The development of the property shall conform substantially with exhibits on file 1 with the department of environmental services, unless modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of this project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. That a vehicle turnaround circle be provided at the end of the visitor/office parking lot. Department of Public Works: 6. Full half-street public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standardards for a private street. 7. Improvement plans for water and sewer systems shall be approved by the respective service districts. 8. Complete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the city. 9. A certificate of compliance shall be completed and approved prior to issuance of any building permits. 10. Landscaping maintenance on Eclectic and the private street shall be provided by the owners. 11. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to the issuance of building permits. j, 12. Prior conditions for PM 17452 to be followed per June 23, 1981. 13. Offsite improvement plans to be approved by the public works department and a surety posted to guarantee the required offsite improvements prior to building permits being issued. 15. The size, number and location of driveway approaches shall be to public works department specifications. Fire Marshal: ( 16. Paint shop must be protected by an automatic fire sprinkler system and shall meet all r provisions of the Uniform Fire Code, Article 45 - Spray Finishing. 17. Additional fire protection requirements may be necessary when specific building plans are submitted for approval. i - 4 - City of Palm Desert Staff Report TO: Planning Commission DATE: November 15, 1983 CASE NOS: PP 16-83 and PMW 06-83 REQUEST: Approval of a precise plan, parcel map waiver and Negative Declaration of Environmental Impact to allow a lot consolidation to permit construction of industrial buildings totalling 10,400 square feet with associated parking in the S.I., S.P. zone located on the west side of Eclectic Street north of 42nd Street. APPLICANTS: CABAK, RANDALL, JASPER, GRIFFITHS ASSOCIATES 1080 O'Brien Drive Menlo Park, CA 94025 L BACKGROUND: A. DESCRIPTION OF SITE: The site is a vacant 3.2 acre site zoned service industrial. The site fronts onto Eclectic Street. B. ADJACENT ZONING AND LAND USE: North: S.I./Vacant South: S.I./Industrial (Under Construction) East: S.I./Mini Storage West: S.I./Vacant C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial II. PROJECT DESCRIPTION: The property is the proposed site for the Palm Desert Disposal vehicle maintenance facility. The perimeter of the site will be enclosed by an eight foot high slumpstone fence. The major building will be located along the southern portion of the lot. This will be an office, support and storage facility. At the west end of the building, four service bays will be provided. Room has been provided for four additional service bays in the future. Along the west property line a paint shop building is located. There are two access points to the site both from Eclectic Street. The southerly access leads to 21 visitor/office parking spaces. The second access leads to the parking compound for the business. There is a separate employee parking area in the southeast corner of the yard. The parking area for the visitor lot ends with a dead-end aisle. This is not acceptable. An acceptable means of resolving this problem would be to create a turning circle at the end of the parking lot. This can be accomplished without. undue hardship. Parking provided on the site exceeds that required by the zoning ordinance. III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF A PARCEL MAP WAIVER: I. The planning commission shall grant a waiver, provided that it finds that the proposed consolidation Lrid the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability environmental protection and other requirements of this title. PP 16 83 and PMW 06-83 NOVEMBER 15, 1993 Justification: The consolidation into one parcel for this development will comply with all applicable requirements and will allow one integrated development. B. FINDINGS NEEDED FOR APPROVAL OF THE PRECISE PLAN: I. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design will utilize the entire 3.2 acre site assuring a well planned totally integrated development. In the design, care has been taken to screen from view service and equipment storage areas. While the development is an industrial facility, care has been taken to assure that its planning and design are well integrated and aesthetically acceptable. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The development is located in an industrial park and the use proposed is compatible with any potential uses in the area. The design of the facility with limited access points and service areas in the center of the project assure that adjacent property can be used for the purposes they have been zoned. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The plan meets or exceeds all code requirements and care has been taken in its design to assure that during its operation the facility will not impact surrounding areas. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have a significant adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared. IV. STAFF RECOMMENDATION: Staff recommends the following: 1. Approval of findings. 2. Approval of Planning Commission Resolution No. , approving PMW 06-83 and PP 13-83 as conditioned. PP 13-83 and TT 19575 - J & J INVESTORS, Applicants Request for approval of a precise plan of design and a single lot tentative tract map to permit a five unit residential condominium development in the R-2 zone on the east side of San Rafael, 270 feet south of Catalina. Mr. Smith reviewed the staff report and indicated that the architectural commission had already reviewed the plans and gave preliminary approval. Staff recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. BILL WARNER, 7245 Joshua Lane, Yucca Valley, concurred with staff's findings but stated that the developer requested the possibility of serving that area on septic tanks with sewer connections installed to the property line for eventual connection to sewers when available. This would modify Condition No. 29. Mr. Diaz felt that use of septic tanks should not be expanded in the area and this was not an unusual hardship on the developer. He pointed out that developers are often required to bring main sewer lines across areas to serve a given project. Further discussion continued regarding the location of the sewer system and it was concluded that the developer needed more time to discuss this problem with staff. Moved by Commissioner Crites, seconded by Commissioner Erwood, to continue this case to the meeting of December 6, 1983, for further evaluation. Carried unanimously 4-0. B. Case Nos.
