Regular Meeting Minutes
Mayor Pro Tem Joe Pradetto,
1. ROLL CALL - REGULAR MEETING
A Regular Meeting of the Palm Desert City Council was called to order by Mayor Trubee
on Thursday, April 9, 2026, at 4:00 p.m., in the Council Chamber, City Hall, located at
73-510 Fred Waring Drive, Palm Desert, California.
2. PLEDGE OF ALLEGIANCE
Mayor Pro Tem Pradetto led the Pledge of Allegiance.
3. INSPIRATION
Councilmember Moreno provided words of inspiration.
4. REPORT OF CLOSED SESSION
None.
5. AWARDS, PRESENTATIONS, AND APPOINTMENTS
5.a PRESENTATION - KEY TO THE CITY: RON GREGORY
Mayor Trubee presented Ron Gregory with a Key to the City and issued a
proclamation recognizing April 9, 2026, as Ron Gregory Day.
The City Council recessed at 4:11 p.m. and returned to session at 4:25 p.m.
6. CITY MANAGER COMMENTS
Martin Alvarez, Director of Economic Development, introduced the City of Palm Desert
softball team and congratulated them on an undefeated championship season.
7. MAYOR/COUNCILMEMBER REPORTS AND REQUESTS FOR ACTION
Councilmembers provided updates on their attendance at various meetings and events.
Councilmember Moreno requested that staff follow up on public comments received
regarding sidewalk accessibility at the Yum Yum Tree Apartments and the suggestion to
plant fruit trees in public areas.

9.c APPROVE AMENDMENT NO. 1 TO CONTRACT C45120A WITH
ENGINEERING RESOURCES OF SOUTHERN CALIFORNIA FOR THE FIRE
STATION 102 GERALD FORD DRIVE STREET IMPROVEMENTS (PROJECT
NO. CFA00010)
Motion by: Mayor Pro Tem Pradetto
Seconded by: Councilmember Harnik
1. Approve Amendment No. 1 to Contract No. C45120A with Engineering
Resources of Southern California (ERSC), Inc., for additional services in
an amount not to exceed $24,300.
2. Authorize the City Attorney to make any necessary non-monetary changes
to the amendment.
3. Authorize the City Manager to execute the amendment and any
documents necessary to effectuate the actions taken herewith.

9.d APPROVE AMENDMENT NO. 3 TO CONTRACT NO. C41450 WITH
HINDERLITER, DE LLAMAS AND ASSOCIATES (HDL) TO CONTINUE
BUSINESS LICENSE TAX AND FEES ADMINISTRATION
Motion by: Mayor Pro Tem Pradetto
Seconded by: Councilmember Harnik
1. Approve Amendment No. 3 to Contract No. C41450 with Hinderliter, De
Llamas and Associates (HdL) to extend the agreement for a term of up to
one (1) year, administered on a month-to-month basis.
2. Authorize the City Attorney to make any non-monetary changes to the
agreement.
3. Authorize the City Manager or designee to execute the amendment and
any related documents necessary to implement the agreement.

9.e FIRST AMENDMENT TO CONTRACT NO. C40870 WITH PALM SPRINGS ART
MUSEUM, INC., FOR THE LEASE OF THE FAYE SARKOWSKY SCULPTURE
GARDEN LOCATED AT ENTRADA DEL PASEO
Motion by: Mayor Pro Tem Pradetto
Seconded by: Councilmember Harnik
1. Approve the First Amendment to Contract No. C40870 with Palm Springs
Art Museum, Inc., for the lease of the Faye Sarkowsky Sculpture Garden
located at Entrada del Paseo.
2. Authorize the City Attorney to make any necessary non-monetary changes
to the agreement.
3. Authorize the City Manager to execute the amendment and all documents
necessary to effectuate this action.

10. ACTION CALENDAR
10.a INTRODUCTION OF AN ORDINANCE ADDING SECTION 5.10.130 TO
CHAPTER 5.10 OF THE PALM DESERT MUNICIPAL CODE TO IMPLEMENT
THE SHORT-TERM RENTAL FACILITATOR ACT OF 2025 REGARDING
SHORT-TERM RENTAL FACILITATOR REPORTING – CEQA
DETERMINATION
Arlene Arellano, Accountant, narrated a PowerPoint presentation and responded
to City Council inquiries.
Motion by: Mayor Trubee
Seconded by: Councilmember Nestande
1. Find that the adoption of the proposed ordinance is exempt from review
under the California Environmental Quality Act (“CEQA”) under CEQA
Guidelines Sections 15378 and 15061(b)(3), as set forth herein.
2. Introduce Ordinance No. 1444 entitled “AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ADDING
SECTION 5.10.130 TO CHAPTER 5.10 OF THE PALM DESERT
MUNICIPAL CODE TO IMPLEMENT THE SHORT-TERM RENTAL
FACILITATOR ACT OF 2025 (SENATE BILL 346) REGARDING SHORT-
TERM RENTAL FACILITATOR REPORTING AND MAKING A FINDING
OF EXEMPTION UNDER CEQA.”

10.b RESOLUTION ADOPTING THE CODE OF CONDUCT FOR ELECTED AND
APPOINTED OFFICIALS
Anthony Mejia, City Clerk, provided a staff report and responded to City Council
inquiries.

Seconded by: Councilmember Moreno
Adopt Resolution 2026-013 entitled “A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PALM DESERT, CALIFORNIA, ADOPTING A CODE OF
CONDUCT FOR ELECTED AND APPOINTED OFFICIALS,” as amended to
clarify in Section 7 that “appointed bodies” refers to the City’s Boards,
Commissions, Committees, and Task Forces, and in Section 8 that the order of
official representation at official events, meetings, and functions shall be the
Mayor, Mayor Pro Tem, and Immediate Past Mayor, in that order if the Mayor is
unavailable.

11. PUBLIC HEARINGS
11.a INTRODUCTION OF AN ORDINANCE AMENDING CHAPTER 9.26 OF THE
PALM DESERT MUNICIPAL CODE RELATING TO UNLAWFUL CAMPING
Pedro Rodriguez, Code Compliance and Support Services Manager, narrated a
PowerPoint presentation and responded to City Council inquiries.
Mayor Trubee opened and closed the public hearing there being no member of
the public wishing to speak.

Seconded by: Councilmember Nestande
Introduce an Ordinance No. 1445 entitled, “AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING
CHAPTER 9.26 OF THE PALM DESERT MUNICIPAL CODE RELATING TO
UNLAWFUL CAMPING AND MAKING A FINDING OF EXEMPTION UNDER
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT.”

11.b ADOPT AND APPROVE COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG) SUBSTANTIAL AMENDMENTS TO THE ANNUAL ACTION PLANS
FOR PROGRAM YEARS 2023 AND 2024
Ivan Tenorio, Homeless and Supportive Services Manager, narrated a
PowerPoint presentation and responded to City Council inquiries.
Mayor Trubee opened and closed the public hearing, there being no member of
the public wishing to speak.
Motion by: Councilmember Harnik
Seconded by: Mayor Pro Tem Pradetto
1. Conduct a public hearing, receive public testimony, and approve the
Substantial Amendment to the Program Year (PY) 2023 and 2024 Annual
Action Plans.
2. Adopt the Substantial Amendment to PY 2023 to reallocate $125,000 in
unspent funds to the City of Palm Desert Housing Authority for capital
improvement projects.
3. Adopt the Substantial Amendment to PY 2024 to reallocate $5,000 in
unspent funds to the City of Palm Desert Housing Authority for capital
improvement projects.
4. Authorize the Director of Finance to appropriate funds for the applicable
CDBG Accounts, if necessary to implement the approved amendments.
5. Authorize the City Manager to execute any documents necessary to
implement the actions taken herewith.

11.c APPEAL OF PLANNING COMMISSION DECISION APPROVING AN
ADDENDUM TO MITIGATED NEGATIVE DECLARATION, FINDING THE
PROJECT EXEMPT FROM CEQA UNDER GUIDELINES SECTION 15183,
AND APPROVING A PRECISE PLAN AND TENTATIVE TRACT MAP 39307,
PORTOLA SPRINGS PROJECT
This item was continued to a date uncertain.
