A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, DIRECTING STAFF TO PREPARE
AMENDMENTS TO CHAPTER 8.50 OF THE PALM DESERT MUNICIPAL
CODE RELATING TO DRILLING AND MAINTENANCE PERMIT
REQUIREMENTS AND CONDITIONS FOR WATER WELLS
WHEREAS, the City of Palm Desert (“City”) is committed to protecting public
health, safety, and welfare through appropriate regulation of activities that may impact the
community; and
WHEREAS, the County of Riverside maintains exclusive authority to issue permits
for new well drilling within the City of Palm Desert and makes efforts to ensure that all
permitted work complies with state and local ordinances; and
WHEREAS, drilling and maintenance operations associated with water wells may
generate noise, vibration, dust, traffic , and other impacts that require local oversight to
minimize disruption to surrounding neighborhoods and to maintain community quality of
life; and
WHEREAS, the City currently has limited municipal regulations addressing local
operational standards for drilling and maintenance activities conducted under permits
issued by the County of Riverside; and
WHEREAS, the City Council desires to establish clear local requirements,
conditions, and operational standards applicable to all future drilling and maintenance
activities to ensure responsible operations and adequate safeguards for public health,
safety, and welfare; and
WHEREAS, the City Council finds that amending Chapter 8.50 of the Palm Desert
Municipal Code is necessary to provide appropriate regulatory tools, community
protections, and enforcement mechanisms for drilling and maintenance operations of
water wells within the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
SECTION 1. That the foregoing Recitals are true and correct and are incorporated
herein by this reference.
SECTION 2. City staff is directed to prepare proposed amendments to Chapter
8.50 of the Palm Desert Municipal Code to establish drilling and maintenance permit
requirements, operational standards, and conditions for water wells located within the
City. The amendments shall include, but are not limited to, submittal requirements,
operational and environmental standards, financial assurances, public notification
procedures, monitoring and reporting obligations, and enforcement tools.

SECTION 3. Staff is further directed to return to the City Council with a draft
ordinance for consideration at a future meeting
