APPLICANT: DIANE STEWART P.O. Box 1132 Rancho Mirage, CA 92270 I. BACKGROUND: A. PREVIOUS APPROVAL: The planning commission originally approved this case on August 2, 1983 . A tentative tract for condominium purposes was approved subsequently which extended the approval to November I , 1985. The current applicant, who has purchased the property from the original owner has decided not to utilize the tentative tract map. However, the November I date still prevails. Il. REQUEST: The applicant is requesting approval of a one year extension of all approvals except the tentative tract map. Although this would be the first extension, it would be a little over two years since the original approval . III. RECOMMENDATION: Staff believes this request is acceptable, and recommends approval of an extension to November 1 , 1985. IV. ATTACHMENTS: A. Letter of request. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in P.P. 09-83 is in accordance with the requirements prescribed by the Fire Marshal . " 5. '- Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. Building is required to be fully covered by an NFPA 13 monitered sprinkler system. Realtor Phyllis Jackson , as a guest , offered the opinion that the Association , in pressing a case against Ars . Isom would open itself to community criticism for pressing its uoirrht against a single home owner. After considerable discussion , the Board voted unanimously to stand by the Board ' s October 5th decision to drop the legal action against Mrs . Isom if and when she paid $100 of the some $375 expended in the Association ' s purauit of the legal action against the Isom CC&R violations . 3 . GRADIWn OP LOTS - Pitchford asked for the Board ' s stand concerning the Architectural Committee ' s position on the rrradinR of lots where new construction was pending?. It was suggested by Doug. Graham, (guest) , that the Board check on the possibility of obtaining; a bond to protect the Association against possible future le Pal action arising out of -riding requirements imposed by the Architectural Committee . Sweet requested that Krieger examine the possibility of the Association ' s acquiring a flood-protection bond , and the cost of such a bond . Page 2 Board of rector:; meeting October 19 , 1976 rl . REZOAING - It was voted unanimously to rezone Lots 3 & 4 Block T 11nit 1 , Lots 6 ,7 ,8 Block U Unit 1 and Lot 9 Block V Unit 1 from R-3 to C-1 to coincide with the City of Palm Desert zoning of C-1 for the above lots . It was required by Association By-Laws that G5% of Association property owners within 500 feet of the above lots approve of the zone change . This requirement involved a total of 83 lots within 500 feet of the: above lot:; . Or 56 replies to the Association 's request for consider- ation of the rezoning, 54 were favorable to the zone change , two were opposed. The 511 votes in favor of the zone change to C-3 represented the required 65% . Shelton moved that the Board accept the rezoning of the above listed lots , Hall seconded. 5 . BLOCK 'N - It was called to the Board 's attention that Lots 1 through 15 of Block W had not previously been included as part of the PDPOA membership. The`City of Palm Desert map indicated that Block W was out- side the PDPOA boundaries . On the other hand , two other maps at the PUMA office indicated that Blbek W was within the Association 's bound- aries . Sweet asked the office secretary to check with one of the title companies to determine' Block W ' s status . G . COMMARE PR0PERTY - Owner claims property at 73-33G Bursera is not in the boundaries of PDPOA. At the Board of -Directors meeting of September 11 , 1973 approval for assessment was passed and to commence in 1974. Hall offered to bring a title report bearing on the question to the attention of the Board. 7 . PLOOD DAMAnE - Krieger asked for clarification on the Board's position regarding retention of legal aid for the Association or any of its individual members , as far as flood damages were concerned. He questioned the Association ' s news release naming a specific attorney as having, been "retained" by the Association. After considerable discussion the Board ar•reed that it had not meant to name any one attorney as representing the Assoclation or as recommending any one attorney . Krieger presented two pieces of correspondence he had gathered regarding the flood and possible damage claims . These letters will be filed at the Association office and will be incorporated in any future flood damage news report that may be mailed to Association members . MINUTES PALM DESERT PLANNING COMMISSION AUGUST 2, 1983 an auction house or gallery in the C-1, S.P. zone at 73-1751 73-185 Highway 111. Mr. Sawa reviewed the staff report and described the gallery as having two sections - one for the reception area and the other for the auctions. He noted the restrictions on the hours to assure there would be sufficient parking spaces. Staff recommended approval based on the required findings being met. Commissioner Richards opened the public hearing and asked if the applicant wished to make a presentation. MR. ARTHUR LEVINE„ 15580 Desert View Rd., Whitewater, stated that they would never be opened later than 10:30 p.m. He had permission from the neighboring businesses to use their parking lots. He concurred with the conditions and requested approval. Commissioner Richards asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Kryder asked why the restriction -of--auctions not beginning before 8:30 p.m. was imposed. DESCRIPTION OF SITE: The 20,250 square foot site is located on the north side of Larrea Street, 300 feet west of Prickly Pear Lane and 500 feet east of San Luis Rey Avenue. The site measures 135 feet in depth and 150 feet in width. B. ADJACENT ZONING AND LAND USE: North: C-1/General Office and Retail South: R-3 20,000 (3)/Motel East: C-I/Parking Lot West: R-3 20,000 (3)/Multi-Family Residential C. GENERAL PLAN LAND USE DESIGNATION: Core Area Commercial and Related Uses. H. PROJECT DESCRIPTION: The proposed 11,880 square foot building will be located on the center of the site utilizing subterranean parking. The building meets the required five foot front setback requirement and is twenty-five feet in height within the thirty foot height limitation. The site is located within the Palm Desert Property Owners' Association jurisdiction and has received that body's preliminary approval. The building is proposed to furnish eight individual suites to be used as individual doctors' offices. When referring to medical offices this is important to consider since if it were one clinic type of situation of over 2,000 square feet, it would require a conditional use permit and additional parking. The project requires forty-one off-street parking spaces. The applicant provides forty-three spaces with some exceptions. First, a condition of the sale on this property is that this project must provide four parking spaces for the Bromley Building to the north which fronts on E1 Paseo. The parking design also includes one compact car stall which is permissible by code with the approval of the planning commission as to location at a rate not to exceed ten percent. The one compact space would comprise 2.4% of the required parking well within the 10% permitted. The project would then require a 7.3% adjustment including the compact car stall or a 9.7% adjustment not including the compact car stall. This deficiency is justified by the amount of on-street parking (five spaces) available located directly in front of an entrance to the building. A second entrance in the form of both an elevator and a stairway leads to the underground garage while a third stairway leads to the rear of the building. - 1 - CASE NOS. PP 09-83 and ADJ 04-83 AUGUST 2, 1983 III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The plan will be required to blend aesthetically with surrounding residential development and is to be reviewed by two architectural bodies (the city's architectural commission and the Palm Desert Property Owners' Association Architectural Committee). The office type use will be compatible with the existing residential more so than a retail commercial use. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The precise plan will have minor effects on adjacent properties and will have elevations that will blend with the residential developments adjacent to it. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The plan meets or exceeds all code requirements and care has been taken in its design to assure that during its operation the facility will not impact surrounding areas. B. FINDINGS NEEDED FOR APPROVAL OF THE ADJUSTMENT: 1. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. Justification: The strict application of the parking requirement would result in an undersirable traffic circulation plan. 2. There are exceptional circumstances or conditions applicable to this property not applicable to other properties in the same zone. Justification: This application must provide parking spaces for a nonconforming structure. 3. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. Justification: Other office structures were built with decreased parking requirements due to being processed by the county prior to incorporation. _ 2 - CASE NOS. The granting of an adjustment will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity.
