A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, ACCEPTING THE CALIFORNIA DEPARTMENT
OF JUSTICE TOBACCO GRANT PROGRAM AWARD AND
AUTHORIZING RELATED ACTIONS
WHEREAS, the California Department of Justice (DOJ) Tobacco Grant Program
provides funding to local agencies for enforcement, education, and related activities
pursuant to Proposition 56 and Revenue and Taxation Code section 30130.57; and
WHEREAS, the City of Palm Desert has been notified that it has been selected to
receive a Tobacco Grant Program award, with the final award amount to be determined
upon issuance of the Grant Agreement and Summary of Award by DOJ; and
WHEREAS, the DOJ Grantee Handbook requires a governing body resolution for
agencies whose governing bodies require such action to formally accept the award and
authorize participation; and
WHEREAS, DOJ requires that the resolution authorize the City to enter into a
contract/Memorandum of Understanding (MOU), incur eligible grant -related expenses,
receive reimbursement, and authorize future amendments without requiring an additional
resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
SECTION 1. That the foregoing Recitals are true and correct and are incorporated
herein by this reference.
SECTION 2. The City Council formally accepts the California Department of
Justice Tobacco Grant Program award, with the final award amount to be established in
the DOJ-issued Grant Agreement and Summary of Award.
SECTION 3. The City Manager, or designee, is authorized to execute the
Memorandum of Understanding (MOU), Grant Agreement, Summary of Award, Budget
Detail, Governmental Taxpayer ID Form, and all other documents required by DOJ to
implement the grant.
SECTION 4. The City of Palm Desert is authorized to incur eligible grant -related
expenses and receive reimbursement from DOJ in accordance with the Grant Agreement
and Grantee Handbook.
SECTION 5. The City Manager, or designee, is authorized to execute future
amendments to the Grant Agreement, including amendments that modify project
timelines, increase or decrease funding, revise the scope of work, or adjust the budget,

without requiring an additional resolution, provided such amendments comply with City
policy and do not obligate additional local funds.
