A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, INITIATING PROCEEDINGS FOR THE
ANNEXATION OF TERRITORY (TRACT 31377 – CORTE PLACITAS) TO
THE CONSOLIDATED PALM DESERT LIGHTING AND LANDSCAPE
DISTRICT NO. 1 (ZONE #6 – HOVLEY LANE) AND THE LEVY AND
ASSESSMENT RELATED THERETO COMMENCING WITH FISCAL
YEAR 2026/2027, PURSUANT TO THE PROVISIONS OF PART 2 OF
DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE
Whereas, the City Council through previous resolutions has established and
levied annual assessments for the Consolidated Palm Desert Landscaping and Lighting
District No. 1 (hereinafter referred to as the “District”), pursuant to the provisions of the
Landscaping and Lighting Act of 1972, Part 2, Division 15 of the California Streets and
Highways Code (hereinafter referred to as the “Act”) that provides for the collection of
special benefit assessments by the County of Riverside on behalf of the City of Pa lm
Desert to pay the maintenance and services of improvements and facilities related
thereto, and
Whereas, the City Council desires to initiate proceedings for the annexation of
territory identified as Annexation of Tract 31377 (Corte Placitas) generally located along
Hovley Lane West, east of Monterey Avenue, west of Portola Avenue and includes
parcels facing Corte Placitas (thereafter referred to as “Annexation Territory”), to the
District, specifically within Zone #6 (Hovley Lane), pursuant to Chapter 2, Article 2 of the
Act; the establishment of the proposed maximum annual assessment related thereto ;
and the levy and collection of annual assessments against lots and parcels of land
within the Annexation Territory commencing in Fiscal Year 2026/2027 for the
landscaping and lighting improvements and services that will provide special benefits to
the properties within the Annexation Territory pursuant to Chapter 4, Article 2 of the Act
and the California Constitution Article XIII D, and
Whereas, the City Council has retained Willdan as the Assessment Engineer of
Work, for the purpose of assisting with the annexation of the territory to the District, the
establishment of annual assessments, and to prepare and file an Engineer’s Report with
the City Clerk in accordance with the Act.
Now, therefore, be it resolved by the City Council of the City of Palm Desert,
California, as follows:
SECTION 1. The above recitals are true and correct.
SECTION 2. Engineer’s Report.

The City Council hereby orders the Assessment Engineer to prepare and file with
the City Clerk an Engineer’s Report concerning the annexation of territory to the District
within Zone #6 (Hovley Lane); the improvements and services connected therewith and
the proposed levy of annual assessments beginning in the Fiscal Year commencing
July 1, 2026, and ending June 30, 2027, in accordance with Chapter 3, Section 22623
of the Act. Said Engineer’s Report shall contain a description of the improvements and
services, an estimate of the costs financed by the levy of the assessments, the
properties benefiting from the improvements and the method of apportioning the
assessments connected with the annexation of said territory to the District.
SECTION 3. Proposed Improvements.
The proposed improvements and services for the Annexation Territory may
include installation, construction, or maintenance of any authorized improvements under
the Act, including, but not limited to landscaping and lighting improvements and any
facilities which are appurtenant to any of the aforementioned or which are necessary or
convenient for the maintenance or servicing thereof, including parkway landscaping,
street lighting, and tree maintenance as identified for Tract 31377. The Engineer’s
Report prepared in connection with the Annexation Territory shall provide a more
detailed description of the improvements and services to be provided and for which
properties are to be assessed.
SECTION 4. Annexation Territory.
The City Council hereby finds that proposed territory within the Annexation
Territory consists of all lots, parcels and subdivisions of land known as “Tract 31377”
located along Hovley Lane West, east of Monterey Avenue, west of Portola Avenue and
includes twenty (20) residential homes facing Corte Placitas. This Annexation Territory
includes all properties that receive special benefits from the improvements to be
provided and will be incorporated as a sub-area within Zone #6 (Hovley Lane).
SECTION 5. Assessments.
The City Council hereby determines that in order to provide the improvements
described in Section 3 of this Resolution and to be detailed in the Engineer’s Report, it
is necessary to levy and collect assessments against the lots and/or parcels within the
Annexation Territory commencing in Fiscal Year 2026/2027 and said assessments shall
be outlined and described in the annexation and annual Engineer’s Report, and
imposed pursuant to the provisions of the Act and the California Constitution Article XIII
D.
