The architectural plans were approved May 22, 1984. The request for the time extension was. timely. There have been no changes in the city's regulations that would negatively impact this project. 11. PP 84-9 and VAR 84-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of May, 1984, hold a duly noticed public_ hearing to consider a request by RALPH SANTOPIETRO for the above mentioned project. The precise plan will not endanger the public peace, health, safety, or general welfare. 4. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinance. 5. There are exceptional circumstances or conditions applicable to this property not applicable to other properties in the same zone. 6. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. 7. The granting of the variance will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity. The development of the property shall conform substantially with Exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission, subdivision process, and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Palm Desert Water Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. That the applicant enter into an agreement with the city guaranteeing that the property will voluntarily be a part of any undergrounding district which may be established by the city, including the property in question. The form of this agreement shall be acceptable to the city attorney and shall run with the land. This condition shall not be applicable to the service lines that lead directly to the building(s) which must be undergrounded. 8. That the four garage doors be equipped with automatic garage door openers. 9. The garages are to be kept clear for express purpose of parking of vehicles. 10. Wing walls at rear to be deleted. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 13. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 14. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the City. 15. Landscaping maintenance on San Rafael shall be provided by the owner. 16. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 17. Dedication of 5 feet of right-of-way on San Rafael shall be done prior to issuance of any permits and approval of plans. 18. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to building permits being issued. 19. Size, number and location of driveways to public works specifications. 20. Only one driveway approach will be allowed to serve this property. Size and location to public works specifications. Fire Marshal: 21. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two (2) hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 22. Install Riverside County super fire hydrants located: a. so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. b. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. curbs shall be painted red 15 feet in either direction from each hydrant. d. hydrants shall not be located closer than 25 feet to any building. 23. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. -4- PLANNING CohIMISSION RESOLUTION NO. 950 24. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 34-9 is in accordance with the requirements prescribed by the Fire Marshal." 25. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 26. Aalph erely, S ntopi o Owner Lot 1 of Palma Village #5 Block 6 i MINUTES PALM DESERT PLANNING COMMISSION MAY 15, 1984 Commissioner Erwood felt that the use of property would be too intense. He had concerns for the percentage of slope to the road; he also felt there was a significant amount of cutting and grading. He believed the zoning for that property was questionable. Chairman Wood felt that the property is zoned properly and pointed out that there was only one owner of the entire hill. He felt the restaurant would be enhancing to the area and gave examples of other restaurants on top of a hill. He felt with those conditions added the city would have complete control of the development. Moved by Commissioner Crites, seconded by Commissiner Erwood, to deny the requested CUP 84-1. VOTE: AYES: Crites, Erwood NOES: Wood, Downs Because of a lack of majority vote, this item was automatically continued to June 5, 1984, at 7:00 p.m. B. Continued Case No. ZOA 84-2 - CITY OF PALM DESERT, Applicant An amendment to reestablish 450 sq.ft. minimums for studio apartments. Mr. Diaz explained that this request was withdrawn based on clarification from city council that 600 sq.ft. be the minimum for studio apartments. C. Case No. PP 4-98 and VAR 84-1 - RALPH SANTOPIETRO, Applicant Request for approval of a precise plan of design for four (4) residential units on a 10,700 square foot lot on the east side of San Rafael, 230 feet north of San Gorgonio Way and variances to reduce the required rear yeard setback from 10 feet to 5 feet and to reduce the required on-site parking from 8 spaces to 6 spaces. Mr. Smith gave the staff report explaining that the reasons for the difficulty of developing a plan on the site is because of the one story limitation, a public works requirement of a 5 ft. dedication, and the necessity of 885 sq.ft. units. The plan required two variances: rear yard setback and on-site parking. Staff recommended approval. Commissioner Crites cited that if residents use the driveway for parking it blocks other parking spaces; this was one of the problems staff felt necessitated for a variance. Commissioner Crites asked what the landscaping is proposed for the rear yard area. Mr. Smith replied that this matter would be before the architectural review commission and added that a condition could read: "The rear yard area shall be intensely landscaped in addition to the proposed fence." Commissioner Downs asked if there was an exit access proposed. Mr. Smith replied that if one is required by the building department it would be,provided. Chairman Wood was concerned with the 5 foot setback. Mr. Smith noted that all the property owners were notified and no comments were received. In addition, Mr. Diaz stated that the developer had a right to develop 4 units on that lot under the city's zoning requirements. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. CHARLES MARTIN, 73-725 El Paseo, described the plan and clarified some concerns expressed by commission and requested approval. Commissioner Downs asked if the windows could be installed more conveniently for the handicap. Mr. Martin replied that he would clarify with the building department in regards to meeting handicap requirements. -5- MINUTES f PALM DESERT PLANNING COMMISSION MAY 15, 1984 Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this matter. MR. JIM UREK, owner of four lots, 44-500 San Rafael, strongly urged against on-street parking and the variance. Commissioner Crites asked Mr. Martin what provisions were made for storage. Mr. Martin replied that there would be storage in the "nose" of the garage. MR. RALPH SANTOPIETRO, owner, explained that when they had to dedicate the 5 foot setback that created all the problems. He has tried to minimize any problems that might arise from this proposal. Commissioner Erwood asked the applicant if the lease agreement would indicate that they are not to use the garages for storage. Mr. Santopietro replied yes. Chairman Wood closed the public hearing. Commission discussed the on-street parking concern but agreed that because the city is requiring the 5 ft. dedication and because the garage areas will be used strictly for car parking this would minimize the problem. Two conditions were to be added: "Wing walls at rear to be deleted. Intensive verticle screening to be planted along rear wall." Moved by Commissioner Erwood, seconded by Commissioner Downs, to approve the findings as recommended by staff. Carried unanimously 4-0. Moved by Commissioner Erwood, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 950, approving VAR 84-1 and PP 84-9, subject to conditions as amended. Carried unanimously 4-0. D. Case No. PP 84-11 and PMW 84-4 - EDWARD TUNISON AND CHARLES MARTIN, Applicants Request for approval of a precise plan of design to allow construction of an 11 unit apartment complex and a parcel map waiver to consolidate the existing three lots into one lot for a 28,000 square foot site located on the east side of Sunset Lane between El Camino and Abronia Trail. Mr. Smith gave the staff report and recommended approval. Chairman Wood opened the public hearing and asked for a presentation from the applicant. MR. CHARLES MARTIN, architect, described the project and explained why the project was designed as proposed. Chairman Wood called for input in FAVOR or OPPOSITION. There being none, the public hearing was closed. Moved by Commissioner Crites, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried unanimously 4-0. APPLICANT: RALPH SANTOPIETRO P.O. Box 1166 Rancho Mirage, CA 92270 I. BACKGROUND: A. DESCRIPTION OF SITE: The site is a flat, vacant 10,700 square foot lot located between two developed properties. B. ADJACENT ZONING/LAND USE: NORTH: R-2/Multi Family SOUTH: R-3/Multi Family EAST: R-I/Residential WEST: R-2/Vacant C. GENERAL PLAN LAND USE DESIGNATION: Residential High Density 7-18 d.u./acre. II. PROJECT DESCRIPTION: A. GENERAL: The project consists of 4 two bedroom, 885 square foot apartment units. The units will be single story in accordance with the ordinance. The site, with four (4) units, is extremely tight; however, the R-3 zoning does entitle the owner to 4 units (i.e. 1 unit per 2,500 square feet of lot). The site becomes tight for a variety of reasons, including: 1) Building height is limited to one story (18 feet) because the site backs onto R-1 property to the east; 2) Public works department is requiring the dedication of 5 feet for street widening; 3) The applicant feels that 2 bedroom, 885 square foot units are necessary to assure adequate return on his investment. Considering these factors, staff felt that the project as presented was not unacceptable and suggested to the applicant that he should consider filing the necessary variance application. B. PRECISE PLAN ANALYSIS: Site Plan/Parking: The site plan has been proposed with the structures in two tiers with the group usable open space area located between the structures. Across the front of the property, set back 20 feet from the ultimate property line, will be a row of four garages. To either side of the garages will be an open parking space. Adjacent and connected to the garages by a breezeway will be one of the units. To the rear of the units will be the usable open space area and to the rear of this area is a row of three (3) units in one building. PP 84-9 and VAR 84-1 MAY 15, 1984 The code requires that apartment complexes provide 2 parking spaces per unit. The applicant's original site plan had 8 parking spaces delineated; however, 2 of the spaces were immediately adjacent to the street and code prohibits parking spaces within 6 feet of the property line. This problem in conjunction with the street widening necessitated the deletion of these parking spaces (see further discussion under variance section). C. ARCHITECTURAL COMMISSION ACTION: April 24, 1984, architectural commission reviewed the plans, but felt that the matter was too unclear at this time and would be until the precise plan and variance requests are decided upon. The case was continued until May 22, 1984. III. VARIANCE APPLICATION ANALYSIS: VARIANCES: Discussion: Two variances are necessary in order to approve the precise plan as proposed. The rear building is proposed with a five (5) foot setback rather than the minimum 10 feet as required by code. Considering the height of this row of units (10 feet) and the five feet of street widening, it was felt that a variance was warranted and would not negatively impact the adjacent property to the east (rear). (See required findings below.) The second requested variance is for a reduction in the required off-street parking from 8 spaces to 6 spaces. Code requires apartment complexes to provide 2 parking spaces per unit, of which one of the two spaces must be covered. Four garages are provided, each with a 20 foot deep driveway. The original plan submitted provided four (4) open parking spaces perpendicular to the driveway area. Code prohibits parking spaces adjacent to the street unless they are set back a minimum 6 feet from the property line. This setback could not be provided considering that each garage has a driveway access 20 feet long; then notwithstanding the provision of other open spaces, this would be the likely location for people to park. Deletion of the two (2) spaces adjacent to the street will allow for some landscaping at the front of the property which was nonexistent in the original submittal. Although the parking spaces cannot be counted for the purpose of compliance with the code, it is felt that they can be considered when reviewing the variance request. Findings For Approval Of Variances: 1. That strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the ordinance. Response: In the matter of the parking variance, a strict interpretation would result in the need for other variances or the project as presented being one which could not be approved because it did not comply with code. The driveway parking spaces, which cannot be counted for the purposes of determining compliance with code, will be used for parking and should assure adequate off-street parking. In addition, automatic garage door openers are being required to encourage the use of the garage for the parking of vehicles rather than storage purposes. In the matter of the variance for the reduced rear yard, a strict interpretation would result in a 10 foot yard which is almost as unusable as a five foot yard. Considering that the five feet of street widening is being required by the city, -2- PP 84-9 and VAR 84-1 MAY 15, 1984 this 5 feet would have to be picked up elsewhere on the site; likely in the open space which is only minimal now. The variance will permit the group usable open space area to be retained at an adequate size with usable dimensions. 2. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties in the same zone. Response: In the matter of both variances, the property in question is the only R-3 zoned lot in the area which is adjacent to R-1, to one (1) story or 18 feet which as a consequence results in a more spread out development than would one using two story structures. 3. That strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. Response. The strict interpretation of the ordinance provision would result in the applicant being unable to develop the property to its highest and best use G.e. 4 units), which the R-3 zoning entitles him. Other R-3 zoned properties are not limited to single story development and therefore should be able to develop to limits the code provides. 4. That the granting of the variance or adjustment will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. Response: It is felt that the granting of both variances will not be detrimental to other properties or improvements in the vicinity. In the matter of the reduced rear yard, the structure is flat roofed and a maximum 10 feet high. In addition, a 6 foot masonry wall will be installed on the property line. The five (5) foot rear yard should not have a negative impact on property in the area. In the matter of the reduction in the parking standard the site will have, in effect, 10 usable parking spaces, although for the purposes of the code only 6 can be counted. Deletion of the 2 parking spaces adjacent to the street will allow for installation of a landscaped area between the street and the screen wall and should represent an improvement to the area. It is felt that the findings necessary to grant the requested variances can be met. Findings For Approval Of Precise Plan: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Response: The project has been designed to conform to the code requirement relating to single story development adjacent to R-1 zoned property. In so designing the project 2 variances become necessary, but it is felt that the overall development will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Response: -3- PP 84-9 and VAR 84-1 MAY 15, 1984 The surrounding land in the vicinity is zoned for similar types of uses as proposed, except for the R-1 zoned property to the east. Owners will not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Response: The precise plan complies with all code requirements, except for the variances as requested and approved, and must receive architectural commission approval and will not be detrimental to the public peace, health, safety, or general welfare. IV. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for purposes of CEQA and no further documentation is necessary. V. RECOMMENDATION: If the commission feels the project and variances are acceptable, then the appropriate action would be: 1. Adoption of Findings 2. The development of the property shall conform substantially with Exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission, subdivision process, and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4.
