APPLICANT: J.P. CONSTRUCTION, INC. INDUSTRIAL WEST 74-831 Velie Way, Suite 1 74-947 Highway Ill Palm Desert, CA 92260 Indian Wells, CA 92210 I. BACKGROUND: The industrial building in question was constructed approximately two years ago as phase I of a three phase project. The applicant is presently in the process of attempting to obtain a building permit for phase II. However, prior to obtaining a permit the applicants must resolve an existing outdoor storage problem. II. PROBLEM: The current tenant in the existing building is a building materials supplier and is currently using the entire off-street parking lot on the east side of the building for storage of materials. This is a violation of the zoning ordinance in that the storage is deleting the utilization of the parking lot for cars. Thus, employees and customers must park on the street. III. PROPOSED RESOLUTION OF PROBLEM: The project when constructed was provided with an extra wide (51.6 foot) aisle instead of the required 24 feet. The westerly part of the phase II parking lot will be intergrated with the existing parking lot. The applicant is requesting approval to permit modified outdoor storage by reducing the aisle width to 24 feet, using the excess width next to his building for storage, using the nine parking spaces along the east side of the existing parking lot for storage, and providing seven parking spaces in the now unparkable lot. The balance of his five required spaces would be provided in the soon to be constructed phase II lot which has in its two parking areas on each side of the building an extra six spaces. Furthermore, the applicant is requesting that they not be required to implement the change until the phase II building is completed in the next three or so months. IV. CONCLUSION: Generally, the request would allow some outdoor storage which is necessary for the business if it is to remain. Off-street parking when included with the phase II area will provide the code required parking. V. RECOMMENDATION: The planning commission should determine whether the proposed change is acceptable. Due to the type of use, customer demand for parking will probably be minimal. If the planning commission approves this modification, it should be subject to the following: A. No final occupancy shall be granted to the phase II building until the plan as shown is striped and implemented. PP 01-82 January 15, 1985 B. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Trash enclosures location and access to be approved by Palm Desert Disposal Company prior to issuance of building permit. 7. Approval is subject to compliance with revised setbacks proposed by ZOA 09-82. City Fire Marshal• 1. Install a water system capable of delivering 3000 GPM fire flow for a three (3) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 150 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the-tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. -2- PLANNING COMMISSION RESOLUTION NO. 825 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company with the following certification: "I certify that the design of the water system in Case No. PP 01-82 is in accordance with the requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating, and delivering the required flow. 6. All three buildings require an automatic fire sprinkler system. PUBLIC HEARINGS A. f Continued Case No. PP 01-82 - J.P. CONSTRUCTION, INC., Applicant Request for approval of a precise plan to allow construction of three industrial buildings on a 101,045 sq.ft. parcel in the S.I. zone on the north side of Mayfair Drive, east of Green Way. This case was continued from the regular meeting of October 5, 1982. Mr. Sawa stated that staff had made several changes to the conditions of approval from the previous report and because the applicant had submitted a revised plan. Deletion of Condition Nos. 6, 7, 10, and 11 relating to access easements, handicap parking, parking aisle widths, and turn-around area was appropriate at this time. Mr. Sawa explained that the only area of conflict between staff and the applicant is that a paved driveway be constructed with Phase II because of a dead-end aisle between buildings. Mr. Sawa noted that some of the conditions from the fire marshal have also been changed from the previous report. Staff recommended approval. MINUTES PALM DESERT PLANNING COMMISSION OCTOBER 19, 1982 Chairman Wood opened the public hearing and asked if the applicant cared to make a presentation. MR. SVEND PEULICKE, 74-831 Velie Way, stated he discussed the revised plan with staff and explained why he was requesting deletion of Condition No. 9, which states: "Provide a minimum 24 foot wide aisle from 20 foot aisle at rear of lot to street on Phase II parking lot to eliminate dead-end aisle for Phase I parking lot." Mr. Peulicke stated that the dead-end aisle would be temporary and to install the 24 foot wide aisle would be very costly. Commissioner Crites asked staff if Condition No. 9 could be reworded to state that the 24 foot wide aisle would be built if Phase II is not constructed within a certain period of time. Commissioner Kryder concurred. Mr. Diaz explained that such a condition would be difficult to enforce and because the parking area is the last item of construction it would not be a hardship to install the added aisle and eliminate the dead-end parking. Commissioner Richards asked how much it would cost to put 24 ft. of paving. Mr. Peulicke replied that it would cost approximately $3,000. Commissioner Downs stated that in a previous case like this, they had bonded with the city and it worked out fine. Mr. Diaz replied that there are problems with bonding. It is difficult for the city to call a bond if necessary. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Moved by Commissioner Crites, seconded by Commissioner Downs, to adopt findings as recommended by staff. Carried unanimously 5-0. Mr. Joy explained they are units in which you do not buy a piece of land, only the air space of the unit; the land is owned in common. DESIGN REVIEW BOARD ACTION: PP 01-82 OCTOBER 5, 1982 The design review board reviewed and approved architectural plans for Phase I of the project on August 10, 1982, with the exception of the landscape plans. The planning commission confirmed the design review board action on August 17, 1982. For your information, the architectural style of the buildings is contemporary with exterior materials consisting of tilt up waffle-crete panels, and a small blue tile roof over the street entry. Contrasting colors and textures are utilized to add architectural interest. III. ANALYSIS- A. FINDINGS NEEDED FOR APPROVAL: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and has received preliminary design review board approval and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project has been previously assessed in connection with TT 13236, and, no further documentation is deemed necessary. ALAN PERRIER, 3001 Tahquitz-McCallum, Palm Springs, explained that he represented Mr. Fox, owner of 97 acres in the study area. He felt that the proposals were not adequately understood and severely limited his client's property. A great deal of time and effort went into the Palm Valley Specific Plan and implementation of its recommendation could result in high quality attractive development. He also objected to the prohibition of hotel development in the new plan's zone. He requested that the commission study the issues more thoroughly before making a decision. ROBERT RICCIARDI, 42-600 Bob Hope Drive, Rancho Mirage, stated that he represented owners of 50 acres in the study area and argued that the slope formula and the development options were too rigid. He favored proposals which would give the commission greater flexibility in determining density and grading. He also requested a continuance so that alternative proposals could be developed. Vice Chairman Richards felt that the plan was not clear to the property owners in informing them of the number of dwelling units they could develop; more precise information as to permitted land uses should be provided. He concluded that this matter should be continued until then.
