THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN TO ALLOW THE ADDITION
TO AN EXISTING FURNITURE STORE AT 74-104
HIGHWAY 111.
CASE NO. PP 10-83
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 2nd day of August, 1983, hold a duly noticed public hearing to consider the request of
WILL MENDELL for approval of above mentioned project..
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project is a Class 1, categorical exemption.
WHEREAS,. at said public hearing, upon hearing and considering all testimony and
arguments of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Q Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 10-83 is hereby granted for reasons subject to.
the attached conditions.

CONDITIONS OF APPROVAL
Case No. PP 10-83
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services as modified by the following j
conditions. JI
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Trash enclosures location and access to be approved by Palm Desert Disposal
Company prior to issuance of building permit.
6. Encroachment permit to be obtained for property dedicated along Alessandro
Drive.

7. A complete grading plan with specifications shall be submitted as required by
ordinance to the city engineer for checking and approval before any on-site
construction is commenced.
8. Landscaping maintenance on Alessandro shall be provided by the owners.
9. Construct PCC driveways per City of Palm Desert Standard #105 on Alessandro
Drive as needed.
10. Dedication of five foot of right-of-way on Alessandro Drive.

Mr. Sawa reviewed the staff report and described the gallery as having two
sections - one for the reception area and the other for the auctions. He noted the
restrictions on the hours to assure there would be sufficient parking spaces. Staff
recommended approval based on the required findings being met.
Commissioner Richards opened the public hearing and asked if the applicant wished
to make a presentation.
MR. ARTHUR LEVINE„ 15580 Desert View Rd., Whitewater, stated that
they would never be opened later than 10:30 p.m. He had permission from
the neighboring businesses to use their parking lots. He concurred with the
conditions and requested approval.
Commissioner Richards asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Commissioner Kryder asked why the restriction of auctions not beginning before
8:30 p.m. was imposed. Mr. Sawa replied that staff felt they should not start
auctions before other businesses close due to parking demands, and the applicant
had requested that time.
Moved by Commssioner Downs, seconded by Commissioner Crites, to approve
findings as recommended by staff; carried unanimously 4-0.
Moved by Commissioner Crites, seconded by Commissioner Kryder, to adopt
Planning Commission Resolution No. 872, approving CUP 16-83, subject to
conditions; carried unanimously 4-0.
D. CASE NOS. PP 09-83 and ADJ 04-83 - ROBERT ROTTSCHAEFER, M.D.,
AND BERNARD LEUNG & ASSOCIATES, Applicants
Request for approval of a precise plan of design to allow
construction of an 11,880 square foot office building in a
C-1 zone, located on the north side of Larrea Street, 300
feet west of Prickly Pear Lane and 500 feet east of San
Luis Rey Avenue.
Mr. Joy reviewed the staff report and explained how they would provide sufficient
parking spaces. Staff recommended approval.
Commissioner Downs asked for a clarification on the square footage of the
building. Mr. Joy replied that 20,000 square feet was the size of the site, 11,880
square feet was the size of the building.
Commissioner Richards opened the public hearing and asked if the applicant cared
to make a presentation.
BERNIE LEUNG, architect, stated that they had to meet two design criteria
- one for the Palm Desert Property Owner's Association and the other for
the City of Palm Desert. He felt both were met and requested approval.
Commissioner Richards asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Kryder, seconded by Commissioner Downs, to approve
findings as recommended by staff; carried unanimously 4-0.

AUGUST 2, 1983
Request for approval of a 1500 square foot addition to an
existing furniture store at 74-104 Highway 111.
Mr. Joy reviewed the staff report and stated that the addition would only serve as
storage space. He explained that the parking is nonconforming but the code only
required three additional parking spaces for this addition and the applicant would
provide those in the rear area which would be enclosed by a six foot block wall and
manually operated gates. Staff recommended approval.
Commissioner Richards opened the public hearing and asked for the applicant's
presentation.
MR. WILL MENDELL, Desert Island Country Club, Rancho Mirage, thanked
staff for their thorough efforts. He felt these improvements would enhance
the area.
Commissioner Crites asked the applicant if he felt the employees would utilize the
parking spaces with the manually operated gates. Mr. Mendell assured commission
he would insist on it.
Commissioner Richards asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Kryder, seconded by Commissioner Downs, to approve
findings as recommended by staff; carried unanimously 4-0.

F. CASE NO. CUP 13-83 - RICHARD AND JUNE DI NUOSCIO, Applicants
Request for approval of a conditional use permit to allow a
1317 square foot restaurant in the C-1 zone (general
commercial) located at the northwest corner of El Paseo
and Sage Lane.
Mr. Diaz reviewed the staff report and explained how parking spaces would be
provided. He noted several letters from tenants in this center were received in
favor of the restaurant. Staff recommended approval.
Commissioner Richards opened the public hearing and asked for the applicant's
presentation.
_ MRS. JUNE DI NUOSCIO, 162 Madrid Ave., stated they would have indoor
and outdoor seating. She felt the restaurant would be beneficial to the area.
The restaurant would be called "Friends".
Commissioner Richards asked if anyone present wished to speak in FAVOR or
OPPOSITION to this case. There being none, the public hearing was closed.
Moved by Commissioner Crites, seconded by Commissioner Downs, to approve
findings as recommended by staff; carried unanimously 4-0.

I. BACKGROUND:
A. DESCRIPTION OF SITE:
The addition will take place at the rear of the existing Wacky Wicker store.
Presently, the area is enclosed by a wooden fence along the rear property
line.
B. ADJACENT ZONING:
North: R-3/Offices
South: C-1/General Retail
East: C-I/Lumber Store
West: C-I/General Retail
C. GENERAL PLAN LAND USE DESIGNATION:
Core Area Commercial
II. PROJECT DESCRIPTION:
The project is a 1500 sq.ft. addition to the Wacky Wicker store. The addition will
"fill-in" a portion of the site on the east side which currently is used for outside
storage. The addition will provide addtional "inside" storage space.
The site is currently nonconforming in that it does not provide any off-street
parking. The section of the code that addresses additions to such buildings states
that parking must be provided for the expansion only. This application meets this
requirement by providing three parking spaces, based on a parking requirement of
one space for each 500 sq.ft. of floor area for a furniture store.
This rear area is proposed to be enclosed by a six foot block wall with entrance
equipped with manually operated metal gates. Staff proposes that these spaces be
identified as employee parking only due to sight obstructions created by adjacent
buildings. The rear wall is located in a five foot dedication area required by the
city engineer. This situation will be handled by a requirement for an encroachment
permit. Any possible future sidewalk appears to be a long way from reality for this
section of Alessandro due to the number of buildings built along rear property lines.
The architectural treatment of the addition will be reviewed by the architectural
commission.
III. ANALYSIS:
A. FINDINGS NEEDED FOR APPROVAL:
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.

Justification:
The design of the use is compatible with other commercial uses
existing in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
Justification:
The surrounding land in the vicinity is zoned for the same type of use
as proposed and owners would not be deprived the use of their land
due to any of the improvements.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
Justification:
The precise plan complies with all code requirements and will not be
detrimental to the public peace, health, safety or general welfare due
to the requirement of other clearances being obtained.
Staff feels the findings for approval can be justified for this precise plan.
B. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the proposed
project is a Class 1, categorical exemption for CEQA purposes.
IV. STAFF RECOMMENDATION:
Staff feels the proposed project is acceptable; therefore, it recommends:
1. Approval of findings for approval; and,
2. Approval of Planning Commission Resolution No. , approving PP
10-83, subject to the conditions attached thereto.

A precise plan of design to allow a 1,500 square foot expansion
to an existing furniture store in a C-1 zone (general commercial),
a Class 1, categorical exemption for CEQA purposes, at 74-104
Highway 111, more particularly described as:
A.P.N. 625-084-006
The attached data was prepared by the applicant and is being forwarded to you for
comments and recommended conditions of approval. The city is interested in the probable
impacts on the natural environment (e.g. water and air pollution), public resources (e.g.
demand for schools, hospitals, parks, power generation, sewage treatment, etc.) and site
and building plan acceptability.
Your comments and recommended conditions of approval must be received by this office
prior to 4:30 p.m. July 7, 1983, in order to be discussed by the land division committee at
their meeting.
The land division committee (comprised of director of environmental services, city
building official, city engineer, fire marshal and a representative of CVWD) will discuss
the comments and recommended conditions of approval and will forward them to the
planning commission through the staff report. Any information received by this office
after the receipt deadline will not be discussed by the land division committee nor will it
be forwarded to the planning commission for consideration.
