Mr. Strothers replied the primary owners were: Robert Richwayne and Max Freeman of Northern California. Commissioner Richards asked what the size of the units would be and the prices. Mr. Strothers replied they would range from 1100 to 1600 sq.ft. with prices of $120,000 to $145,000. Commissioner Richards asked if the amenities would also be shared with the single family residents. Mr. Strothers replied that it was not their intention. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. MS. PRUDENCE CLUVER, of Los Lagos, asked if they would be I or 2 story buildings. Mr. Joy replied that the apartments would be two-story, the single family one- story. Chairman Crites closed the public hearing. Mr. Joy at this time noted that an additional condition would read: "Tennis courts are to be set back 10 feet from property line and sunken 4 feet." Commissioner Richards felt it was a good project. Moved by Commissioner Richards, seconded by Commissioner Downs, to approve the findings as recommended by staff. Carried unanimously 5-0. Case No. PM 17449 - CHAZEN CONSTRUCTION CO. and A-1 SURVEYING CO., Applicants Approval of a parcel map creating eight parcels for leasing purposes in a partially completed commercial shopping center in a regional commercial zone located at the southeast corner of El Paseo (west) and Highway 111. Mr. Smith gave the staff report and recommended approval. Commissioner Downs inquired about a finding in the staff report regarding natural heating or cooling opportunities of the development. Mr. Smith replied that this was a state required finding which allows a review of the matter for the applicant. Mr. Diaz added that this was a new required finding of the map act to make sure that the cities do not block future developments to provide passive or natural heating and cooling opportunities. Commissioner Richards concurred that staff should review the adequacy of solar access. Chairman Crites opened the public hearing and asked if the applicant wished to make a presentation. MR. FRED STRAIGHTER, representative, was present for any questions the commission might have. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this matter. MR. DON STAGE, 1313 Sandpiper, asked for clarification on what this request was about, he was concerned if this request would change the approved development plan for that area. Mr. Straighter explained that this approval would not affect the approved precise plan or design. This was strickly for properly defining the lease descriptions. Commissioner Downs suggested that the applicant meet with the Sandpiper residents to answer any of their concerns and/or questions. Chairman Crites closed the public hearing. PP 84-16 and VAR 84-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of June, 1984, hold a duly noticed public hearing to consider the request of VICTOR MIHAJSON for approval of a precise plan of design and variance to allow construction of a 4000 sq.ft. furniture store in the C-1, S.P. zone located on the north side of Highway ill (frontage road), 80 feet west of Las Palmas Drive, more particularly described as: APN 627-092-032 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-8911, in that the director of environmental services has determined that the project is a Class 3 categorical exemption and no further documentation is deemed necessary. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall bu subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. DESCRIPTION OF SITE: The site is a vacant lot on the north side of Highway 111, one lot west of Las Palmas Avenue. The area of the site is 8,392 square feet. Power poles as well as a 20 foot wide paved alley run east to west adjacent to the rear property line. Curbs have been installed along the Highway III frontage. The buildings to the east and west are both constructed to side property lines. B. ADJACENT ZONING AND LAND USE: North: R-3/Multiple Family South: C-1/Commercial East: C-1/Commercial West: C-1/Commercial C. GENERAL PLAN LAND USE DESIGNATION: Core Area Commercial D. PREVIOUS PERTINENT CASES: 146 C - A-1 Surveying - 5250 sq.ft. office building was approved May 5, 1981, by planning commission. 184 C - A-1 Surveying - 3,380 sq.ft. office building was approved on June 14, 1983, by the architectural review board. 11. PROJECT DESCRIPTION: A. GENERAL: The building proposed is a one story 4000 square foot furniture store. The building is at the front of the lot with parking at the rear with access to the alley. -1- 0 1 Staff Report PP 84-16 and VAR 84-2 June 19, 1984 B. PARKING: Required 8 spaces Provided 8 spaces C. LANDSCAPING: Required in parking lot 15% or 664 sq.ft. Provided in parking lot 24% or 1063 sq.ft. D. ARCHITECTURE: The building will be somewhat Spanish with stucco and possibly a tile roof utilized. There will be further refinement of the building during the architectural review process. E. VARIANCE REQUEST: The municipal code in the C-1 zone requires a 5 foot building setback from the front property line. Because of the buildings on each side, both of which slightly encroach over the property line, the applicant is requesting a variance to allow an 8 inch setback rather than 5 foot setback. The applicant feels this is necessary to provide adequate exposure for his building. F. ALLEY WIDENING: There has been discussion regarding the widening of the alley at the rear of the property to increase traffic capacity to that of a street. To date, no definite plans have been made. Staff is, therefore, recommending that an irrevocable offer to dedicate and improve approximately 10 feet of alley be given to the city. Further, that any relocation of improvements for that dedication and widening be at the applicant's expense. III. ANALYSIS- A. REQUIRED FINDINGS AND JUSTIFICATION (AS SUBMITTED BY APPLICANT) FOR APPROVAL OF A VARIANCE: 1. What practical difficulties or unnecessary physical hardships inconsistent with the objectives of the zoning ordinance would result if the variance is not granted? To build according to building code requirements (5 ft. setback) would effect newly remodeled adjacent building as well as proposed building in both function and architectural appearance. 2. What exceptional or extraordinary circumstances or conditions apply to your property that do not apply generally to other properties in the same zone? Enforcement of 5 ft. front setback did not apply to adjacent remodeled structure. 3. To what extent would the strict or literal interpretation and enforcement of the specified regulation deprive you of priveleges enjoyed by the owners of other properties in the same vicinity and zone? It would deprive proposed building of equal exposure and commercial function. -2- Staff Report PP 84-16 and VAR 84-2 June 19, 1984 4. To what extent would the granting of this adjustment be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity? None. Staff feels these findings can be justified in this case. B. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and compatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Surrounding land to the north and south in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land, nor would they be negatively impacted by traffic or structures. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The project is designed in a manner that will not endanger the public peace, health, safety or general welfare due to compliance with existing code requirements. Staff feels these findings can be justified in this case. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for purposes of CEQA and therefore, no further documentation is deemed necessary. IV. CONCLUSION: Staff feels the request is acceptable as submitted. A condition for future dedication of the alley is required and the variance is justifiable. V. STAFF RECOMMENDATION: Staff recommends: A. Approval of the findings; B.
