BACKGROUND: As a condition of approval of C.U.P. 20-83,Amendment No. 3, a total of 77 parking spaces are required for a restaurant at 72-185 Painters Path of which 42 are to be located off-site pursuant to an agreement with an adjacent property owner. II. PURPOSE: The purpose of this agreement is to determine the obligation of the property owner and restaurant tenant concerning compliance with the parking requirements of the conditional use permit. Terms of this agreement shall be enforceable by the City upon the tenant/property owner and their successors as conditions of C.U.P. 20-83. III. AGREEMENT: Due to the existence of over 50 on-street parking spaces within 300 feet of the restaurant, the City shall defer the off-street parking requirements provided the Property Owner and Restaurant Tenant agrees to the following: MEMORANIUM OF UNDERSTANDING C.U.P. 20-83 1 SEPTEMBER9, 1997 I. i If in the future the Community Development Director determines in his/her sole and reasonable discretion that the parking demands I enerated by the restaurant exceeds the available supply to the detriment of businesses in the vicinity, then the Property Owner/Restaurant Tenant shall agree to secure up to 42 additional off-site spaces to be used for employee and valet parking as approved by the Director. A failure to secure required parking will result in initiation of proceedings to revoke the conditional use permit per Section 25.72.130 of the Zoning Ordinance. Onsite parking at Women's Health - 11 spaces day use only. I 2. Onsite parking at BB's - 24 spaces including 2 handicapped. 3. Onsite parkin'lg at Hot Pockets - 14 including 1 handicapped. All of the above properties are owned by Poul Moller. On street parking on BB's side: Slightly more than 1,000' less 6 driveways of 20' each leaves approximately 880'. Figuring 22 ' per car yields approximately 40 spaces. On street parking across from BB's: Slightly less than 1,000' less 2 driveways of 30' leaves approximately 900' or parking for 40+ cars at 22' per vehicle. The I,essees, Ken Moon and Karl Nielson, are in agreement that if parking overwhelms the above referenced parking tliey will acquire the necessary additional parking from Mr. Rifenbark at 72-171 Hwy 111 (there is an agreement to use Mr. Rifenbark's parking spaces which permitted BB O'Brien's to operate) or from the owners of the Las Sombras Center or even at Desert Crossings. Chairman Crites also noted that the existing house has a three to four foot block wall and oleander hedge on the outside of this property and indicated that commission does not usually require someone to build another wall and hedge adjacent to an existing one. (s) of the Palm Desert Municipal Code is requested to permit: Four units built in 1985 containing approximately 300 sf , rather than the 450 sf required by the Code. 2. What practical difficulties or unnecessary physical hardships inconsistent with the objectives of the Zoning Ordinance would result if the variance is not granted? It is impossible to expand the present units to a larger size without considerable economic hardship above and beyond the owner ' s ability to pay. Also the present tenants would have to be evicted if the units had to be vacated . 3. What exceptional or extraordinary circumstances or conditions apply to your property that do not apply generally to other properties in the same zone? The units are already built and the only way to make them conform to the required size is economically unfeasible. The units are surrounded by R-3 lots . The units are well-designed to house a single person comfortably. The units are presently rented . 4. To what extend would the strict or literal interpretation and enforcement of the specified regulation deprive you of priveleges enjoyed by the owners of other properties in the same vicinity and zone? I don ' t believe there are comparable properties in the vicinity at present. These units will e tor senior citizens and to tear them down or to convert them to a single thrre-bedroom unit would not meet the needs ot the senior citizen who really wants a small , inexpensive apartment. The units rent for $350 per month with and are tovety , new untcs across from ZrIe senior citizens center . These are very affordable for one senior person. 5. To what extend would the granting of this adjustment be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity? None whatsoever . J CITY OF PALM DESERT DEPARTMENT OF COMMUNITY DEVELOPMENT STAFF REPORT TO: Planning Commission DATE: August 5, 1986 CASE NO: CUP 86-5 & VAR 86-4 REQUEST: Conditional use permit and variance to allow the conversion of four existing standard rental units to eight senior citizen rental units under provisions of the Senior Housing Overlay Ordinance. APPLICANT: RICHARD L. AND MAY LEE 1085 Ravoli Drive Pacific Palisades, CA 90372 1. BACKGROUND: A. ADJACENT ZONING/LAND USE: North: R-3 S.O./vacant South: R-2 S.O./single family East: R-2 S.O./duplex West: R-3 S.O./multi family B. PROJECT DESCRIPTION: The subject property is zoned R-2 Senior Overlay. In December of 1983 four three bedroom units were approved on the property and subsequently constructed. Some time after the city's final inspection, one of the bedrooms in each unit was converted to a 300 square foot studio apartment without city approval . The violation was brought to the attention of the city and enforcement proceedings were initiated by the city attorney. Those proceedings have been temporarily suspended pending a decision on the conditional use permit and variance applications. The applicant does not propose any additional improvements. PROJECT DATA: Pro.iect Senior Ordinance Site Area 17,503 sq. ft. Units 8 7 maximum Unit Size 4 - 2 bdrm. 800 sq. ft. 800' minimum 4 - studio 300 sq. ft. 450' minimum Parking 8 covered spaces 8 spaces CUP 86-5 S VAR 86-4 Based on the 17,503 lot area, the R-2 zone allows four units. The senior overlay population intensity calculation yield 12 occupants which translates to four two bedroom units and three studios for a total of seven units. 11. ANALYSIS: Although senior housing is an appropriate use of the site, the existing units .do not comply with the senior overlay intensity or minimum unit size standards. The applicant asserts that the 300 square foot units provide acceptable living accommodations and that the building modifications required to comply with the code create an economic hardship. If a hardship exists, it was created by the applicant's own actions when the units were converted without approvals. The applicant should have been aware that only four units were approved when she purchased the project and that 300 square foot units were not permitted under any zone in the city. If the applicant does not have the financial ability to legally comply with the senior overlay standards then the only alternative is to restore them as bedrooms. One's personal financial situation is not considered to be relevant to the definition of extraordinary circumstances of hardship. 111 . CONCLUSION: The required positive findings cannot be made for the variance and without the variance, positive findings cannot be made for the conditional use permit. 1 . There are no practical difficulties or unnecessary physical hardship associated with compliance other than those normally associated with remodeling. To state that the required work is expensive is not sufficient. 2. There are not exceptional circumstances which apply to the property which do not apply to other senior overlay or R-2 zoned properties in the vicinity. The proposed property does not contain any unusual feature to differentiate it from surrounding properties. 3. Enforcement of the senior overlay standards will not be depriving the applicant of privileges enjoyed by other owners of senior overlay property in the vicinity. Three senior projects recently approved in the area have been required to comply with the intensity and unit size requirements from which a variance is being requested. 2 CUP 86-5 8 VAR 86-4 4. Without approval of a variance the application will not be consistent with the senior overlay standards. IV. ADJACENT ZONING AND LAND USE: North: R-1 Single Family Dwelling and Vacant South: R-2 Multifamily Dwellings East: R-2 Multifamily Dwellings West: R-2 Multifamily Dwellings C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential, 5-7 d.u./acre H. DISCUSSION: The proposed four units (two duplexes) comply with all ordinance requirements. This hearing is to review only the site plan as submitted. The property is a corner lot with a width on San Rafael of 115 feet by a depth of 152 feet on Catalina. The units are all oriented toward the Catalina frontage (i.e. garage and driveways enter from Catalina). As noted previously, as submitted all code provisions have been met; however, due to the required street dedication on San Rafael, this side yard would become less than the prescribed ten foot minimum. There is room to shift the westerly units three feet to the east and thereby assure the ten foot standard. This would help facilitate a lot split should the applicant choose to do so at some future time. The zoning allows one dwelling unit for every four thousand square feet of land area; therefore, on this 17503 square foot lot up to four units are permitted. All units will have two bedrooms with two baths and will be approximately 1108 square feet. III. ANALYSIS: A. REQUIRED FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. APPLICANT: MICHAEL N. SCURO 81-211 Helen Avenue Indio, CA 1. BACKGROUND: A. DESCRIPTION OF SITE: The site is vacant, relatively flat and is 17503 square feet in area. B. ADJACENT ZONING AND LAND USE: North: R-1 Single Family Dwelling and Vacant South: R-2 Multifamily Dwellings East: R-2 Multifamily Dwellings West: R-2 Multifamily Dwellings C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential, 5-7 d.u./acre II. DISCUSSION: The proposed four units (two duplexes) comply with all ordinance requirements. This hearing is to review only the site plan as submitted. The property is a corner lot with a width on San Rafael of 115 feet by a depth of 152 feet on Catalina. The units are all oriented toward the Catalina frontage (i.e. garage and driveways enter from Catalina). As noted previously, as submitted all code provisions have been met; however, due to the required street dedication on San Rafael, this side yard would become less than the prescribed ten foot minimum. There is room to shift the westerly units three feet to the east and thereby assure the ten foot standard. This would help facilitate a lot split should the applicant choose to do so at some future time. The zoning allows one dwelling unit for every four thousand square feet of land area; therefore, on this 17503 square foot lot up to four units are permitted. All units will have two bedrooms with two baths and will be approximately 1108 square feet. III. ANALYSIS: A. REQUIRED FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. _ 1 _ CASE NO. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for similar types of uses as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will be required to receive architectural commission approval and will not be detrimental to the public peace, health, safety or general welfare. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for the purposes of CEQA and no further documentation is necessary. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect whatsoever. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Community Services District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. That the westerly building be shifted three (3) feet to the east to provide for a minimum ten (10) foot setback after the required street widening dedication. Department of Public Works: 6. Drainage facilities shall be provided per Ordinance No. 218 and the master drainage plan to the specifications of the director of public works. 7. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 8. Improvement plans for water and sewer systems shall be approved to the respective service districts. 9. Complete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the city. 10. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 11. Landscaping maintenance on Catalina Way and San Rafael Avenue shall be provided by the homeowners association. 12. This property is in the AO Depth V zone as shown on the flood insurance rate map. A flood hazard report, as required by Ordinance No. 221 (Flood Damage Prevention Ordinance) shall be submitted to the the public works department. The report must be approved by the flood review committee prior to recordation of the final map. 13. Complete grading plans and specifications to be submitted to the city engineer for review and approval prior to issuance.of any permits. _ 2 _ PLANNING COMMISSION RESOLUTION NO. 14.
