Commissioner Erwood added that he was very familiar with the crime rate and his experience is that it is higher for the single family detached residents than apartments. He felt that with the amenities proposed for the project it makes it compatible to country club living. Moved by Commissioner Richards, seconded by Commissioner Crites, to approve the findings as recommended by staff. Carried 4-0-1 (Wood abstained). Moved by Commssioner Richards, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 947, recommending approval of C/Z 84-1, PP 84-3, and DA-3 to the city council, subject to conditions. Carried 4-0-1 (Wood abstained). A RECESS WAS CALLED AT 10:08 P.M. - THE MEETING RECONVENED AT 10:18 P.M. E. Case Nos. PP 84-5 and PMW 84-3 - TED MARTINEZ, Applicant Request for approval of a precise plan of design, Negative Declaration of Environmental Impact and parcel map waiver to consolidate the site into one lot to allow construction of a 28 unit apartment project (utilizing 25% density bonus allowed by state law) in the R-3 (Multiple family zone, one unit per 2500 square feet of land) located 225 feet south of the Highway I I I Frontage Road, between Deep Canyon Road and Shadow Hills Road. Mr. Sawa reviewed the staff report and recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. TED MARTINEZ, 14032 Enderle St., Tustin, was present to answer any questions the commission might have. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Richards noted that this proposal was thoroughly discussed at their study session and felt it was a good project. Moved by Commissioner Downs, seconded by Commissioner Richards, to approve the findings as recommended by staff. Carried unanimously 5-0. Moved by Commissioner Downs, seconded by Commissioner Crites, to adopt Planning Commission Resolution No. 948, approving PP 84-5 and PMW 84-3, subject to conditions. Carried unanimously 5-0. F. Case N(o. P�TEPHANOS KAPOROS, Applicant Request to allow construction of a duplex in a multifamily residential zone located on the south side of Candlewood Street, 144 feet west of Quailbrush Avenue. Mr. Diaz reviewed the staff report and recommended approval. Commissioner Richards asked what the size of the units were. Mr. Diaz replied about 1100 to 1200 sq.ft. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. CASE NO. PP 84-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of May, 1984, hold a duly noticed public hearing to consider the request of STEPHANOS KAPOROS for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89," in that the director of environmental services has determined that the project is is a Class 3 categorical exemption. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect whatsoever. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. The front setback shall be 20 feet, the rear 15 feet. City Fire Marshal: 6. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2-hour duration in additon to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-ini fire protection provisions of buildings. Install Riverside County super fire hydrant: a. so that no point of any building is more than 250 feet from a hydrant measured along approved vehicular travel ways. b. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. curbs shall be painted red 15 feet in either direction from each hydrant. d. hydrants shall not be located closer than 25 feet to any building. 8. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 9. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-6 is in accordance with the requirements prescribed by the fire marshal." 10. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 11. SITE DESCRIPTION: The site is flat and when developed will slope slightly from south to north. B. ADJACENT ZONING AND LAND USE: North: R-3/Apartments South: R-1/Single Family Residence East: R-3/Single Family Residence West: R-3/Apartments C. GENERAL PLAN LAND USE DESIGNATION: High Density Residential II. PROJECT DESCRIPTION: A. SITE PLAN AND ELEVATIONS: The applicant is proposing attached single story two bedroom apartment units, each with a two car garage that faces directly onto Candlewood. The rear yard is divided so that each unit will have an 820 sq.ft. private rear yard. This square footage is after an additional requirement that the building be moved back five feet to allow a twenty foot long driveway between the garage opening and public right-of-way as required by code. The elevations show a 16Y: foot height with a Spanish tile roof. B. FINDINGS: 1. That the design of the project will not substantially depreciate adjacent property values and will be compatible with improvements in the vicinity. Justification: The design of the use is compatible with other residential uses existing in the vicinity, due to density and heights proposed. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for similar types of uses as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings . 2. Install Riverside County super fire hydrant: a. so that no point of any building is more than 250 feet from a hydrant measured along approved vehicular travel ways. b. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. c. curbs shall be painted red 15 feet in either direction from each hydrant. d. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the building department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-6 is in accordance with the requirements prescribed by the Fire Marshal . " 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6.
