Water District File f PLANNING COMMISSION RESOLUTION NO. 870 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN AND AN ADJUSTMENT TO ALLOW CONSTRUCTION OF A . THREE UNIT APARTMENT ON THE NORTH SIDE OF SANTA ROSA WAY, 84' EAST OF SAN PASCUAL AVENUE. CASE NO. PP 08-83 AND ADJ 02-83 WHEREAS the planning commission of the City of Palm Desert, California, did on the 19th day of July, 1983, hold a duly noticed public hearing to consider the request of ROBERT McLACHLAN and MIKE SCURO, for approval of a precise plan of design and an adjustment to allow the development of a triplex in an R-2 zone on the north side of Santa Rosa Way, eighty feet,east of San Pascual Avenue. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement -the California. Environmental Quality Act, Resolution No. 80-891', in that the director of environmental services has determined that the project is a Class 3 Categorical Exemption for purposes of CEQA and no further documentation is necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity.. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the.vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger .the public peace,. health, safety or general welfare. 4. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. 5. There are exceptional circumstances or conditions applicable to the properties in the same zone. 6. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same-vicinity and zone. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct. and constitute the findings of the commission in this case. 2. That approval. of Precise Plan 08-83 and Adjustment 02-83 is hereby granted for reasons subject to.the attached conditions. PASSED,. The development of the property shall conform substantially with exhibits on file with the department of environmental services as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the" applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Architectural Commission City Fire Marshal. Coachella Valley Water District Palm Desert Community Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. That all conditions of the architectural commission shall be met. Department of Public Works: 6. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to issuance of building permits. 7. Drainage facilities shall be provided per Ordinance No. 218 and the master drainage plan to the specifications of the director of public works. 8. Full public improvements, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 9. Complete improvement plans and specifications shall be submitted to the city engineer for checking and approval before construction of any improvements is commenced. The developer shall submit "as-built" plans prior to acceptance of the street improvements by the city. 10. This property is in the AO Depth 1' Zone as shown on the flood insurance rate map. A flood hazard report, as required by Ordinance No. 221 (flood damage prevention ordinance) shall be submitted to the public works department. The report must be approved by"the flood review committee prior to issuance of building permits. V 11. Five-foot dedication on the north side of Santa Rosa Way to complete.sixty-foot right of way. 1 / 12. Installation of curb and gutter at 18 feet from centerline and match-up paving. MINUTES PALM DESERT PLANNING COMMISSION JULY 19, 1983 MR. ED WARD, manager of apartments near the proposed arcade, 44-845 Las Palmas, stated his major concern was no buffer zone next to the proposed arcade. He felt that the use would lead to serious problems. Commissioner Richards responded stating that Mr. Ward should have been aware of the zoning in that area when he developed his apartments. He assured him that if the use fails to meed the city's guidelines the permit could be taken away. MR. JOHN BARKOU, representative of the White Sheet, stated his concern for vandalism. He requested denial. Chairman Wood noted that if adjacent property owners experience any problems the could come to the city council and present their problems. A FIVE MINUTES RECESS WAS CALLED - THE MEETING RECONVENED AT 2:45 P.M. Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt findings as recommended by staff; carried 4-0-1 (Commissioner Downs abstaining). Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt Planning Commission Resolution No. 869, approving Case No. CUP 12-83, subject to conditions as amended; carried 4-0-1 ((fommissioner Downs abstaining). Case Nos. ` P 08-83 d ADJ 02-83 - ROBERT MC LACHLAN and MIKE SCURO, App ' is Request for approval of a precise plan of design and adjustment to reduce the rear yard setback from twenty to fifteen feet to allow the development of a triplex in the R-2 zone-on the north side of Santa Rosa Way, eighty feet east of San Pascual Avenue. Mr. Joy reviewed the staff report and noted a letter was received in opposition from the property owner to the north because of the proposed density and setback. Staff recommended approval. Commissioner Kryder asked for a clarification on the parking analysis. Mr. Joy explained and stated there would be sufficient parking spaces. Chairman Wood opened the public hearing and asked if the applicant cared to make a presentation. MR. BILL ROSS, representative, stated they had had financing problems for the project in the past, resulting in this second request. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case; there being none, the public hearing was closed. Moved by Commissioner Crites, seconded by Commissioner Downs, to approve findings as recommended by staff; carried unanimously 5-0. Proposal for hotel at the corner of Lupine and Sage on El Paseo Chairman Wood stated that since this item was originally not placed on the agenda and the commission would like to give it reasonable time needed for study, he suggested that it be scheduled for the next study session. Commission agreed. Moved by Commissioner Downs, seconded by Commissioner Crites, to schedule this item for the next study session, August 2, 1983; carried unanimously 5-0. - 3 - b • e City of Palm Desert Staff Report TO: Planning Commission DATE: July 19, 1983 CASE NO: PP 08-83 and ADJ 02-83 REQUEST: Approval of a precise plan of design and an adjustment to reduce the rear yard setback from twenty to fifteen feet to allow the development of a triplex in an R-2 zone on the north side of Santa Rosa Way, eighty feet east of San Pascual Avenue. APPLICANTS: ROBERT MC LACHLAN MIKE SCURO 74-075 El Paseo 81-211 Helen Palm Desert, CA 92260 Indio, CA I. BACKGROUND: A. DESCRIPTION OF SITE: The site is vacant, relatively flat and is 12,938 square feet in area and is bordered to the east by a single family residence with a four foot chain link fence overgrown with oleanders. To the north is a single family residence just being completed and a six foot block wall as measured from that property. B. ADJACENT ZONING AND LAND USE: NORTH: R-I/Single Family Residential SOUTH: R-2/Vacant EAST: R-2/Single Family Residential WEST: R-2/Vacant C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 d.u./acre. II. PROJECT DESCRIPTION: The project was originally approved by the design review board on March 11, 1980; however that approval expired one year from the date of approval, hence the requirement of the resubmittal. At the time the original approval was given, the design review board review was all that was necessary. The city now requires a precise plan of design which includes a public hearing, thereby giving adjacent property owners legal notice of this type of development. (i.e. any project of two or more dwelling units on the same parcel). The zoning allows one dwelling unit for every four thousand square feet of land area, or in this case, with a 12,000 square foot lot, three dwelling units. The triplex will consist of two bedroom units that are 875 square feet in area. This type of development requires a total of six off-street parking spaces which the applicant is providing in the form of two three car garages. The units are arranged in an "L" shape with the garages facing each other in the front portion of the property. The adjustment in this case will allow part of the structure to be sixteen feet from the rear property line while the required setback is twenty feet. This adjustment was previously granted by the previous zoning administrator due to a requirement that the applicant dedicate five feet of right-of-way along Santa Rosa Way. - 1 - CASE NO. PP 08-83 and ADJ 02-83 JULY 19, 1983 Presently the single family residence to the north includes a detached accessory structure five feet set back from the same property line. III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for similar types of uses as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and has received design review board approval and will not be detrimental to the public peace, health, safety or general welfare. B. FINDINGS NEEDED FOR APPROVAL OF THE ADJUSTMENT: 1. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. Justification: The strict application of the twenty foot setback would result in a decrease of the usable amount of open space. 2. There are exceptional circumstances or conditions applicable to this property not applicable to other properties in the same zone. Justification: Adjacent to this property is a detached accessory structure five feet from the same property line. The applicant's structure will have a sixteen foot setback from the property line. 3. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. Justification: Other multifamily structures in the neighborhood were built with reduced setbacks due to being processed by the county prior to incorporation. 4. The granting of an adjustment will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity. - 2 - CASE NO. FINDINGS NEEDED FOR APPROVAL OF THE ADJUSTMENT (CONTINUED): Justification for Finding No. 4: The granting of the adjustment does not relieve the applicant from obtaining all other necessary permits and meeting all other development standards. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for purpsoes of CEQA and no further documentation is necessary. IV. STAFF RECOMMENDATION: Staff feels the proposed project is acceptable and recommends: 1. Adoption of the findings; and 2. Adoption of Planning Commission Resolution No. , approving PP 08-83 and ADJ 02-83, subject to the conditions attached thereto. I was delighted to see that two of my neighbors have de- cided to petition the Planning Commission for a variance to construct three housing units on an R-2 zoned site. -rhis agrees with my concept that necessary changes need to be made in the present restrictive zoning ordinances to enable more people to join our lovely community. It is obvious that single family home ownership is fast be- coming a thing of the past for a majority of our people. We in government, and the landlord class , must step in and do whatever possible to provide affordable shelter for persons less fortunate than ourselves. This particular area of Palm Desert would seem to me to be the ideal location for higher density residential development to accomplish this worth- while goal.
