A Resolution of the City Council of the City of Palm Desert, California,
Approving FY 2026-27 Solid Waste, Recycling, and Organics Service
Rates and Authorizing Annual Rate Adjustments through July 1, 2030,
Pursuant to the Franchise Agreement with Burrtec Waste and Recycling
Services, LLC
Whereas, the City of Palm Desert (“City”) maintains an exclusive franchise
agreement with Burrtec Waste and Recycling Services, LLC (“Burrtec”) for solid waste,
recycling, and organics collection services within the City; and
Whereas, the City has contracted with Burrtec since 2006 to provide solid waste
collection and related services to residential and commercial customers; and
Whereas, on March 10, 2022, the City Council approved amendments to the
franchise agreement to implement Senate Bill 1383 (“SB 1383”) requirements, including
organics collection, contamination monitoring, outreach, reporting, and food recovery
programs; and
Whereas, on March 10, 2022, the City Council also approved phased rate
adjustments through July 1, 2025, and annual Consumer Price Index (“CPI”) based
adjustments tied to the Garbage and Trash Collection Index and disposal-related costs;
and
Whereas, the current rate schedule approved in 2022 expires June 30, 2026, and
updated rates and future annual adjustment authority are necessary to continue funding
solid waste, recycling, organics diversion, disposal, and SB 1383 compliance services
required under the franchise agreement; and
Whereas, Article XIII D of the California Constitution and Proposition 218 require
the City to conduct a public hearing and consider all written protests and public
comments related to proposed property-related service rate adjustments; and
Whereas, a 45-day Proposition 218 notice was mailed by May 6, 2026, to
affected property owners and customers outlining the proposed rates, protest
procedures, and public hearing information in an abundance of caution and without
conceding the applicability of Proposition 218 to privately provided solid waste service;
and
Whereas, on June 25, 2026, the City Council conducted a duly noticed public
hearing to receive and consider all public testimony, written protests, and other evidence
regarding the proposed FY 2026-27 solid waste, recycling, and organics service rates;
and

Resolution No. 2026-039 Page 2
Whereas, at the conclusion of the public hearing, the City Council determined
that a majority protest, as defined under Proposition 218, did not exist; and
Whereas, the City Council now desires to impose the proposed solid waste,
recycling, and organics collection service rates set forth in Exhibit A, attached hereto
and incorporated herein by this reference.
Now, therefore, be it resolved by the City Council of the City of Palm Desert,
California, as follows:
Section 1. Recitals.
That the foregoing Recitals are true and correct and are incorporated herein by this
reference.
Section 2. Approval of FY 2026-27 Service Rates.
Approves the FY 2026-27 solid waste, recycling, and organics service rates set forth in
Exhibit A, attached hereto and incorporated herein by this reference.
Section 3. Authorization of Annual Rate Adjustments.
Authorizes annual rate adjustments for a five year period through and including July 1,
2030, without further public hearings in accordance with the provisions and
methodology established in the franchise agreement between the City of Palm Desert
and Burrtec Waste and Recycling Services, LLC.
Section 4. Annual Adjustment Methodology.
Beginning July 1, 2027, annual rate adjustments shall be based on changes in the
Garbage and Trash Collection Index, capped at five percent (5%) annually, and
disposal fee adjustments as authorized pursuant to the franchise agreement.
Section 5. Proposition 218 Compliance.
Finds that the approved rates do not exceed the funds required to provide the solid
waste, recycling, organics diversion, disposal, outreach, and SB 1383 compliance
services for which the rates are charged and that the rates comply with Proposition 218
and all applicable provisions of law.
Section 6. Implementation Authority.
The City Manager, or designee, is hereby authorized and directed to implement the
rates approved by this Resolution and set forth in Exhibit A, and to take such additional
actions as necessary to carry out the intent of this Resolution.

Section 7. California Environmental Quality Act.
This Resolution is not subject to the requirements of the California Environmental
Quality Act (CEQA) pursuant to California Public Resources Code section 21080(b)(8)
and State CEQA Guidelines section 15273(a) because the administration, operation,
maintenance, and improvements of the solid waste collection system are necessary to
maintain solid waste services within the City’s existing service area and such solid
waste, recycling, and organics collection service rates are necessary and reasonable to
fund the administration, operation, maintenance, and improvements of the solid waste
collection system.
Section 8. Severability.
If any provision of this Resolution or the application thereof to any person or
circumstance is held invalid by a court of competent jurisdiction, such invalidity shall not
affect other provisions or applications, and to this end the provisions of this Resolution
are declared to be severable.
Section 9. Effective Date.
This Resolution shall become effective immediately upon its adoption.
Adopted on June 25, 2026.
