GPA 85-4 and C/Z 85-3 - BIRTCHER-DUNHAM, Applicant Request for approval of a general plan land use element change from medium density residential (5-7 du/acre) to core area commercial and a change of zone from PR-6 (planned residential , six dwelling units per acre) to C-1 (general commercial ) for approximately 10.3 acres and a negative declaration of environmental impact for land bounded by E1 Paseo, Shadow Mountain Drive, San Pablo Avenue, and Larkspur Lane. Mr. Diaz outlined the proposal . Mr. Sawa noted that some letters had been received in favor and opposition. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. CURT DUNHAM, spoke in behalf of the zone change and described the proposed amenities. Chairman Crites asked Mr. Dunham if he had made an effort to meet with the surrounding neighbors. Mr. Dunham indicated that a letter had been sent stating that the plans could be viewed in his office. MR. ANDREW FELA, 144 S. Grand Avenue, gave an overview of the colored plans. Mr. Diaz explained to the commission that the plans before them were for informational purposes only and not under consideration. Chairman Crites suggested a motion of continuance after taking public testimony. He also discussed staff's checklist nos. 16 and 20 regarding traffic circulation and the height ordinance. (2) Additional storm drain construction shall be contingent upon a drainage study by the private engineer. (3) Full public improvements, including traffic safety lighting, as required by ordinance and the Director of Public Works, shall be installed in accordance with city standards. (4) Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the city. (5) Landscaping maintenance on Santa Rosa shall be provided by the owners. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two (2) hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants located: a. install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. b. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. c. curbs shall be painted red 15 feet in either direction from each hydrant. d. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water sompany, with the following certification: "I certify that the design of the water system in PP 84-23 is in accordance with the requirements prescribed by the Fire Marshal." DESCRIPTION OF SITE: The site is a flat, vacant 13,376 square foot lot (83 feet by 152 feet) in the R-2 zone on the north side of Santa Rosa, 252 feet east of San Pasqual. B. ADJACENT ZONING AND LAND USE: North: R-1 10,000 S.P./Vacant South: R-2/Two Single Family Dwellings East: R-2/Apartments West: R-2/Single Family Dwelling C. GENERAL PLAN LAND USE DESIGNATION: Medium density residential, 5-7 d.u./acre. IL PROJECT DESCRIPTION: A. GENERAL: The project consists of 3 two bedroom, 885 square foot apartment units. The units will be single story in accordance with the ordinance. The site, with three (3) units, is tight; however, the R-2 zoning does entitle the owner to 3 units (i.e. one unit per 4,000 square foot lot). The site becomes tight for a variety of reasons, including: 1) Building height is limited to one story (18 feet) because the site backs onto R-1 property to the north; 2) Public works department is requiring the dedication of 5 feet for street widening; 3) The applicant feels that 2 bedroom, 885 square foot units are necessary to assure adequate return on his investment. Considering these factors, staff felt that the project as presented was not unacceptable and suggested to the applicant that he should consider filing the necessary variance application. B. PRECISE PLAN ANALYSIS: Site Plan/Parking: The site plan has been proposed to locate the three (3) units along the east side of the site with an attached three car garage located to the south of the units - 1 - PP 84-23 and VAR 84-3 Continued between the front setback and the units. Opposite the garages will be three (3) open parking spaces. To the north of the open parking spaces, opposite the entries to the units, will be the pool and spa area. The six on-site parking spaces (3 covered) comply with the code provisions for apartments. C. ARCHITECTURAL COMMISSION: The building elevations and landscape plans will be reviewed and must be approved by the Architectural Commission. Said approval will be requested if the present applications are approved. M. VARIANCE APPLICATION ANALYSIS: VARIANCES: Discussion: A variance is necessary in order to approve the precise plan as proposed. The building is proposed with a fifteen (15) foot rear setback rather than the minimum 20 feet as required by code. Considering the height of this end unit (12 feet) and the five feet of street widening required by public works, it was felt that a variance was warranted and would not negatively impact the adjacent property to the east (rear). (See required findings below.) Findings for Approval of Variances: 1. That strict or literal interpretation and enforcement of the specified regulation would result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the ordinance. Response: The strict interpretation would require that a 20 foot rear yard be provided. The applicant came to the city with a proposal which complied with the zoning ordinance in all respects. The variance became necessary when it was determined that the city would require dedication of five (5) feet across the front of the lot for street widening. The original site plan, although it conformed to code, was tight. The loss of the five feet to street widening had to be picked up elsewhere on the site. The units to be constructed are "factory units" and must remain single story. Requiring the development to maintain a 20 foot rear yard setback would effectively kill this project and require the applicant to begin at square one again, as a result of the required street widening. 2. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to other properties in the same zone. Response: The property in question is zoned R-2, however, it is adjacent to R-1 zoned property to the north. This limits all property development to single story, 18 feet maximum. This results in single story projects which are quite tight if they are to be developed to the maximum number of units permitted by code. All of the lots on the north side of Santa Rosa between San Pasqual and Portola are similarly limited. This is not the case for most R-2 zoned properties. 3. That strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. - 2 - PP 84-23 and VAR 84-3 Continued Response: The strict interpretation of the ordinance provision would result in the applicant being unable to develop the property to its highest and best use (i.e. 3 units), which the R-2 zoning entitles him. Most other R-2 zoned properties are not limited to single story development and therefore should be able to develop to limits the code provides. 4. That the granting of the variance or adjustment will not be detrimental to the public health, safety, or welfare, or be materially injurious to properties or improvements in the vicinity. Response: It is felt that the granting of the variance will not be detrimental to other properties or improvements in the vicinity. In the matter of the reduced rear yard, the structure is flat roofed and a maximum 12 feet high. In addition, a 6 foot masonry wall will be installed on the rear property line. The property to the north is presently vacant so the reduced rear yard will not impose on existing residents. It is felt that the findings necessary to grant the requested variances can be met. Findings for Approval of Precise Plan: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Response: The project has been designed to conform to the code requirement relating to single story development adjacent to R-1 zoned property. In so designing the project, a variance becomes necessary, but it is felt that the overall development will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Response: The surrounding land in the vicinity is zoned for similar types of uses as proposed. Owners will not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Response: The precise plan complies with all code requirements, except for the variance as requested and approved, and must receive architectural commission approval and will not be detrimental to the public peace, health, safety, or general welfare. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two (2) hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants located: a. install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. b. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. c. curbs shall be painted red 1S feet in either direction from each hydrant. d. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water sompany, with the following certification: "I certify that the design of the water system in PP 84-23 is in accordance with the requirements prescribed by the Fire Marshal."
