Morgan 4020 Birch St . , Ste 103 Newport Beach, Ca. 92660 A Waste Management Company PALM DESERT DISPOSAL EXPANSION 6 GROWTH HISTORY: Palm Desert Disposal began operations in the Coachella Valley during the 1950's. In 1966 Palm Desert Disposal was sold to Fred Brignardello and Gino Scopesi both of whom are still with the company. They sold the company in 1972 to S.C.A. Services, Inc. , who were acquired by the current owners, Waste Management Inc. , the nations leading solid waste hauling company, in September 1985. The mission of Waste Management Inc. , is to be the acknowledged worldwide leader providing comprehensive services of high quality utilizing state of the art systems that are responsive to our customers' needs and which preserve or enhance our environment. In fulfilling this mission, we shall provide a rewarding work environment for our employees, co-operate with all relevant agencies of government and be a responsible neighbor and coporate citizen while increasing shareholder value. Palm Desert Disposal has expanded with the community's needs throughout its history. In 1986 two major acquisitions were achieved, Bill 's Sanitation a portable toilet company now known as Port-O-Let and Coachella Valley Disposal , Inc. a rubbish hauling firm who serviced the city of Indio. In 1987 Palm Desert Disposal completed our "site services" concept with the additional business lines of office trailers, Port-O-Fence and temporary power. CURRENT ACTIVITIES: Palm Desert Disposal currently services the following: 46,011 Residential Customers 6,910 Commercial Bins 1 ,250 Construction Roll-Off Bins 568 Portable Toilet Units 25 Office Trailers Assorted Temporary Fences and Power Pole Jobs Our current .location is centrally located in the Coachella Valley and currently serves the following communities: Palm Desert, Rancho Mirage, Cathedral City, La Quinta, Indian Wells, Indio and unicorporated areas of the county around the Coachella Valley. All the above cities has been serviced from °this location since 1984. THE FUTURE: The aquisition of these subsidiaries in conjunction with the positive growth pattern of the Coachella Valley nesessitate the expansion of the current facilities to allow for an orderly and planned growth of Palm Desert Disposal as well as continuing its policy of providing efficient and competitive "site services" to the communities it serves. As additional communities grow in the valley and surrounding areas it is currently envisioned that Palm Desert Disposal would be able to service the area bordered by Sky Valley to the north, the San Jacinto Mountains to the south, the City of Coachella to the east, and Palm Springs to the west. Any service beyond that area would probably require other facilities. As stated previously Palm Desert Disposal currently services 46,000 residences and 6,900 commercial bins with its rubbish hauling operation. This service is handled by 26 refuse vehicles. We see the growth of the Valley, based on Chamber of Commerce figures and studies, as listed below. This is based on the assumption that Palm Desert Disposal will continue to service 40.5% of the population and using industry standards of one residential truck servicing 2500 residences and one commercial truck for every 700 bins. The level of construction activity in the Coachella valley is expected to increase over the next 15 years to accommadats the growth projections listed above. It is expected that there will be fluctuations in this projection. The following list shows the required inventory to meet these construction needs. It also recognizes the quality of development within the Industrial park and the expansion has been designed to compliment those surrounding facilities. Some of these plans include: 1. An 8 ' high slump stone wall with interior screen walls 2. Upgraded landscaping and concreted throughout 3. Employee parking relocated to expansion a. This is important because it allows the route truck parking to stay within the existing walls of the facility 4. Expansion area uses include: a. Construction services storage b. Enlarged washdown area. c. Sweeper cleanout d. Spare truck storage e. Employee parking area S. Office and maintenance expansion will be on existing property and will blend architectually to the existing facility, with upgraded landscaping. This expansion of the physical property is projected to contain safely and efficiently the 1S year growth pattern indicated previously. i SUMMARY: Palm Desert Disposal is looking to the future and planning to provide trash hauling and temporary construction services to Palm Desert and the surrounding valley with competitive prices and state of the art efficiency as the valley grows. . Palm Desert Disposal is a service oriented company whose growth and success must compliment the needs and requirements of a growing modern community. Palm Desert Disposal works hard to provide community support in enviromental issues and other interests of its people. The expansion of the facility is in an area specifically zoned and set aside by the City to accommadate such service industries as what Palm Desert Disposal provides for the community. Proposed screening will limit visual pollution from surrounding . properties in a positive way. Traffic will not be adversley affected. As you know we provide refuse and recycling collection services to seven cities and Riverside County from our yard at 41-575 Eclectic Street. The following is a list of the different activities we perform at the Palm Desert facility: • Administrative and operating offices • Vehicle maintenance, parking and fueling • Bin and container storage and repair • Port-O-Let storage and maintenance • Collect and transfer recycled materials • Operation of a buy-back center for recycled items • Receive and transfer green waste from local residents and gardeners • Provide a public access CNG fueling station • Provide a center for the collection of household hazardous waste We understand the above activities are permitted by existing use permits and by the service industrial zoning of the site. In view of the added services that have been developed over the last several years of operation at this site, we would appreciate a letter from you confirming that we are operating within the permitted limits at this location. Case No. P 6P 11 83 Amendment #2 - HONARD PARSELL, Applicant Request for approval of a 3.5 acre expansion to a parking and storage area and a second story addition to an existing structure (5400 sq. ft. ) located on the south side of Lennon Place between Eclectic and approximately 500 feet_ east of Corporate Way. Mr. Diaz outlined the salient points of the staff report and reviewed the concerns generated by the last application. He noted that a letter from the Riverside County Health Department had been supplied by the applicant; a letter had been received from George Berkey relaying agreement to the application per compliance with the provision of trees and landscaping; and with the mitigation measures, Mr. Diaz recommended approval . Chairman Erwood opened the public testimony and asked if the applicant wished to address the commission. i MR. GORDON PAULUS, representative, concurred with the staff report and provision of trees and landscaping per Mr. Berkey's letter. He addressed the issues of "port-a-johns" and explained how they would be cleaned before coming onto Palm Desert Disposal 's site. He also discussed the garbage trucks and the process used to clean them. Mr. Paulus read the letter from John Fanning of, the Riverside County Health Department and asked commission for any questions. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION.to the proposed. MR. ROGER LANGER, 74-489 Gary, President of Palm Desert Country Club Homeowners Association, explained that the only concerns he had were files and odor and assurance that there would be no transfer station. Chairman Erwood explained that the transfer station was not part of the application. Chairman Erwood closed the public testimony. 4 I _vr MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 17. 1987 Commissioner Richards commented on the mitigation measures and felt that the expansion was acceptable. Commissioner Ladlow asked for and received clarification from Mr. Paulus that this expansion was for 15 years. Commissioner Whitlock stated that her concerns had been addressed and was in favor of the expansion. Chairman Erwood felt that the applicant and staff had answered all the questions and concerns from prior meetings and impacts on neighbors, and indicated that the city has adequate ordinances to deal with odor and noise if a problem ever occurs. Action: Moved by Commissioner Ladlow, seconded by Commissioner Whitlock, adopting the findings as presented by staff. Carried 4-0. The project site is located on the south side of Lennon Place between Eclectic and approximately 500 feet east of Corporate Way. APPLICANT: Palm Desert Disposal Howard Parcel ] 41-575 Eclectic Street 4815 Main Street Palm Desert, CA 92260, Yorba Linda, CA 92686 I. DISCUSSION: A. HISTORY: Palm Desert Disposal located their operation and headquarters in this industrially zoned and developed area in 1983. Additional land was acquired for future expansion, a total of seven additional acres, were acquired. Earlier this year a precise plan application requesting expansion onto these seven acres was requested. The request was denied. The applicant has filed a request to expand his storage area onto about 3.6 acres. B. DESCRIPTION OF SURROUNDING AREA: The site is surrounded by service industrial zoning. North of the site, across Lennon Place, five office industrial projects have been approved. South of the site are a vacant lot, armored transport service facility, a cement truck washout area, two vacant lots and a mini-warehouse project. C. ZONING AND PROPOSED USE: The site is zoned S. I . (service industrial ) and has been so zoned since its annexation into the city. Section 25.34. 100 of the Palm Desert Municipal Code sets forth the purpose of the S. I , zone. it states in part: "The intent and purpose of the service industrial district is to allow for the manufacture, PLANNING COMMISSION STAFF REPORT PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 distribution, and service thereof of products intended for local usage within Palm Desert, its sphere of influence and surrounding cove communities." The service area of Palm Desert Disposal is principally the communities of Palm Desert, Rancho Mirage, Cathedral City, La Quinta, Indian Wells, Indio and unincorporated areas in the Coachella Valley. It may be argued that the service area is no larger and in many instances smaller then that of other firms located in the S. I . zone. Section 25.34.020 Permitted Uses for the service industrial zone lists the following: 1 . Equipment maintenance and storage facilities. 2. Maintenance facilities (bulk laundering, janitorial , etc. ) 3. Mortuaries. 4. Pest control facilities. 5. Preparation of foodstuffs (no processing) e.g. baking, bottling, etc. 6. Production of home and office decor accessories. 7. Public utility and public service facilities. 8. Support facilities for local construction, renovation and installation of related equipment. 9. Uses customarily related to any of the uses listed in this section. 10. Completely screened vehicle service and storage facilities. 11 . Warehouse or storage facilities. The proposed use could fall under any one of six uses listed as permitted in the zone. I . Equipment maintenance and storage facilities. 2. Maintenance facilities (bulk laundering, janitorial , etc. ) 7. Public utility and public service facilities. 8. Support facilities for local construction, renovation and installation of related equipment. 9. Uses customarily related to any of the uses listed in this section. 10. Completely screened vehicle service and storage facilities. The applicant proposes to expand his existing maintenance and storage facilities which were previously approved by the city. The use can be categorized as a public utility in that it is franchised and regulated by the city. 2 PLANNING COMMISSION STAFF REPORT PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 Items to be stored on the site include portable toilets, construction trash bins, fencing, barricades and other things used by the construction industry. Finally, trash and refuse collection is a use that is customarily related to any of the other uses identified as permitted. The question, therefore, is not whether the requested expansion is a permitted use--for clearly it is, as setforth in the code adopted in 1975 and reaffirmed when the applicant's present operations were approved in 1983. The issue is one of how the proposed facility is designed and does that design meet the required findings setforth in chapter 25.73 Precise Plan of the Palm Desert Municipal Code. Those findings are setforth in section 25. 73 . 013 approval or rejection considerations: "A . . . . consideration shall be given and restrictions shall be imposed to the extent necessary, in view of the size and shape of the parcel and the present and proposed zoning and use of the subject property and the surrounding property, to permit the same degree of enjoyment of the subject property, but subject the same degree of protection of adjoining properties, as would be accorded in normal circumstances by the standard restrictions imposed by this chapter. The standard restrictions imposed in the various zones by this chapter. . .are intended as minimum restrictions necessary in normal circumstances to prevent substantial depreciation of property values in the vicinity, unreasonable interference with the use and enjoyment of property in the vicinity by the occupants thereof for lawful purposes and the protection of the public peace, health, safety and - general welfare. "Normal circumstances" are extended to refer the case of a permitted case upon a lot of a normal size and shape surrounded by property in the same zone as the lot in question." The proposed use is a permitted use as has been stated earlier. The site is question exceeds the lot specifications in the S. I . zone, which requires a minimum lot area of 20,000 square feet with minimum depth and width of 100 feet; the parcels in question are 165.29 and 3 PLANNING COMMISSION STAFF REPORT PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 170.81 feet wide respectively, thus have a combined width of 336 feet and their depth is 463.90. The proposed perimeter screening exceeds the requirements of the S. I . zone setforth in section 25.34. 170 which requires a minimum wall height between five and seven feet, the proposed slumpstone exterior wall will be eight feet in height. In addition, views into the yard at the entry shall be screened by a planter and eight foot wall located in the yard approximately twenty feet from the driveway. The plan also creates 93 employee parking stalls in the expansion area and places the trash truck parking in their existing area, thus reducing traffic on Lennon Place. D. PREVIOUS APPLICATIONS: PP 16-83 amendment #1 which was denied included a parcel which was located in the Corporate Way Property Owners Association area. This application restricts the project to the two parcels immediately adjacent to the existing Palm Desert Disposal Operation and were taken out of the property owner's CC&R's by the group which developed the Corporate Center. There was at that time discussion between the applicant and the property owner' s association relating to the question of permissibility of the proposed use, and this is a question which these two groups must resolve. The new application reduces the area of the proposed expansion by 1 . 16 acres and eliminates the question of permissibility and CC&R regulations. During the first hearings questions were raised relating to odors and health impacts. The present operations have received total clearance from the Riverside County Health Department. The question of traffic generation was also raised during the first application. As stated previously, the streets can accommodate the traffic generated by this industrial use. In addition, the dividing of the areas and entrances between employee vehicles, truck parking and storage assures that there will not be an undue concentration at any given point in time of traffic generated by this use either in its present or expanded condition. The issue of aesthetics were also discussed previously. The applicant has been required to increase his landscaping throughout the site and completely screen the storage area from street visibility. 4 PLANNING COMMISSION STAFF REPORT PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 E. ENVIRONMENTAL REVIEW: During the previous application requests for a complete environmental impact report were made. It was staff's recommendation that a negative declaration of environmental impact met the legal and intended requirements of the California Environmental Quality Act. Staff recommends that a negative declaration of environmental impact be certified on this application. The basis of this recommendation is the initial study hereto attached and the fact that there is no evidence that the project could have a significant adverse impact on the environment that has not been mitigated by the conditions of approval identified in the initial study. 11. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 3. PP 16-83 AMENDMENT #2 1 . EARTH a. The project will not result in any major excavation or grading activity that will reach the geologic substructure of the site. b. There will be compaction of soils, which are required as part of the city's construction ordinance relating to paved areas for parking and storage. Compaction is a normal part of any construction activity and does not result in any adverse impact to the environment. (Department of Public Works conditions 1 , 4) C. The topography of the site is relatively flat, there maybe minor changes •on the site to meet city drainage requirement. This will be further discussed under item 3. (Department of Public Works conditions 1 , 2 and 4) d. As stated previously, the site is flat and, therefore, does not contain any unique or physical features. e. If anything, the construction of the wall and paving will reduce wind and water erosion. However, it should be noted that this has not been a problem in the area. 2. AIR a. This is a service industry which responds to demands for an increase in service, which is generated by growth occurring outside of its control . Any significant reduction in air quality is thus generated by the developments that cause the need for trash disposal and other such services rather than the services themselves. In. The activity proposed will not create objectionable odors. If there are odor problems, they are referred to the appropriate agencies for resolution. C. The project is located in an already developed area and encompasses in total only approximately seven acres and, therefore, could not impact air movements or any other climatic conditions. 3. WATER a. If necessary to meet city drainage requirements to protect adjacent properties, the course of water failing on the sight may be altered. This would result in a positive rather than adverse impact on the environment. (Department of Public Works conditions I , 2, and 4) b. The rate of ground absorption will be reduced as the amount of area paved increases and the natural area decreases. This will not result in a significant adverse impact on the environment that cannot INITIAL STUDY PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 be mitigated because the city's drainage requirements, fees and drainage projects financed by those fees are intended to handle the increased runoff created by this or any development. There is a specific department of community development condition requiring the payment of drainage fees and approval of grading plans. (Department of Community Development condition 10) C. The project site is not subject to flooding. d. The site does not contain any ground water. e. The project will not add to or withdraw from any ground water. As stated previously, none of the activity either during construction or operation will impact or touch the geologic substructure. f. Public water supplies are not impacted by this development. 4. PLANT LIFE a. In order to complete the landscaping needed to meet city requirements, new plants will be introduced on site. However, these plants and shrubs have been introduced into the area previously. b. The site does not contain any rare or endangered species of flora. C. See item 4a. 5. ANIMAL LIFE a-d The site does not serve as habitat for any known animals. Development in the area has already eliminated its usefulness as a wildlife habitat. The applicant is required to pay nearly $1800 as required by the fringe-toed lizard mitigation plan. Though no fringe-toed lizards have been identified on the site, the area is covered by the plan and the applicant will pay the required fee as conditioned in the resolution. (Department of Community Development condition 10) . 6. NATURAL RESOURCES a-d The use of natural resources will be minimal and limited to the ingredients normally found in paving material . 2 INITIAL STUDY PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 7. ENERGY a-b The project is to develop a storage area, and as such will use minimal amounts of energy after its completion. 8. RISK OF UPSET No chemicals or explosives will be stored on the site. 9. ECONOMIC LOSS a-b The project site is not in an area endangered by flooding. Development of the property will increase its value above that of vacant land. However, the project is not subject to geologic risks beyond accepted community standards, and outside of the wall and second story stucco structure, there are no improvements seriously exposed to geologic hazards. 10. NOISE The project will not increase ambient noise levels beyond the acceptable CNEL. In addition, the dispersal of vehicles will result in a lessening of any noise increase at a given area. The activity is also completely screened by an eight foot masonry wall , which will keep noises from going outside of the project area boundaries. Noise generated by large trucks are to be expected in the industrial area, and their concentration in that area is expected and these areas are established to concentrate industrial development and keep such noises outside of residential and commercial areas. In any event, the noise level of the activity proposed meets the requirements of section 25.34. 130 of the city zoning ordinance. If anytime the noise standards setforth on section 25.34. 180 are exceeded, appropriate legal action can be taken to curtail the activity. (Department of Community Development condition 3) 1l . LAND USE The area is zoned and has been planned for industrial uses. 12. OPEN SPACE The site is not designated for open space use. 3 INITIAL STUDY PP 16-83 AMENDMENT #2 NOVEMBER 17, 1987 13. POPULATION a-b The project is the result of an increase in population that has and will continue to occur. The project does not impact the area's population in terms of its distribution of socio-economic makeup. 14. EMPLOYMENT The proposal will not result in new jobs. However, the expanded growth which has generated the expansion of this service industry may result in new jobs created in this industry. 15. HOUSING The project is a small expansion totaling three acres; thus it will not have significant impact on population, employment or housing. In addition, the city's housing element of the general plan addresses the future housing needs of the city and programs and projects to meet those needs have been established. 16. TRANSPORTATION/CIRCULATION a. Additional vehicular movements will be generated but these are movements that have been contemplated by the planned circulation system in the area. In addition, as stated previously the division of the different types of vehicular movements assures that they will be dispersed, thus making the impact on any area minimal . Furthermore, the applicant will be required to pay appropriate signalization fees to offset the impact of their proposal on the city's circulation system. Therefore, no unmitigated significant adverse traffic impacts are caused by the project. In addition, to join a Cook Street assessment district is required. (Department of Community Development conditions 5 and 11 ) . b. New parking is being created and access facilitated the planned project. c, d, and e The streets are designed to accommodate projected traffic, sidewalks are present where required and bicyclists are discouraged from riding through industrial areas. 17. PUBLIC FISCAL BALANCE On a one-on-one basis industrial developments have traditionally generated greater revenues than expenditures for government. The applicant is under a franchise agreement with the city which will assure that a positive rather than negative fiscal balance is maintained. 19. UTILITIES All utility purveyors are aware of the project and all have indicated an ability to serve the project. 20. HUMAN HEALTH a-b The entire operation is monitored by the Riverside County Health Department. This project expanding office and storage area will not impact human health. (Department of Community Development condition 4) 21 . SOCIAL SERVICES No state or local social service agency will be required to render services as the result of this project. 22. AESTHETICS a-c The project will be completely screened, meet or exceed all zoning requirements and the requirements of the Palm Desert Architectural Commission; as such it will not result in any significant adverse aesthetic impacts on the environment.
