availability of all materials supporting the proposed fees, which have been accessible on the City’s website for at least ten (10) days prior to the hearing date to facilitate public review and transparency; and (4) dissemination of an email notice to the development community including developers, engineers, and contractors—via the City’s Land Management System contact list, thereby ensuring broad industry awareness and opportunity for participation in the public hearing process; and WHEREAS, in adopting this Resolution, the City Council is taking action only on those fees for the services, programs or products set forth in Exhibit “A” which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: SECTION 1. Incorporation of Recitals. The City Council finds and determines that the recitals of this Resolution are true and correct and are hereby incorporated into this Resolution as though fully set forth herein. SECTION 2. Establishment and Update of User and Regulatory Fees. The City Council hereby adopts the fees, charges, and rates as set forth in attached Exhibit "A" and incorporated by this reference. SECTION 3. Effective Date. Any new or adjusted fees adopted by this Resolution shall go into effect 60 days of the adopted date for the initial year of the phase-in, July 1, 2026 for the second year of the phase-in, and July 1, 2027 for the third year of the phase- in. SECTION 4. Certification. The City Clerk shall attest to and certify the vote adopting this resolution. [a] California Government Code Section 66015(a)(1), establishes maximum fees for residential solar energy systems. For photovoltaic systems, fees shall not exceed $450 plus $15 per kW for each kilowatt above 15kW. For thermal systems, fees shall not exceed $450, plus $15 per kWth for each kilowatt thermal above 10kWth. Fees in excess of these amounts require written findings and resolution or ordinance. [b] California Government Code Section 66015(b)(1), establishes maximum fees for commercial solar energy systems. Fees shall not exceed $1,000 for systems up to 50kW plus $7 per kilowatt for each kilowatt between 51kW and 250kW, plus $5 for each kilowatt above 250kW. For thermal systems, fees shall not exceed $1,000 up to the 30kWth, plus $7 per kWth for each kWth between the 30th and 260th kWth, plus $5 for each kWth above 260kWth. Fees in excess of these amounts require written findings and resolution or ordinance. If, in the opinion of the Building Official, the valuation is underestimated on the application, the permit shall be denied, unless the applicant can show detailed estimates to meet the approval of the Building Official. Final building permit valuation shall be set by the Building Official. For determining project valuations for new construction, the Building Official may use data published by the International Code Council (ICC) (building valuation data table, typically updated in February and August of each year). The final building permit valuation shall be set at an amount that allows the City to recover its costs of applicant plan check, permit and inspection activities. Note: For construction projects with permit fees calculated using Section B, C, D, or E, additional fees apply for permit issuance. Additional fees apply for plan review, when applicable.
