BUILDING IN THE C-1, S.P. ZONE ON THE NORTH SIDE OF HIGHWAY 11.1, 200 FEET EAST OF CABRILLO AVENUE. CASE NO. PP 28-83 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of February, 1984, hold a duly noticed public hearing to consider the request of FRANK R. GOODMAN & ASSOCIATES for approval of a Negative Declaration of Environmental Impact and a precise plan of design to allow construction of a 5000 square foot commercial building in the C-1, S.P. zone on the north side of Highway Ill, 200 feet east of Cabrillo Avenue, more particularly described as: APN 625-085-004 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-8911, in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist: to justify the granting of said precise plan of design- 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE,, BE IT RESOLVED by the Planning Commission of the City of. Palm Desert, California, as follows: 1. That the above recitations are :true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 28-83 is hereby granted for reasons subject to the attached conditions. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development: of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all rnunicioal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an exension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Provide 3.5 foot high decorative masonry wall in front of parking lot areas and trash area exposed to streets (except driveways). 7. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 8. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 9. Encroachment permits and Hold Harmless Agreement, if determined necessary by the department of public works, shall be obtained prior to issuance of a building permit. 10. In lieu of undergrounding existing utility distribution lines at rear of property as a part of construction, the applicant shall record an agreement guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the city including the property in question. City Fire Marshal: 11. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a. 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 12. Install Riverside County super fire hydrant: a. so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. -2- PLANNING COMMISSION RESOLUTION NO. 933 b. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. curbs shall be painted red 15 feet in either direction from each hydrant. d. hydrants shall not be located closer than 25 .feet to any building. 13. Prior to issuance of building permits the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. 14. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 15. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 28-83 is in accordance with the requirements prescribed by the fire marshal." 16. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 17. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. Department of Public Works: 18. Landscaping maintenance on Alessandro Drive and Frontage Road parkways shall be provided by the owner. 19. Complete grading plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval prior to issuance of any permits. 20. Size, number and location of driveways shall be installed to public works department specifications. 21. Sidewalk installed shall be on Alessandro Drive to satisfaction of director of public works. /Ir -3- I MINUTES PALM DESERT PLANNING COMMISSION FEBRUARY 7, 1984 Request for approval of a parcel map creating two parcels in the S.I., S.P. (Service Industrial District, Scenic Preservation Overlay) zone located between Cook Street and Eclectic Street, north of 42nd Avenue. Mr. Joy reviewed the staff report and recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. HAROLD HOUSLEY, 74-040 El Paseo, was present for any questions the commission might have. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. ALAN LEVINE, 71-537 Highway 1I1, explained that the purpose of this request was to transfer ownership of the swimming pools from the golf course to the homeowners association. Chairman Wood asked if anyone had discussed it with the property owners. Mr. Levine replied he did not know. Commissioner Downs asked if the property owners were legally notified. Mr. Joy replied that they were and there was no response. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Chairman Wood believed that the property owners were not aware of this request. Moved by Commissioner Crites, seconded by Commissioner Downs, to approve the. findings as presented by .staff. DESCRIPTION OF SITE: The property is located on the north side of the frontage road between Cabrillo Avenue and DeAnza Way. The site also has frontage on Alessandro Drive to the rear. The property, until recently, was used for outdoor storage of plants by the House of Plants who have a store immediately to the west. Presently there is a chain link fence across the rear with a wrought iron fence across the front. Along the west property line is a wood fence with a building and fence on the east side. Overhead utility lines run along the rear property line parallel to Alessandro Drive. B. ADJACENT ZONING AND LAND USE: North: R-3 (4)/Multiple family South: C-1, S.P./Commercial East: C-1, S.P./Commercial West: C-1, S.P./Commercial C. GENERAL PLAN LAND USE DESIGNATION: Core Area Commercial R. PROJECT DESCRIPTION: A. GENERAL: The proposed building would contain 5000 square feet of floor area and have the parking lot to the rear with vehicular access to Alessandro Drive. The building would be one story in height and contain a maximum five suites. B. PARKING/CIRCULATION: Required parking is 17 spaces and 18 spaces are provided. Due to the width of the lot the parking layout is not ideal but does maximize the number of spaces. A screen wall is required facing Alessandro Drive to screen the cars. ARCHITECTURE: The building is a conventional commercial building utilizing stucco walls and fascias and fixed glass storefronts. D. ARCHITECTURAL COMMISSION REVIEW: The architectural commission reviewed the preliminary plans at their meeting of December 27, 1983, and approved them subject to a number of conditions. The applicant has filed revised plans that reflect the conditions of approval. III. ANALYSIS• A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other commercial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity, is zoned for the same type of use as proposed and owners would not be,deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan comples with all code requirements and has received preliminary architectural commission approval and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared. IV. STAFF RECOMMENDATION: Staff feels the proposed project is acceptable. Therefore, we recommend: A. Adoption of the findings; B. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Provide 3.5 foot high decorative masonry wall in front of parking lot areas and trash area exposed to streets (except driveways). 7. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 8. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 9. Encroachment permits and Hold Harmless Agreement, if determined necessary by the department of public works, shall be obtained prior to issuance of a building permit. 10. In lieu of undergrounding existing utility distribution lines at rear of property as a part of construction, the applicant shall record an agreement guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the city including the property in question. City Fire Marshal: 11. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 12. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 17. Landscaping maintenance on Alessandro Drive and Frontage Road parkways shall be provided by the owner. 19. Complete grading plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval prior to issuance of any permits. 20.
