WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect whatsoever. 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Turnaround in area where trash enclosure is located shall be revised to provide more turnaround area to satisfaction of city. 6. Site plan to be revised to comply with required setbacks due to additional dedication required on San Pablo Avenue by the public works department. 7. Six foot high wall on east side of property to be moved 5 feet east so that it is along property line. 8. In lieu of undergrounding existing utility distribution lines at rear of property as a part of construction, the applicant shall record an agreement guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the city including the property in question. 9. Prior to issuance of any permits evidence in writing shall be provided to the city that the developers have made provisions with the Desert Sands Unified School District to pay local school impact fees as established by the city council. Department of Public Works: 10. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to permit issuance. 11. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the director of public works. 12. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 13. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 14. City Fire Marshal: 23. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 24. Install Riverside County super fire hydrants located: a. So that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. b. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs shall be painted red 15 feet in either direction from each hydrant. d. Hydrants shall not be located closer than 25 feet to any building. 25. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 26. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-18 is in accordance with the requirements prescribed by the fire marshal." 27. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 28. APPLICANT: JAMES SATTLEY 74-050 San Marino Circle Palm Desert, CA 92260 I. BACKGROUND• A. DESCRIPTION OF SITE: The site contains slightly more than 24,000 square feet of area and is vacant. The site unit recently was used for a construction yard as a legal nonconforming use. There are no fences on either interior side of the property, and there are some existing overhead power lines on the property. The curbs have been installed on San Pablo Avenue recently. B. ADJACENT ZONING AND LAND USE: North: R-2, S.P./Single Family South: R-2/Vacant East: R-2/Single Family West: R-2 (7)/Garages C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 d.u./acre II. PROJECT DESCRIPTION: A. GENERAL: The 6 unit apartment would be constructed in an "L" shape along the west and north property lines. All units would be 2 bedroom units with 3 one story in height (14 feet) and 3 two stories in height (18' feet). The project complies with applicable setback and coverage requirements. B. PARKING: Vehicular access is to Santa Rosa Way for the 6 open spaces and 6 carports. The applicant will need to provide a better turnaround at the end of the aisle. C. ARCHITECTURE: The architectural style of the project is somewhat Spanish with exterior materials consisting of stucco walls with flat and mission tile roofing. D. RECREATION: The applicant is providing a pool, jacuzzi and small recreation room for the use of the tenants. E. ARCHITECTURAL COMMISSION: Staff Report PP 84-18 July 17, 1984 The applicant has not yet applied for architectural commission approval. If the precise plan is approved, the applicant should apply for architectural review. III. ANALYSIS• A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 1 categorical exemption and therefore no further review is deemed necessary. IV. The subject property is within the service area of the Palm Desert Water and Services District . 2 . Any additional fire hydrants or any other water system improvements required by the City Fire Marshal will be installed at the developer ' s expense . 3 . Water meters required for the new building and for land- scape irrigation will be installed at the developer ' s expense . 4 . Frontage fees will be imposed for the entire frontage along Santa Rosa Way . 5 . The developer must comply with all current Palm Desert Water and Services District ordinances . 6 . A concrete block wall appears to be shown on the east property line which is encroaching on an existing five- foot utility easement . A 4-inch steel water main lies within that easement . If a wall is to be built : 1) Care must be exercised when excavating for the wall footing so as not to damage the 4-inch steel water main. 2) All costs for damages and/or repair to the main due to construction of the wall shall be borne by the developer . The method of repair or replacement shall be approved by the District before repairs shall begin . 7 . Mr. Shatzman replied that the parcels would be connected by an easement and their concern would be for both parcels. The will attempt to do the best job possible to develop the property as a whole for everyone's best interest. Vice Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Wood agreed with Commissioner Richards' concern about splitting up the parcels. He asked if they could legally deny this request without findings. Vice Chairman Erwood explained that the findings for approval had to be supported by evidence on the part of the applicant. Commissioner Richards felt that without a proposal to look at they could not possibly determine if those findings are met or not. Vice Chairman Erwood summarized the feelings of the commission and stated that because of the vagueness of the proposal it makes it impossible to determine if those findings are correct. Mr. Shatzman requested that a condition be added to address that concern or a 30 day continuance be given. Mr. Diaz indicated that a continuance would be in order to allow the applicant to come forth with a concept plan, that plan would not be necessarily before commission for a public hearing but a resolution would state the parcel would be developed to be consistent with that concept plan. Mr. Sawa briefly reviewed the background for this project and indicated these were the last permitted units on the site. Staff Recommended approval. The site unit recently was used for a construction yard as a legal nonconforming use. There are no fences on either interior side of the property, and there are some existing overhead power lines on the property. The curbs have been installed on San Pablo Avenue recently. B. P P 84- 18 Dear Mr. Diaz : In response to your letter regarding the above referenced project , we would like to make the following comments : 1 . The subject property is within the service area of the Palm Desert Water and Services District . 2 . Any additional fire hydrants or any other water system improvements required by the City Fire Marshal will be installed at the developer ' s expense . 3 . Water meters required for the new building and for land- scape irrigation will be installed at the developer ' s expense . 4 . Frontage fees will be imposed for the entire frontage along Santa Rosa Way. 5 . The developer must comply with all current Palm Desert Water and Services District ordinances . 6 . A concrete block wall appears to be shown on the east property line which is encroaching on an existing five- foot utility easement . A 4-inch steel water main lies within that easement . If a wall is to be built : 1) Care must be exercised when excavating for the wall footing so as not to damage the 4-inch steel water main. 2) All costs for damages and/or repair to the main due to construction of the wall shall be borne by the developer . The method of repair or replacement shall be approved by the District before repairs shall begin. 7 . The owner of the property shall execute an agreement that provides .that if at any time in the future the water main requires repair; the owner shall pay for all costs related to the repair including removal and replacement of the wall and any improvements in the vicinity of the required repair .
