CONDITIONS OF APPROVAL
PP 02-82
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following ;I
conditions. 1
2. The development of the property described herein shall be subject to the J
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. That all conditions of the design review board shall be met.
6. Five foot high block wall between south property line and southeast corner of .£
building shall be setback to west to be even with face of building; patio walls
adjacent to San Pablo Avenue shall be placed three feet to the west to provide safe
visibility for cars utilizing driveway to south.
7. Redwood headers shall be used to separate planter areas from lawn areas.

THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF A THREE UNIT APARTMENT AT
THE SOUTHWEST CORNER OF SAN PABLO AVENUE
AND ROYAL PALM DRIVE.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 1st day of February, 1983, hold a duly noticed public hearing to consider the request
of JAMES SATTLEY for approval of a precise plan of design to allow construction of a
three unit apartment in the R-2 (5) and R-2, S.P. zone at the southwest corner of San
Pablo Avenue and Royal Palm Drive, more particularly described as:
APN's 627-085-005 and 006
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project is a Class 3, categorical exemption for purposes of CEQA, and no further
documentation is necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will r not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 02-82 is hereby granted for reasons subject to
the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 1st day of February, 1983, by the following vote, to
wit:

PALM DESERT PLANNING COMMISSION
FEBRUARY 1, 1983
Commissioner Crites felt that the preschool facility could change in the future
from what is being proposed. He suggested a condition be added to 'restrict the hours of
playtime.
Mr. Kite, in answering the question of Ms. Barnett, explained that 24 children are
presently enrolled but the school is not in operation. They would be open to the
community and their idea is to give high quality Christian Montessori education; it would
not be a day care center.
Chairman Wood closed the public hearing and asked for the pleasure of the
commission.
Commissioner Crites felt that the noise impact would to some extent carry over to
the adjacent neighborhood and therefore, suggested a condition be added to address this
concern.
Commissioner Kryder pointed out that a conditional use permit is approved with
the understanding that the commission has the ability to revoke the permit if any
violations occur. He felt a restriction for playtime is not necessary.
Commissioner Richards felt the preschool would be located in an area where it is
properly zoned for this use and explained that a preschool represents a good use for a
church and is very much needed in this city.
Chairman Wood stated he was sympathetic to the concerns of the Indian Creek
Villa owners but it would not be fair to disallow this preschool to operate in the area
proposed.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt
findings as recommended by staff. Carried unanimously 4-0.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt
Planning Commission Resolution No. 839, approving CUP 01-83, subject to conditions.
Carried unanimously 4-0.
Case No. PP 02-82 - JAMES SATTLEY, Applicant
Request for approval of a precise plan of design to allow
construction of a three unit apartment in the R-2 (5) and
R-2, S.P. zone at the southwest corner of San Pablo
Avenue and Royal Palm Drive.
Mr. Sawa reviewed the staff report and conditions of approval; staff recommended
approval.
Chairman Wood asked since this property is in the AO-1 flood zone, if a fill would
be required. Mr. Sawa replied that there would. Chairman Wood was concerned about a
possible problem of the grade being much higher than existing neighboring properties.
Chairman Wood opened the public hearing and asked if the applicant cared to make
a presentation. The applicant was not present. Chairman Wood asked if anyone present
wished to.speak in FAVOR or OPPOSITION to this case. There being none, the public
hearing was closed.
Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt
findings as recommended by staff. Carried unanimously 4-0.
Moved by Commissioner Crites, seconded by Commissioner Richards, to adopt
Planning Commission Resolution No. 840, approving PP 02-82, subject to conditions.
Carried unanimously 4-0.

I. BACKGROUND•
A. DESCRIPTION OF SITE:
The property is a relatively flat vacant lot consisting of approximately
16,400 sq.ft. of area. There are several palm trees on the lot, most of which
will be retained and/or relocated.
B. ADJACENT ZONING AND LAND USE:
North: R-2 (5)/Water District Tank
South: R-2, S.P./Residence
East: R-2/Vacant
West: R-2 (5)/Residence
C. GENERAL PLAN LAND USE DESIGNATION:
Medium Density Residential 5-7 d.u./acre
H. PROJECT DESCRIPTION:
A. GENERAL:
The proposal is to construct a three unit apartment with two detached three
car carports. The residential structures will be constructed in a "L" shape
with a swimming pool in the courtyard area.
B. DESIGN REVIEW BOARD:
The preliminary and final plans have been approved by the design review
board, subject to some minor changes to the architecture and landscaping,
and approval of this request.
C. ARCHITECTURE/LANDSCAPING:
The project will be Spanish in nature with exterior materials consisting of
stucco, wood trim, and some tile roofing. There are a number of palm trees
on the site which have been incorporated into the landscaping scheme.
D. FLOOD ZONE DESIGNATION:
The property is in the AO-1 flood zone and will need clearance from the
dept of public works prior to issuance of building permits.
III. ANALYSIS•
A. FINDINGS NEEDED FOR APPROVAL:

1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
Justification:
The design of the use is attractive and compatible with other
residential uses existing in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in vicinity by the occupants thereof for lawful
purposes.
Justification:
The surrounding land in the vicinity is zoned for the same type of use
as proposed and owners would not be deprived the use of their land.
3. The precise plan will not endanger the public peace, health, safety, or
general welfare.
Justification:
The precise plan complies with all code requirements and has
received design review board approval and will not be detrimental to
the public peace, health, safety or general welfare.
Staff feels the findings for approval can be justified for this precise plan.
B. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the proposed
project is a Class 3 categorical exemption for purposes of CEQA and no
further documentation is necessary.
IV. STAFF RECOMMENDATION:
Staff feels the proposed project is acceptable and recommends:
1. Adoption of the findings; and
2. Adoption of Planning Commission Resolution No. , approving PP
02-82, subject to the conditions attached thereto.
