A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA,
APPROVING A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF FIVE RESIDENTIAL UNITS ON THE
EAST SIDE OF OCOTILLO, ONE LOT NORTH OF VERBA
SANTA.
CASE NO, PP 24-83
WHEREAS, the planning commission of the City of Palm Desert, California,
did on the 17th day of January, 1984, hold a duly noticed public hearing to consider the
request of MIKE SUKO for approval of a precise plan of design to allow the development
of five residential units in the R-3, 20,000 (3) zone on the east side of Ocotillo Drive, one
lot north of Verba Santa.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-8911, in that the director of environmental services has determined that
the project is a Class 3 categorical exemption for purposes of CEQA and no further
documentation is necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design
and parcel map waiver.
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
3. The precise plan will not endanger the public peace, health,
safety or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That approval of Precise Plan 24-83 is hereby granted for reasons subject
to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this. l7th day of January, 1984, by the following vote, to
wit:

Conditions of Approval
Case Nos. PP 24-93
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following J
conditions.
2. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein in addition to all municipal ordinances and state and
federal statutes now in force or which hereafter may be in force.
3. Construction of this project shall commence within one year from the date of
approval unless an extension of time is granted; otherwise said approval shall become
null and void and of no effect whatsoever.
4. Prior to the issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permits or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit for
the use contemplated herewith.
5. A 6 foot high block wall on the east and north side of the property shall be installed.

6. Complete grading plans and specifications shall be submitted as required by ordinance
to the city engineer for checking and approval before construction of any
improvements is commenced and issuance of any permits.
7. Landscaping maintenance on Ocotillo Drive shall be provided by the homeowners
association.
Coachella Valley Water District:
8. That this property be annexed to Improvement District Nos. 54 and 80 of Coachella
Valley Water District for sanitation service.

Request for-approval:of a precise plan of design to allow
construction of a five unit apartment complex on the east
side of Ocotillo Drive, south of Verba Santa, in the R-3,
20,000 (3) zone.
Mr. Smith reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation. The applicant was not present.
Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION
to this case.
MS. ELEANOR CRESWELL, 46-139 Verba Santa, asked if there would be air
condition units on top of the roofs.
Mr. Smith replied they would not.
MS. MARILYN BIBBY, 46-100 Verba Santa, asked how high the fence would.
be between this project and her property.
Mr.-Smith replied 6 feet.
MR. THOMAS CRESWELL, 46-139 Verba Santa, stated that Mr. Suko had
erected a 6 foot cedar fence in the rear of his property and he did not feel it
was structurally stable.
Mr. Smith replied that he was aware of the fence and assured Mr. Creswell the
matter would be looked at and taken care of.
Because there was concern expressed a condition of approval was added to read:
"A 6 foot block wall on the east and north side of the property shall be installed."
Commissioner Erwood felt the applicant should have the opportunity to respond to
this condition.
Mr. Smith assured the commission the applicant was already aware of the fence
problem.
Chairman Wood closed the public hearing.
Moved by Commissioner Richards, seconded by Commissioner Crites, to approve
the findings as recommended by staff. Carried unanimously 5-0.
Moved by Commissioner Richards, seconded by Commissioner Crites, to adopt
Planning Commission Resolution No. 9222 approving Case No. PP 24-83, subject to
conditions,as amended. Carried unanimously 5-0.
D. Case Nos. PP 26-83 and ADJ 05-83 - CHARLES GARLAND, Applicant
A request for approval of a precise plan of design to allow
construction of a two unit residential structure and an
adjustment to allow encroachment into a rear and front
setback in an R-2 zone located on the west side of Portola
Avenue, 120 feet south of Shadow Mountain Drive.
Mr. Joy reviewed the staff report and recommended approval.
Chairman Wood opened the public hearing and asked if the applicant wished to
make a presentation.

I. BACKGROUND:
A. DESCRIPTION OF SITE:
The site is vacant, slopes from south to north and has an area of 15,500 square
feet.
B. ADJACENT ZONING AND LAND USE:
North: R-3/Multi Family
South: R-I/Single Family
East: R-1/Single Family
West: R-3/Vacant
C. GENERAL PLAN LAND USE DESIGNATION:
Low Density Residential, 3-5 d.u./acre.
H. DISCUSSION:
The proposed five (5) units comply with all ordinance requirements. This hearing is to
review the site plan as submitted. The property is located on the east side of
Ocotillo, one lot north of Verba Santa. This is the first multi family zone d (R-3) lot
on the street in that the corner lot immediately to the south is single family (R-1).
The lot is irregular in shape (triangular) and has a front width of 183 feet. The units
are oriented to a central courtyard and pool. The units are located on the north
(wider) portion of the lot while parking is provided on the southerly part of the lot.
The zoning permits one unit for every three thousand square feet of land area;
therefore on this 15,500 square foot lot up to five (5) units are permitted.
Four of the units will be one bedroom with one bath and range from 700-800 square
feet each. The fifth unit is two bedrooms and 2 baths with an area of 1361 square
f eet.
III. ANALYSIS:
A. REQUIRED FINDINGS FOR APPROVAL OF A PRECISE PLAN:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.

The design of the use is compatible with other multiple residential uses
existing in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
Justification:
The surrounding land in the vicinity is zoned for similar types of uses as
proposed and owners would not be deprived the use of their land.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
Justification:
The precise plan complies with all code requirements and will be required to
receive architectural commission approval and will not be detrimental to
the public peace, health, safety or general welfare.
B. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the proposed project
is a Class 3 categorical exemption for the purposes of CEQA and no further
documentation is necessary.
III. STAFF RECOMMENDATION:
1. Approval of the findings.
2. Approval of Planning Commission Resolution No. , approving Case No.
PP 24-83, subject to conditions.

Conditions of Approval

Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein in addition to all municipal ordinances and state and
federal statutes now in force or which hereafter may be in force..
3. Construction of this project shall commence within one year from the date of
approval unless an extension of time is granted; otherwise said approval shall become
null and void and of no effect whatsoever.
4. Prior to the issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permits or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit for
the use contemplated herewith.
Department of Public Works:

CONSTRUCTION OF FIVE RESIDENTIAL UNITS ON THE
EAST SIDE OF OCOTILLO, ONE LOT NORTH OF VERBA
SANTA.
CASE NO. PP 24-83
WHEREAS, the planning commission of the City of Palm Desert, California,
did on the 17th day of January, 1984, hold a duly noticed public hearing to consider the
request of MIKE SUKO for approval of a precise plan of design to allow the development
of five residential units in the R-3, 20,000 (3) zone on the east side of Ocotillo Drive, one
lot north of Verba Santa.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project is a Class 3 categorical exemption for purposes of CEQA and no further
documentation is necessary.
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design
and parcel map waiver.
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
3. The precise plan will not endanger the public peace, health,
safety or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That approval of Precise Plan 24-83 is hereby granted for reasons subject
to the attached conditions.

Planning Commission, held on this 17th day of January, 1984, by the following vote, to

existing in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
Justification:
The surrounding land in the vicinity is zoned for similar types of uses as
proposed and owners would not be deprived the use of their land.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
Justification:
The precise plan complies with all code requirements and will be required to
receive architectural commission approval and will not be detrimental to
the public peace, health, safety or general welfare.

A. DESCRIPTION OF SITE:
The site is vacant, slopes from south to north and has an area of 15,500 square
f eet.
B. ADJACENT ZONING AND LAND USE:
North: R-3/Multi Family
South: R-I/Single Family
East: R-I/Single Family
West: R-3/Vacant
C. GENERAL PLAN LAND USE DESIGNATION:
Low Density Residential, 3-5 d.u./acre.
H. DISCUSSION:
The proposed five (5) units comply with all ordinance requirements. This hearing is to
review the site plan as submitted. The property is located on the east side of
Ocotillo, one lot north of Verba Santa. This is the first multi family zone d (R-3) lot
on the street in that the corner lot immediately to the south is single family (R-1).
The lot is irregular in shape (triangular) and has a front width of 183 feet. The units
are oriented to a central courtyard and pool. The units are located on the north
(wider) portion of the lot while parking is provided on the southerly part of the lot.
The zoning permits one unit for every three thousand square feet of land area;
therefore on this 15,500 square foot lot up to five (5) units are permitted.
Four of the units will be one bedroom with one bath and range from 700-800 square
feet each. The fifth unit is two bedrooms and 2 baths with an area of 1361 square
feet.
