D. CASE NO. CUP 19-83 - PALM DESERT TOWN CENTER ASSOCIATES, APPLICANT Request for approval of a conditional use permit to allow the construction and operation of a car wash and gasoline station at the northwesterly portion of the Palm Desert Town Center adjacent to E1 Paseo in the the PC (3) S.P. zone (regional commercial with a scenic preservation overlay) previously assessed for CEQA purposes. Mr. Diaz reviewed the staff report and noted that three conditions should be added by the director of public works. 1. Complete grading plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction is commenced. 2. Landscaping maintenance on El Paseo shall be provided by the owners. 3. The southerly driveway shall be reduced from 40-foot width to 30- foot width to provide a separation between the two driveways to comply with city design criteria. Chairman Wood opened the public hearing and asked if the applicant cared to make a presentation. MR. JAY TARANTON, 3666 Kearny Villa Rd., San Diego, concurred with staff's recommendation and requested approval. Commissioner Richards asked Mr. Taranton if they have considered offering services to shopping customers while they do their shopping; and if so, could they provide adequate parking for those cars. Mr. Taranton replied that they are offering that service and would also be providing shuttle service to those customers. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case; there being none, the public hearing was closed. Install a water system capable of delivering 4000 GPM fire flow for a four (4) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Built-in fire protection may reduce fire flow requirements. 8. Install Riverside County super fire hydrants so that no point of any building is more than 150 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 9. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. APPLICANTS: JAMES RODGERS PATRICK SHEEHY, ARCHITECT 17802 Sky Park Circle, Ste. 104 74-215 Highway I I I Irvine, CA 92714 Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE The property is a vacant 2.5 acre site in the Palm Desert Business Center zoned service industrial. The site fronts onto Boardwalk and is surrounded by smaller (.33 acre to .45 acre) industrial parcels. The site has been graded; therefore additional grading will be nominal. B. ADJACENT ZONING AND LAND USE NORTH: S.I./Vacant SOUTH: S.I./Vacant EAST: S.I./Vacant WEST: S.I./Vacant C. GENERAL PLAN LAND USE DESIGNATION: SERVICE INDUSTRIAL ff. PROJECT DESCRIPTION: This is the first project submitted for the Palm Desert Business Center which is located at the southeast corner of Cook Street and Hovley Lane. The project involves the consolidation of two lots into one lot. As the attached site plan indicates, the two buildings are parallel to each other and to the street. The majority of the parking area will be located in front of the westernmost building separated from Boardwalk by a thirteen foot wide landscaped strip of property. There are additional parking spaces between the buildings and on the rear portion of the site. The site plan exceeds the minimum landscaping and setback requirements while meeting minimum parking requirements. The site is to be surrounded by a six foot masonry wall while the parking lot design will allow integration of a parking lot with an adjacent parcel. The proposed structures on the site will be single story and measure nineteen feet in height. The architecture of the structures is to be reviewed by the city's architectural commission along with the business center's architectural review process. The proposed landscape plan exceeds the requirement of one fifteen gallon tree for every five parking spaces. The lot consolidation fits into a parcel map waiver category due to the fact that no new lots are being created. - 1 - CASE NOS. PP 11-83 and PMW 03-83 SEPTEMBER 6, 1983 II. PROJECT DESCRIPTION (CONTINUED): During preliminary review of the project the architectural commission raised concern over the twenty-four foot width of the accessways to the rear of the structures. This width is similar to an accessway approved by the design review board for the building at the Cook Street Industrial Park which is completed and fully occupied at this time. Staff investigation did discover a truck parking along this accessway at that site. The site plan for this case; however, should not present these problems since designated parking spaces are shown to the rear of both buildings. III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF A PARCEL MAP WAIVER: 1. The planning commission shall grant a waiver, provided that it finds that the proposed consolidation and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability environmental protection and other requirements of this title. JUSTIFICATION: The consolidation into one parcel for this development will comply with all applicable requirements and will allow one integrated development. B. FINDINGS NEEDED FOR APPROVAL OF THE PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design will utilize the entire 2.5 acre site assuring a well planned totally integrated development. In the design, care has been taken to screen from view service and equipment storage areas. While the development is an industrial facility, care has been taken to assure that its planning and design are well integrated and aesthetically acceptable. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The development is located in an industrial park and the use proposed is compatible with any potential uses in the area. The design of the facility with limited access points and service areas in the center of the project, assure that adjacent property can be used for the purposes they have been zoned. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The plan meets or exceeds all code requirements and care has been taken in its design to assure that during its operation the facility will not impact surrounding areas. - 2 - CASE NOS. NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of plans to construct two 2 multitenant industrial buildings. LOCATION: East side of Boardwalk Street opposite end of St. James Place Cook Street Business Center). ZONE: S.I., S.P. Mr. Smith stated that this application was a request for preliminary approval of two multitenant industrial buildings in the Cook Street Business Center, both buildings would have the same elevations. A precise plan application will be undergoing review by the planning commission at which time the parking, circulation and other matters will be reviewed. The commissioners indicated the building was acceptable aesthetically and found no problem with the elevations but felt that the planning commission should be apprised of their concerns regarding parking and circulation for the building. They recommended that the driveway between the buildings be set back from the rear of the front building and adequate protection should be installed to protect the buildings from cars and trucks parking and backing into the spaces. Other concerns were that there was not not enough room for trucks to unload and load without creating a circulation problem and that the plans should be changed to reflect the grade change at the rear of the building. A representative of Patrick A. Sheehy Architects indicated that the parking lot layout was no different from the parking lots of other buildings on Joni Drive. Tenants requiring loading and unloading of trucks will be assigned to the units in the rear of the building where more loading space is provided. Commissioner Cook stated that the buildings on Joni Drive were in the County. He was skeptical that the uses in the front building would not require loading and unloading from the driveway. Commissioner Cook asked if a study had been made to see if the access areas could be in a central court. The representative replied that if they had a central court, they would have ingress and egress problems. On a motion by Commissioner Cook, seconded by Commissioner Martin, preliminary approval was granted subject to staff apprising the planning commission of the commission's concerns at the time of precise plan submission and the following two conditions as listed in the staff report: 1. Construction plans shall be submitted for approval to the city fire marshal prior to issuance of building permits. Install a water system capable of delivering 4000 GPM fire flow for a four (4) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Built-in fire protection may reduce fire flow requirements. 2. Install Riverside County super fire hydrants so that no point of any building is more than 150 feet from a fire hydrant measured along approved vehicular travel ways. -Zoo A. Hydrants shall not be located closer than]5�feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: " I certify that the design of the water system in Case Number PP 11-83 and PMW 03-83 is in accordance with the requirements prescribed by the Fire Marshal." 5.
