CHARLES PLACE, 220 FEET EAST OF BROADWAY. CASE NO. PP 17-83 and PMW 05-83 I WHEREAS, the Planning Commission of the City of Palm Desert, California, did on ` the 6th day of December, 1983, hold a duly noticed public hearing to consider the request of E.M. BEROL for approval of a precise plan of design, parcel map waiver and Negative Declaration of Environmental Impact to allow a consolidation of two lots, and construction of an industrial building on 1.1 acres in the S.I. (Service Industrial) zone on the south side of St. Charles Place, 220 feet east of Boardwalk. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant adverse environmental impact and a Negative Declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or s general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Provide 3.5 foot high decorative masonry wall in front of parking lot areas exposed to streets (except driveways). 7. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. Department of Public Works: 8. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for review and approval before issuance of building permits. 9. Landscaping maintenance on St. Charles Place shall be provided by the owner or a property owners association. 10. Size and location of driveway approaches shall be to public works department specifications. 11. All required permits from the public works department shall be obtained prior to any work on and off site. a: City Marshal: 12. Install a water system capable of delivering 2000-4000 GPM fire flow for a two (2) - four (4) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 13. Install Riverside County super fire hydrants so that no point of any building is more -2- PLANNING COMMISSION RESOLUTION NO. 909 . than 15-250 feet from a fire hydrant measured along approved vehicular travel ways. a. Hydrants shall not be located closer than 25 feet to any building. b. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 14. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 15. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case No. PP 17-83 and PMW 05-83 is in accordance with the requirements prescribed by the fire marshal." 16. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 17. DESCRIPTION OF SITE: The site is a flat vacant 45,180 sq.ft. site which is made up of two lots. The site is in the new Palm Desert Business Center and void of any vegetation. B. ADJACENT ZONING AND LAND USE: North: S.I., S.P/vacant South: S.I., S.P/vacant East: S.I., S.P/vacant West: S.I., S.P/vacant C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial 11. PROJECT DESCRIPTION: A. GENERAL: The proposed project consists of a 16,345 sq.ft. industrial building, tentatively divided into seven rental suites. B. DESIGN: The irregularly shaped building is located in the middle of the lot with full circulation around the building. The parking which complies with requirements is primarily located in the front of the building. The parking and circulation are acceptable as designed. The architecture of the building is conventional with walls consisting of "waffle Crete" panels with a contrasting painted stripe. Each suite entry is architecturally treated with textured panels and slump block veneer. C. PARCEL MAP WAIVER: Because the site is made up of two parcels, the applicant has filed a request -1- Staff Report PP 17-83 and PMW 05-83 December 6, 1983 to consolidate the parcels into one lot. D. ARCHITECTURAL COMMISSION ACTION: The architectural review commission reviewed preliminary plans at their meeting of October 25, 1983, and approved the plans as submitted. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and has received preliminary design review board approval and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. FINDINGS FOR APPROVAL OF PARCEL MAP WAIVER: The required findings for approval are that the proposed adjustment and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection, and other requirements of the municipal code. These findings can be justified since the project complies with applicable city ordinances and can be serviced adequately by the utilities. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse environmental impact on the environment and a Negative Declaration of Environmental Impact has been prepared. IV. STAFF RECOMMENDATION: Staff feels the proposed project is acceptable. Therefore, we recommend: 1. Approval of findings; 2. Approval of Planning Commission Resolution No. , approving PP 17-83 and PMW 05-83.
