HomeMy WebLinkAboutRes No. 2916 Hillside ODSPLANNING COMMISSION RESOLUTION NO. 2916 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE TO ADOPT HILLSIDE RESIDENTIAL DESIGN STANDARDS, MODIFY SECTIONS OF PALM DESERT MUNICIPAL CODE TITLE 25 PERTAINING TO THE HILLSIDE RESIDENTIAL DESIGN STANDARDS AND FIND THAT THE ACTION IS NOT A PROJECT SUBJECT TO CEQA, OR IN THE ALTERNATIVE, IS EXEMPT FROM CEQA UNDER STATE CEQA GUIDELINES SECTION 15061(B)(3) CASE NO. ZOA 25-5001 WHEREAS, Government Code Section 65800 et seq. provides for the amendment of any and all adopted City of Palm Desert (“City”) zoning laws, ordinances, rules and regulations; and WHEREAS, the Zoning Ordinance Amendment (ZOA) is initiated by the City of Palm Desert to adopt Hillside Residential Design Standards and modifies sections of the Palm Desert Municipal Code (PDMC) Title 25 (Zoning) to incorporate the standards and processes to use for new residential developments within the Hillside Residential zoning district; and WHEREAS, the City has complied with the requirements of the Local Planning and Zoning Law (Government Code section 65100 et seq.), and the City’s applicable ordinances and resolutions with respect to approval of amendments to Title 25 of the Palm Desert Municipal Code (“Zoning Ordinance”); and WHEREAS, the Project has complied with the requirements of the "City of Palm Desert Procedure for Implementation of CEQA” Resolution No. 2024-035, in that the Director of Development Services has determined that the Project will not have a foreseeable significant impact on the environment and the proposed action is not a project subject to CEQA, or in the alternative, is exempt from CEQA under State CEQA Guidelines section 15061(b)(3); and WHEREAS, the Planning Commission of the City of Palm Desert, California, did on December 16, 2025, hold a duly noticed public hearing to consider the request by the City of Palm Desert for approval of Zoning Ordinance Amendment (“ZOA”) 25-5001; and WHEREAS, the City Council of the City of Palm Desert, California, did on January 8, 2026, hold a duly noticed public hearing to consider the request by the City of Palm Desert for approval of Zoning Ordinance Amendment (“ZOA”) 25-5001; and WHEREAS, staff identified inconsistencies in the document after adoption and determined that a re-adoption of the ordinance was required; and          PLANNING COMMISSION RESOLUTION NO. 2916 2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on March 3, 2026, hold a duly noticed public hearing to consider the request by the City of Palm Desert for approval of Zoning Ordinance Amendment (“ZOA”) 25-5001; and WHEREAS, at the said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, the Planning Commission did find the following facts and reasons, which are outlined in the staff report, to exist to justify approval of said request; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred; and NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: SECTION 1. CEQA. The Planning does recommend that the City Council finds that adoption of this ordinance is not a “project,” as defined in the California Environmental Quality Act (CEQA) because it does not have a potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment and concerns general policy and procedures. SECTION 2. Findings. The Planning Commission of the City of Palm Desert hereby finds that: A. The City of Palm Desert, California (“City”) is a municipal corporation, duly organized under the constitution and laws of the State of California; and 1. The Planning and Zoning Law authorize cities to establish by ordinance the regulations for land use and development. SECTION 3. Amendment. The Planning Commission of the City of Palm Desert recommends that the City Council of the City of Palm Desert, California, approve and adopt the PDMC amendments to Title 25 as shown in “Exhibit B”, which is attached hereto and incorporated herewith. SECTION 4. Severability. If any section, subsection, subdivision, paragraph, sentence, clause, or phrase in this ordinance or any part thereof is for any reason held to be unconstitutional or invalid, or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this ordinance or any part thereof. The Planning Commission hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause, or phrase thereof irrespective of the fact that one (1) or more subsections, subdivisions, paragraphs, sentences, clauses, or phrases be declared unconstitutional, invalid, or ineffective. The Planning Commission hereby recommends to the Palm Desert City Council approval of the Hillside Residential Design Standards and Zoning Ordinance Amendment 25-5001, as depicted in “Exhibit A” and “Exhibit B”, respectively, attached hereto; and SECTION 6. Execution of Resolution. The Chairperson of the Planning Commission shall sign this Resolution, and the Secretary to the Commission shall attest and certify the passage and adoption thereof.
