PP 04-83 r -c a WHEREAS the planning commission of the City of Palm Desert, California, did on the 19th day of April, 1983, hold a duly noticed public hearing to consider the request e -- of EDWARD F. REED TRUST, for approval of a precise plan of design to allow construction of a three unit apartment in the R-3 zone on the west side of Las Palmas between Alessandro and San Gorgonio, more particularly described as: A.P.N.'S 627-092-016 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project is a Class 3 categorical exemption for purposes of CEQA and no further documentation is necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise Ian will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 04-83 is hereby granted for reasons subject to the attached conditions. The development of the property shall conform substantially with exhibits on file with the department of environmental services as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a buildinghpermit for construction of any use contemplated by this approval, the applicants all first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. WEXLER ASSOCIATES, Applicants Request for approval of a precise plan of design and Negative Declaration of Environmental Impact to allow construction of a district operations center in the S.I. zone located on the west side of State Street between Mayfair Drive and Sego Lane. Mr. Diaz reviewed the staff report and recommended approval. Commissioner Kryder asked if this development was strictly for office use. Mr. Diaz replied that it would serve as their main service facility. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. DePACARMA, representing Southern California Gas Co., stated he was present to answer any questions the commission might have. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case; there being none, the public hearing was closed. Moved by Commissioner Kryder, seconded by Commissioner Richards, to adopt findings as recommended by staff; carried unanimously 4-0. Case No. PP 03-83 - ARMORED TRANSPORT OF CALIFORNIA, INC., AND STEVEN SULLIVAN, ARCHITECT, Applicants Request for approval of a precise plan of design to allow construction of a 6150 square foot industrial building in the S.I., S.P. zone located on the north side of 42nd Avenue, west of Eclectic Street. Mr. Diaz reviewed the staff report and recommended approval of this case. Chairman Wood opened the public hearing and 'asked if the applicant wished to make a presentation. MR. CLEMENS STADLER, 73-850 Colton Circle, stated he was present to answer any question the commission might have. Chairman Wood asked.if anyone present wished to speak in FAVOR or OPPOSITION to this matter; there being none, the public hearing was closed. DISCUSSION: The proposed three unit apartment complies with all provisions of the zoning ordinance. This hearing is to review only the site plan as it has been submitted. II. BACKGROUND: A. DESCRIPTION OF SITE: The property is a flat vacant lot consisting of approximately 9147 square feet of area. B. ADJACENT ZONING AND LAND USE: North: R-3 - Multifamily South: R-3 - Multifamily East: R-3 - Multifamily West: R-1 - Vacant C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 d.u./acre III. PROJECT DESCRIPTION: A. GENERAL: The proposal is to construct a three unit apartment with an attached three car garage. The residential structures will be constructed in a linear fashion with the garages facing the street. B. DESIGN REVIEW BOARD: The preliminary plans have been approved by the design review board, subject to some minor changes. C. ARCHITECTURE/LANDSCAPING: The project will be similar in nature to the existing units to the south with exterior materials consisting of stucco, wood trim and white rock roof. IV. ANALYSIS: Due to the lot configuration the three units have been located on the lot in linear fashion. Facing the street is a three car garage. To the south and east of the garage three open parking spaces are provided. Open space for the units is located - 1 - CASE NO. PP 04-83 APRIL 19, 1983 ANALYSIS (CONTINUED): in the side yards. This apartment complex will be operated by the same people as the existing units to the south and will have use of the swimming pool at that location although access thereto will not be direct. A. FINDINGS NEEDED FOR APPROVAL: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for similar types of uses as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welare. Justification: The precise plan complies with all code requirements and has received design review board approval and will not be detrimental to the public peace, health, safety or general welfare. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for purposes of CEQA and no further documentation is necessary. IV. STAFF RECOMMENDATION: Staff feels the proposed project is acceptable and recommends: 1. Adoption of the findings; and 2. Adoption of Planning Commission Resolution No. , approving PP 02-82, subject to the conditions attached thereto.
