HomeMy WebLinkAboutRes 2026-023Resolution No. 2026-023 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, INITIATING PROCEEDINGS FOR THE RENEWAL OF THE PRESIDENT’S PLAZA III PROPERTY AND BUSINESS IMPROVEMENT DISTRICT AND THE LEVY AND COLLECTION OF ASSESSMENTS THEREIN, PURSUANT TO THE PROVISIONS OF PART 7 OF DIVISION 18 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE, FOR FISCAL YEAR 2026/2027 Whereas, the City Council desires to initiate proceedings for the renewal of President’s Plaza III Property and Business Improvement District (hereafter referred to as the “District”), pursuant to the provisions of the Property and Business Improvement District Law of 1994, part 7 of division 18 of the Streets and Highways Code of California (hereafter referred to as the “Act”), and for the levy and collection of assessments by the County of Riverside for the City of Palm Desert, in order to pay for the imp rovements and activities that are described in the Management District Plan (hereafter referred to as the “Plan”) and in the Engineer’s Report (hereafter referred to as the “Report”), which are combined; and Whereas, pursuant to the Act, a written petition of the property owners within the District, representing more than 50 percent of the proposed assessments to be renewed and levied, has been submitted requesting that the City Council initiate proceedings pursuant to the Act to renew the District for a five (5) year term; and Whereas, the City Council has retained Willdan Financial Services (hereafter referred to as the “Assessment Engineer”) for the purposes of assisting with the renewal of the District and the establishment of assessments; preparing and filing the Plan with the City Clerk, in accordance with the Act; and preparing and filing the Report with the City Clerk, in accordance with the requirements of California Constitution Article XIII D. Now, therefore, be it resolved by the City Council of the City of Palm Desert, California, as follows: SECTION 1. The above recitals are true and correct and are incorporated herein by this reference. SECTION 2. Preparation of Plan and Report. The City Council hereby orders the Assessment Engineer to prepare and file with the City Clerk the Plan and Report, which addresses the renewal of and the establishment of assessments for the District, in accordance with the Act. SECTION 3. Improvements. The improvements and activities within the District include maintenance of parking lot landscaped areas, maintenance and operation of parking lot lighting facilities, debris removal, and maintenance of parking lot surface areas. These improvements and activities are more specifically described in the Plan and Report that will be filed annually, Docusign Envelope ID: B8E13545-8D7F-83F3-8239-18A3D147FFE9 Resolution No. 2026-023 Page 2 which is attached hereto and incorporated herein by reference. SECTION 4. Boundaries and Designation. The proposed District will consist of all parcels located in the commercial business area known as the President's Plaza Ill within the City of Palm Desert, the County of Riverside, and the State of California. The territory of the proposed District is gen erally located south of Palm Desert Drive at Highway 111, north of El Paseo, west of Sage Lane, and east of Old Highway 74. It also includes the Palm Desert Parking Lot, which is a lease parcel to the City of Palm Desert that is located south of Highway 11 1, east of New Highway 74, and west of Old Highway 74. The proposed District will be designated as the “President’s Plaza III Property and Business Improvement District.” SECTION 5. Effective Date.
