Commissioner Erwood felt other justifications were needed to accept this proposal. Commissioner Downs wanted to see the letters from Monterey and Chapparal given to Mr. Anderson expressing acceptability to this project. He further felt that this matter should be continued to see if the applicant can come up with something different. Chairman Wood felt that this would be the only opportunity to develop that site into affordable project. He also felt that the proposed density from PR-5 to PR-7 was a minor adjustment. He was in favor of the project. Commissioners Crites and Richards both felt that the project should be redesigned to address the needs for people with families rather than possible weekenders. It was also noted that the applicant should attempt to notify all the residents in the area. Commission concluded their discussion with the general feeling being that they would be more inclined to continue this matter to let the developer restudy and make necessary changes to the plan. Mr. Diaz explained that if the density averaging is not acceptable a general plan amendment would be recommended. He advised commission that a density of 6.25 d.u./acre can be acquired without the change of zone application. He recommended that staff and developer get together and work out a plan with the 6.25 density. Moved by Commissioner Downs, seconded by Commissioner Commissioner Richards, to continue this matter to February 7, 1984, for further study. Carried unanimously .5-0. B. Case Nos. RUSSELL;Applicant Request for approval of a precise plan of design, parcel map waiver to consolidate two lots into one lot and Negative Declaration of Environmental Impact to allow construction of a 7,830 sq.ft. building in a service industrial zone on the east side of Beacon Hill, 200 feet north of Sego Lane. Mr. Sawa reviewed the staff report and recommended approval. Chairman Wood 22ened the public hearing and asked if the applicant wished to make a presentation. The applicant was not present. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. MR. BOB RITCHEY, architect, 42-600 Bob Hope Drive, requested approval and was present to answer any questions the commission might. have. Chairman Wood closed the public hearing and asked for the pleasure of the commission. Moved by Commissioner Crites, seconded by Commissioner Richards, to approve the findings as recommended by staff. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse environmental impact on the environment and a Negative Declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Provide 3 foot high decorative masonry wall or heavy landscape hedge in front of handicap parking space areas exposed to streets. 7. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 8. Fence area directly visible from street at end of driveway shall be provided with aluminum slats or other acceptable means to satisfaction of city. Department of Public Works: 9. Complete grading plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced and the issuance of any permits. 10. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 11. Landscaping maintenance on Beacon Hill shall be provided by the owners. 12. Approval of PMW by the planning commission prior to issuance of any permits. 13. Location and sizes of all driveways shall be reviewed and approved on the grading plan. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. Install Riverside County super fire hydrants located at each intersection:. a. but not greater than 400 feet apart in any direction. b. so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. _. C. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. d. curbs shall be painted red 15 feet in either direction from each hydrant. e. hydrants shall not be located closer than 25 feet to any building. 16. Prior to recordation of the final map, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. 17. APPLICANT: SAMUEL I. RUSSELL 74-215 Highway Ill Palm Desert, CA 92260 ARCHITECT: ROBERT RITCHEY 42-600 Bob Hope Drive Rancho Mirage, CA 92270 I. BACKGROUND• A. DESCRIPTION OF SITE: The site is a flat, vacant 29,000 square foot property which consists of two lots. At the rear of the lot is a 6-8 foot high wall which retains the rear 10 feet of the site. B. ADJACENT ZONING/LAND USE: North: S.I./vacant South: S.I./vacant East: W-2 (Riverside County)/vacant West: S.I./vacant C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial II. PROJECT DESCRIPTION: A. GENERAL: The project consists of a 7830 square foot industrial building with three proposed suites. The building is proposed in the middle of the site with circulation around the sides and back of the structure. Screened outside storage is proposed at the rear of the site. B. CIRCULATION/PARKING: Two driveways would serve the site near the north and south property lines. Sixteen parking spaces are required and provided for the building. The spaces in the location of the two handicap stalls will have to be screened as required by code. The applicant should also check state codes to insure that the handicap stalls comply with size and access requirements. C. ARCHITECTURE: The architectural is conventional with masonry or concrete flat roofed walls -1- Staff Report PP 22-83 and.PMW 08-83 and a blue tile mansard roof extending across the front. There will also be some masonry veneer and a wood glu-lam fascia. D. PARCEL MAP WAIVER: The property is made up of two lots which the applicant has requested approval to consolidate into one through the parcel map waiver procedure. E. ARCHITECTURAL COMMISSION ACTION: The architectural review commission reviewed preliminary plans at their meeting of November 22, 1983, and approved the plans as submitted. III. ANALYSIS• A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and has received preliminary architectural commission approval and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. FINDINGS FOR APPROVAL OF PARCEL MAP WAIVER: The required findings for approval are that the proposed waiver and the resulting parcels comply with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availabiity, environmental protection, and other requirements of the municipal code. These findings can be justified since the project complies with applicable city ordinances and can be serviced adequately by the utilities. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse environmental impact on the environment and a Negative Declaration of Environmental Impact has been prepared. As a condominium owner at The Lakes , I have invested con- siderable money to live in a low-density, completely low- profile area which provides quiet, serenity and unobstructed view of mountain and sky. I feel that many other people have come here in the twilight of their years for the very same reasons as I have. It does not seem appropriate to me that you would even consider allowing multi-story dwellings in this area. There are already too many towns and cities in California where lack of sound planning has resulted in a devastating mumbo-jumbo of ill-suited architectural styles juxtapositioning and little or no allow- ance for green belts and recreational areas . Let this not happen in this marvelous desert spot! Surely there are other areas that the Tavaglione Construction Company people might do well to consider for their development, for which, I am sure , there is a need. I was appalled that there could besuch utter disregard of the plans as presented to potential buyers of this property when we purchased our homes, might even be considered. I have a home at 75-265 Vista Huerto and have spent considerable money on upgrading the home with the thought that I will occupy it even more as I have retired this year and I am a widow. With the plot plan in Your office and at the sales office of Vista Del Montanas, we were assured that these would all be free standing, single family, one story homes. What has happened to the intregity of a city that would allow two story, density housing, low cost condos in the remainder of this property. We understood from Covington and Kavanaugh that the property in question would be like the present housing, and now it seems the proposal is totally different than that. I feel that all of us who have homes here have been totally mislead and would create a real hardship on many of us who have spent money on our homes, if this were considered.
