The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall" be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. The minimum fire flow requirement is 3000 GPM for a duration of 3 hours in addition to the calculated average domestic use. APPLICANT: BOB SANDIFER 45-120 San Pablo, Suite 2-D Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE: The 21,500 sq.ft. site is an existing graded lot in the Palm Desert Business Center. The lot is on the southern edge of the subdivision and is elevated 14 feet above the Cook Street Business Park which is to the south. B. ADJACENT ZONING AND LAND USE: All adjacent property is vacant and zoned service industrial C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial U. PROJECT DESCRIPTION: A. SITE PLAN: The proposed building is to be located on the corner of the site closest to the intersection with the parking to the rear and side. This enables the required 20 foot front and 10 foot street side yards to be utilized for landscaping. The applicant is in the landscaping maintenance business and this fits into his building plans. This parking area to the rear will also be the maintenance yard for the company's vehicles. As mentioned earlier, there is a 14 foot height differential between the two industiral parks and this will be the first project on the high side of the boundary. There are two retaining walls holding the slope and the applicant's parking comes right to the edge of the top wall. The applicant intends to plant trees on the slope between the two walls to eventually screen the parking area. The applicant has agreed to immediately install either a vine covered chain link or 42" cedar fence along the top wall upon the discretion of the architectural commission. Staff has worked with the applicant to further increase the amount of landscaping along the westerly wall within the rear yard. Since the applicant owns the adjacent piece of property to the west, he plans to share a 24 foot wide driveway with this property. This is being achieved by an agreed condition that a 12 foot easement be recorded on that adjacent \ property. -1- B. ELEVATIONS: The 8691 sq.ft. building is divided so that the first floor is 5458 sq.ft. while the second floor is 3233 sq.ft. The preliminary elevations have been approved by the architectural commission. The 28 foot building height is within the 30 foot or two-story height limitation. Staff feels that the location of the two-story element will not have a negative impact on any adjacent properties due to similar adjacent zoning. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and has received preliminary design review board approval and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse environmental impact on the environment and a Negative Declaration of Environmental Impact has been prepared.
