Case No. PP 24-83 - MIKE SUKO, Applicant Request for approval of a precise plan of design to allow construction of a five unit apartment complex on the east side of Ocotillo Drive, south of Verba Santa, in the R-3, 20,000 (3) zone. Mr. Smith reviewed the staff report and recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. The applicant was not present. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. MS. ELEANOR CRESWELL, 46-139 Verba Santa, asked if there would be air condition units on top of the roofs. Mr. Smith replied they would not. MS. MARILYN BIBBY, 46-100 Verba Santa, asked how high the fence would be between this project and her property. Mr. Smith replied 6 feet. MR. THOMAS CRESWELL, 46-139 Verba Santa, stated that Mr. Suko had erected a 6 foot cedar fence in the rear of his property and he did not feel it was structurally stable. Mr. Smith replied that he was aware of the fence and assured Mr. Creswell the matter would be looked at and taken care of. Because there was concern expressed a condition of approval was added to read; "A 6 foot block wall on the east and north side of the property shall be installed." Commissioner Erwood felt the applicant should have the opportunity to respond to this condition. Mr. Smith assured the commission the applicant was already aware of the fence problem. Chairman Wood closed the public hearing. Moved by Commissioner Richards, seconded by Commissioner Crites, to approve the findings as recommended by staff. Carried unanimously 5-0. Moved by Commissioner Richards, seconded by Commissioner Crites, to adopt Planning Commission Resolution No. 922, approving Case No. PP 24-83, subject to conditions, as amended. Mr. Joy reviewed the staff report and recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. CHUCK GARLAND, 33163 Cathedral Canyon, stated he was prepared -4 MINUTES PALM DESERT PLANNING COMMISSION JANUARY 17, 1984 to meet any necessary requirements. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this request. MR. RICHARD PETRIE, 45-620 Mountain View, was concerned for the setback in the rear of the units. He objected to the adjustment and felt it would create a noise impact and invasion of privacy. MR. ALAN FULK, 73-950 Mountain View, was concerned about the existing underground storm drain on his property, which drains onto Portola, and asked what the city intends to do to assure there would not be a possible drainage problem. Staff noted an easement did not exist there and explained that they are aware of the drainage structure and would be studying the situation further. It was suggested that this matter be continued for two weeks to clarify the drainage situation and setback concerns. MRS. CATHY MONROE, corner of Alessandro and Portola, stated she was very familiar with the drainage problems caused by the storm drain and felt it was very bad. MR. WILLIAM SETZLER, 73-950 Mountain View, also added that many people were not aware of the strain of the drainage structure. He asked for a continuance. Moved by Commissioner Crites, seconded by Commissioner Downs, to continue this matter to February 7, 1984, for further study. Carried unanimously 5-0. E. Case No. CUP 24-83 - H.B. FOOD SERVICES, INC., Applicant A request for approval of a conditional use permit and Negative Declaration of Environmental Impact to allow construction and operation of a 6438 square foot restaurant in a general commercial zone located on property bordered by Alessandro and Palm Desert Drives at San Jacinto Avenue, approximately 300 feet east of San Luis Rey. Mr. Joy reviewed the staff report and recommended approval. Commissioner Downs asked if the applicant was aware of the possibility of Palm Desert Drive (frontage road) becoming a two-way street. Mr. Joy replied that the applicant was aware of this. Mr. Diaz noted a change on Condition No. 19 to read: "Additional right-of-way shall be dedicated and improved on Alessandro Drive to complete a 30 foot half- street width, to include sidewalk." Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. STAN SUTER, director of construction for H.B. Food, accepted staff's recommendation and was present to answer any questions the commission might have. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. MR. DOUG MAVIS, 73-850 Highway 111, manager of the Palm Desert Biltmore, asked what the operating hours would be. APPLICANT: CHARLES GARLAND 33-163 Cathedral Canyon Drive Cathedral City, CA 92234 I. BACKGROUND: A. SITE DESCRIPTION AND SURROUNDING LAND USE: The site is vacant and is surrounded by vacant lots to the north and south and by an existing single family residence to the west. The site is also across the street from the new home of the Religious Science Church of the Desert. B. ADJACENT ZONING: North: R-3 (3) South: R-2 S.P. East: Public Institution West: R-1 C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 d.u./acre II. PROJECT DESCRIPTION: The project involves construction of a duplex residential structure. Each unit will be 1256 sq.ft. and single story. The structure is oriented so that the dwelling unit portion is set back closest to the rear property line with two car garages, whose openings are perpendicular to the street, closest to the front property line. The development of this property requires dedication of fourteen feet along Portola. This leaves a lot dimension of 86 feet in depth and 100 feet of width and comprises grounds for the adjustment due to the resulting decrease in lot depth. Dedications have previously been considered as grounds for an adjustment. The adjustment would reduce the front setback from 15 feet to 10 feet and the rear setback from 20 feet to 12 feet. III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. -1- Staff Report PP 26-83 January 17, 1984 Justification: The design of the use is compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for similar types of uses as proposed and owners would not be deprived the use of their•land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and has received architectural review approval and will not be detrimental to the public peace, health, safety or general welfare. B. FINDINGS NEEDED FOR APPROVAL OF THE ADJUSTMENT: 1. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinances. Justification: The strict application of the twenty and fifteen foot setbacks would result in a decrease of the usable amount of building space. 2. There are exceptional circumstances or conditions applicable to this property not applicable to other properties in the same zone. Justification: The development of this property requires a 14 foot dedication creating a nonconforming lot. 3. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. Justification: Other multifamily structures in the neighborhood were built with reduced setbacks due to being processed by the county prior to incorporation. 4. The granting of an adjustment will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity. Justification: The granting of the adjustment does not relieve the applicant from obtaining all other necessary permits and meeting all other development standards. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for purposes of CEQA and no further documentation is necessary. -2- 4. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect whatsoever. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. The front setback shall be 10 feet, the rear 12 feet. Department of Public Works: 6. Complete grading plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is comenced and the issuance of any permits. 7. Landscaping maintenance on Portola Avenue shall be provided by the owners. 8. This property is in the AO Depth 2' zone as shown on the flood insurance rate map. A flood hazard report, as required by Ordinance No. 221 (Flood Damage Prevention Ordinance) shall be submitted to the public works department. The report must be approved by the flood review committee prior to recordation of the final map. 9. Driveway improvements to be reviewed at the grading plan check stage for sizes and locations. 10. Further staff investigation discovered two storm drains on Mountain View Avenue that empty into a 24 inch line that extends along the northerly property line of the subject site to Portola Avenue and continues past this point eastward. The public works department is recommending a twelve foot easement along this boundary for drainage purposes as an extra condition of approval. The easement further substantiates the setback adjustments due to the reduction of building site area. Another factor to consider is that the property to the rear, plain R-1 zoning, allows a 15 foot rear setback, but the subject property, R-2 zoning, requires a 20 foot rear setback. The adjustment to a 12 foot rear setback then,is a 3 foot differential compared to what is allowed to the rear of the subject site. II. RECOMMENDATION: A. A field investigation was conducted with both the Public Works and Environmental Services staff to review the system and the project site. The Mountain View Drive drainage basins that presently drain the residential area have been constrained in functioning at its full potential by the siltation that accumulates in the basins and pipes. This condition is due to the outlet end of the system which has a bubbler-type set-up and does not allow for the silt and debris that is collected to flow through. A direct result of this is an over- flowing situation that has the remainder of the water directed to the vicinity of the northwest corner of the subject development. Currently, the surrounding area is undeveloped and the area north c ` the property serves as a retention basin for the additional storm waters . Presently, a Capital Improvement Program that is being put together is the Portola Storm Drain project that basically entails the installation of a main line in Portola Avenue to collect the tributary waters east and west of Portola Avenue. At the time this main line is installed, the Mountain View drainage basins and \ pipe will connect to the Portola drain. Staff recommends, at this time, that a <- \v. 12-foot storm drain easement be granted to the City for the future reconstruction of the existing storm drain. A. R. Each unit will be 1256 sq.ft. and single story. The structure is oriented so that the dwelling unit portion is set back closest to the rear property line with two car garages, whose openings are perpendicular to the street, closest to the front property line. The development of this property requires dedication of fourteen feet along Portola. This leaves a lot dimension of 86 feet in depth and 100 feet of width and comprises grounds for the adjustment due to the resulting decrease in lot depth. Dedications have previously been considered as grounds for an adjustment. The adjustment would reduce the front setback from 15 feet to 10 feet and the rear setback from 20 feet to 12 feet. i i III. ANALYSIS: A. FINDINGS NEEDED FOR APPROVAL OF PRECISE PLAN: 1. A field investigation was conducted with both the Public Works and Environmental Services staff to review the system and the project site. The Mountain View Drive drainage basins that presently drain the residential area have been constrained in functioning at its full potential by the siltation that accumulates in the basins and pipes. This condition is due to the outlet end of the system which has a bubbler-type set-up and does not allow for the silt and debris that is collected to flow through. A direct result of this is an over- flowing situation that has the remainder of the water directed to the vicinity of the northwest corner of the subject development. Currently, the surrounding area is undeveloped and the area north of the property serves as a retention basin for the additional storm waters . Presently, a Capital Improvement Program that is being put together is the Portola Storm Drain project that basically entails the installation of a main line in Portola Avenue to collect the tributary waters east and west of Portola Avenue. At the time this main line is installed, the Mountain View drainage basins and pipe will connect to the Portola drain. Staff recommends, at this time, that a 12-foot storm drain easement be granted to the City for the future reconstruction of the existing storm drain. A. R.
