Mr. Sawa reviewed the staff report and recommended approval. Chairman Crites opened the public hearing and asked if the applicant wished to make a presentation. MR. PAUL FILING, #3 Cueta, Rancho Mirage, described the design of the project. He received unanimous approval from the homeowners association. Chairman Crites asked if anyone else wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Wood asked if there had been any objections from residents in the area. Mr. Sawa replied there had not. Moved by Commissioner Richards, seconded by Commissioner Downs, to approve the findings as recommended by staff. Carried unanimously 5-0. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a - building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission, subdivision process, and building permit procedures. 3. Construction of the total development shall be done in one phase. 4. Construction of a portion of said project shall commence within two years from the date of approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 5. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 6. FILING for approval of a one lot subdivision to allow construction of a six unit condominium project in the R-3 20,000 (3) S.P. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 2. The applicant shall have twenty-four (24) months from the date of the approval of conditional approval of the tentative map for filing of the final map unless an extension of time as permitted by code is granted by planning commission. 3. All on site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 4. Any dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. 5. The CC&R's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. C. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. (Multiple family, 20,000 sq.ft. minimum lot size, one unit per 3000 sq.ft. of lot area, scenic preservation overlay) located on the east side of Ocotillo Drive, 260 feet south of Tumbleweed Lane. APPLICANT: . PAUL M. FILING 3 Cueta Dr. Rancho Mirage, CA 92270 ARCHITECT: KURTZMAN KODAMA 2800 Van Ness Ave San Francisco, CA 94109 ENGINEER: CHARLES HAVER AND ASSOCIATES 74-390 Highway III Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE: The site is a vacant lot containing approximately 19,630 sq.ft. (.45 acre) of area. The lot while relatively level slopes from south to north. Power poles run north-south parallel to the rear property line. 6 foot high wood fences exist to the rear of the property, while a 6 foot block wall exists to the south. Curb and gutter has been installed along the street. B. ADJACENT ZONING AND LAND USE: North: R-3 20,000 (3) S.P./Vacant South: R-3 20,000 (3) S.P./Condominium East: R-1 12,000/Single Family West: PC(4) S.P./Motel C. GENERAL PLAN LAND USE DESIGNATION: Medium density residential 5-7 d.u./acre H. PROJECT DESCRIPTION: A. GENERAL: This request is to allow construction of a six unit one-story condominium project with the parking area located in the basement below the finish grade. B. SITE DESIGN: The units are basically in the middle of the site facing Ocotillo Drive. There are two units located near the southeast corner of the site. A swimming pool and spa are located near the northeast corner of the property. -1- Staff Report PP 84-8, TT 20064 June 5, 1984 Most of the parking is located adjacent to the south property line with three spaces near the north property line. C. PARKING: Open Covered Required 3 sp 11 sp Provided 3 sp 11 sp D. UNIT DESIGN: Unit Type/Number Unit Size 2 bedroom/5 1195 to 1280 sq.ft. 1 bedroom/1 885 sq.ft. E. BUILDING DESIGN/HEIGHT: The architecture of the project is basically Spanish with exterior materials consisting of Spanish tile roofs, Navajo white stucco walls, and brown trim. Hardscape will consist of turfblock and natural Mexican pavers. Other architectural features consist of a decorative fountain, and arbor near the swimming pool. All units will have private outside areas. The units while one story in height, have garage spaces designed as basements (garage floors are minimum four feet below existing adjacent grades). They have designed them this way because the project is limited to one story due to R-1 zoned lots behind the site. The applicant indicates that the overall height from adjacent grade above the basement structures will be no more than 18 feet which is the height limit for one story in the R-1 zone. This would be similar to the Ryway Place project which was recently completed. F. LANDSCAPING/OPEN SPACE: The conceptual landscaping plan indicates proposed landscaping which appears well designed. Along the parking area where there will be a high retaining wall, coordination with the adjacent block wall will be necessary to insure compatible construction. Additionally, planting provided along there should be vertical to break up the massive height of the wall. The open space and lot coverage maximums of the R-3 zone will be complied with. G. ARCHITECTURAL REVIEW: The applicant has filed for preliminary architectural approval. Staff will schedule the request after they receive planning commission approval. H. TENTATIVE TRACT MAP: The applicant has filed a request for a one lot tentative tract map as required for condominium purposes. III, ANALYSIS• A. FINDINGS FOR PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and compatible with other uses existing in the vicinity. -2- Staff Report PP 84-81 TT 20064 June 5, 1984 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Surrounding land to the north and south in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land, nor would they be negatively impacted by traffic or structures. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The project is designed in a manner that will not endanger the public peace, health, safety or general welfare due to compliance with existing code requirements. Staff feels these findings can be justified in this case. B. FINDINGS NEEDED FOR APPROVAL OF TENTATIVE TRACT MAP: 1. That the proposed map is consistent with applicable general and specific plans. Justification: The proposed map is consistent with the zoning and general plan designation. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. Justification: All public streets will be improved and sufficient drainage facilities will be provided in conformance with the general plan guidelines and city ordinances. 3. That the site is physically suitable for the type of development. Justification: The site is of sufficient size to accommodate the proposed project and the topography of the site does not create significant problems. 4. That the site is physically suitable for the proposed density of development. Justification: The design of the project indicates that the site is suitable for the proposed density of development because the site can be served by respective utilities, the city and existing or proposed circulation system. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. Justification: The design will not cause substantial environmental damage or injure fish or wildlife or their habitat because it will be constructed in compliance with applicable regulations. 6. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. Justification: -3- Staff Report PP 84-8, TT 20064 June 5, 1984 The design will not cause serious public health problems because it will be in compliance with applicable health, safety and building codes. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. Justification: There have been no easements acquired by the public at large for access through or use of property within the proposed subdivision. Staff feels these findings can be justified in this case. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 1 categorical exemption for purposes of CEQA and therefore, no further documentation is deemed necessary. IV. CONCERNS/CONSIDERATIONS: The project is a relatively well designed project. Staff's main concern is that the basements are properly designed to comply with code requirements. During the architectural process, a detailed grading plan will need to be submitted to insure code compliance. Additionally, proper treatment of the retaining wall along the south property line will be necessary to insure that no problems with the existing wall occur. In order to provide compatibility and privacy for the adjacent lots to the rear, a six foot high masonry wall should be constructed to replace the existing wood fences. V. STAFF RECOMMENDATION: Staff feels the proposed project is acceptable with modifications and recommends: A. Adoption of the findings; B. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission, subdivision process, and building permit procedures. 3. Construction of the total development shall be done in one phase. 4. Construction of a portion of said project shall commence within two years from the date of approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 5. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 6. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 7. No air conditioning equipment shall be located within the 10 foot rear yard setback area. 8. Pool equipment shall be located 5 feet from side property line. 9. Detailed grading plan including existing grading and finish floor elevations shall be submitted for review at architectural commission level to insure compliance with building height and number of stories requirements. 10. Six foot high masonry wall shall be constructed along rear property line. 11. In lieu of undergrounding existing utility distribution lines at rear of property as a part of construction, the applicant shall record an agreement prior to issuance of a building permit guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the city including the property in question. 12.
