MR. JIM UREK, owner of four lots, 44-500 San Rafael, strongly urged against on-street parking and the variance. Commissioner Crites asked Mr. Martin what provisions were made for storage. Mr. Martin replied that there would be storage in the "nose" of the garage. MR. RALPH SANTOPIETRO, owner, explained that when they had to dedicate the 5 foot setback that created all the problems. He has tried to minimize any problems that might arise from this proposal. Commissioner Erwood asked the applicant if the lease agreement would indicate that they are not to use the garages for storage. Mr. Santopietro replied yes. Chairman Wood closed the public hearing. Commission discussed the on-street parking concern but agreed that because the city is requiring the 5 ft. dedication and because the garage areas will be used strictly for car parking this would minimize the problem. Two conditions were to be added: "Wing walls at rear to be deleted. Intensive verticle screening to be planted along rear wall." Moved by Commissioner Erwood, seconded by Commissioner Downs, to approve the findings as recommended by staff. Carried unanimously 4-0. Moved by Commissioner Erwood, seconded by Commissioner Downs, to adopt Planning Commission Resolution No. 950, approving VAR 84-1 and PP 84-9, subject to conditions as amended. Mr. Smith gave the staff report and recommended approval. Chairman Wood opened the public hearing and asked for a presentation from the applicant. MR. CHARLES MARTIN, architect, described the project and explained why the project was designed as proposed. Chairman Wood called for input in FAVOR or OPPOSITION. There being none, the public hearing was closed. Moved by Commissioner Crites, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried unanimously 4-0. A PRECISE PLAN OF DESIGN, PARCEL MAP WAIVER, AND A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION OF A 11 UNIT APARTMENT PROJECT ON THE EAST SIDE OF SUNSET LANE BETWEEN EL CAMINO AND ABRONIA TRAIL. CASE NOS. PP 84-11 and PMW 84-4 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of May, 1984, hold a duly noticed public hearing to consider a request by EDWARD H. TUNISON and SHERRY F. TUNISON for a precise plan of design, parcel map waiver, and negative declaration of environmental impact to allow construction of a 11 unit apartment complex on approximately 0.65 acres on the east side of Sunset Lane between Abronia Trail and El Camino. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of environmental services has determined that the project will not have a negative impact on the environment and a Negative Declaration has been prepared. WHEREAS, at said pulbic hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design and the parcel map waiver to consolidate three lots into one lot: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not . endanger the public peace, health, safety, or general welfare. 4. That the proposed waiver to consolidate three lots into one lot and that resulting parcel complies with applicable requirements as to area, improvement and design, floodwater drainage control, appropriate improved public roads, sanitary disposal facilities, water supply availability, environmental protection, and other requirements of the municipal code. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this rase. 2. That approval of Precise Plan 84-11 is hereby granted for reasons subject to the attached conditions. 3. That approval of PMW 84-4 is hereby granted. 4. That a negative declaration of environmental impact is hereby approved subject to implementation of the attached conditions. PLANNING COMMISSION RESOLUTION NO. 951 CONDITIONS OF APPROVAL Case No. PP 84-11 Department of Environmental Services: 1. The development of the property shall conform substantially with Exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission, subdivision process, and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. Project to be provided with a minimum six foot high solid masonry wall along the east, north, and south property lines (except for approved openings). The required wall along the west property line may be the maximum height permitted by code. 7. Location and design of trash enclosures shall be coordinated with Palm Desert Disposal Company. Department of Public Works: 8. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 9. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the city. 10. Landscaping maintenance on Sunset Lane shall be provided by the owners. It. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 12. DESCRIPTION OF SITE: The site is a flat, vacant 28,000 square foot property which consists of 3 adjacent lots. B. ADJACENT ZONING/LAND USE: North: R-3/Hotel South: R-3/Vacant East: R-3/Multi Family West: R-3/Multi Family C. GENERAL PLAN LAND USE DESIGNATION: High Density Residential 7-18 d.u./acre. II. PROJECT DESCRIPTION: A. GENERAL: The project consists of 11 two bedroom apartment units utilizing one and two story structures. Two of the units will be approximately 1,200 square feet and 9 will be approximately 1,100 square feet. The project will also include laundry and storage facilities and garages. The R-3 zoning allows one unit for every 2,500 square feet of lot area. The 28,000 square foot property is then entitled to 11 units. The group usable open space area, while not centrally located for all the units, is well in excess of the minimum 3,300 square feet required by code. B. CIRCULATION/PARKING: Two driveways from Sunset Lane will provide access to the garages. Eleven apartment units are required to have 22 parking spaces, of which at least 11 must be covered. Covered parking for 22 cars is provided. In addition, 6 open parking spaces are delineated which will serve to permit a future conversion to condominiums. - 1 - PP 84-11 and PMW 84-4 MAY 15, 1984 C. ARCHITECTURAL COMMISSION ACTION: The architectural review commission reviewed plans at its meeting of April 10, 1984, and approved the plans. D. PARCEL MAP WAIVER: The property is composed of three lots which the applicant has requested approval to consolidate into one lot through the parcel map procedure. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Response. The precise plan as approved will comply with code requirements; architectural plans have been approved by the architectural commission and the project will be the first new development in the area in some time. The project should not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Response: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Response: The precise plan as amended and conditioned will comply with all code requirements and has received architectural commission approval and will not be detrimental to the public peace, health, safety, or general welfare. Staff is of the opinion that a different site plan layout using different unit types could produce a superior project for this property. Notwithstanding this opinion, the plan as submitted complies with code and the applicant's architect has indicated that the applicant is not prepared to consider a different site layout or unit type. Commission should review the precise plan and determine its adequacy relative to the required findings. B.
