Continued Case No. TT 19503 - GEORGE FOX, Applicant Request for approval of a 58 lot Tentative Tract Map and Negative Declaration of Environmental Impact for 97 acres within the HPR,D zone located west of the Palm Valley Storm Channel, north of the Palm Desert Community Center. MR. ALAN PERRIER, attorney for the applicant, asked Chairman Crites to abstain from this case because of the location of his residence. Chairman Crites replied that he was not in an area where the project would have an economic impact. Mr. Phillips, city attorney, replied that he didn't see any conflict. Commissioners Downs and Wood concurred with Mr. Phillips. Commissioner Erwood asked if adequate notice was sent out. Mr. Diaz answered yes. Mr. Diaz reviewed the staff report, emphasizing that staff was very concerned that if the project were approved the ability to satisfactorily control development in the steeper portions of the site would be lost. Commissioner Wood asked for a clarification on the losing of control of Phase I and II if preliminary approval was granted. Mr. Diaz replied that if Phase I was given preliminary approval, Phase II would then be given preliminary approval and the commission would lose the option of moving the hillside units to flatter terrain. In approving 58 lots, the developer would have the right to develop 29 lots in Phase II (steep area). The city would be required to give him 29 lots somewhere in that area. To date, the applicant has not demonstrated that lots could be developed in that area in a manner consistent with the city's hillside regulations. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. ALAN PERRIER and MR. FOX explained to the commission the history of the case and explained where the proposed units would be placed on the hillside and showed the commission aerial photographs of the canyon. A TEN MINUTE RECESS WAS CALLED AT 10:00 P.M. The meeting was reconvened and Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the project. MR. DON STAGE, 1313 Sandpiper, and MR. ALEX TECHONMIER, Sandpiper, spoke in oppositon. Their concerns were regarding the destruction of the scenic hillside and the flood zone. Mr. Fox replied that concerns could be addressed with conditions. Mr. Fox indicated that he would like direction from the commission as to what would be acceptable. After further discussion, the commission continued this matter to the meeting of September 4, 1984, to allow the applicant's attorney and the city attorney time to prepare an agreement satisfactory to the applicant and staff that might permit development and still give the city the controls it needs. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, to continue this discussion to the September 4 planning commission meeting. Carried unanimously 4-0. D. Case No. PP 84-25 - FRANK R. GOODMAN AND ASSOCIATES, Applicants Request for approval of a Negative Declaration of Environmental Impact and a precise plan of design to allow construction of a 5000 square foot commercial building in the C-1, S.P. zone on the north side of Highway 111, 400 feet east of Cabrillo Avenue. -4- MINUTES PALM DESERT PLANNING COMMISSION AUGUST 7, 1984 Mr. Sawa reviewed the staff report and recommended approval. Chairman Crites opened to public hearing and asked for the applicant's presentation. MR. FRANK GOODMAN, applicant, concurred with the staff report as presented. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the case. There being none, the public hearing was closed. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, to approve the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Wood, to adopt Planning Commission Resolution No. 978, approving PP 84-25 and a Negative Declaration of Environmental Impact, subject to conditions. Carried unanimously 4-0. E. Case No. PP 84-26 - EUGENE E. DOMS, Applicant Request for approval of a Negative Declaration of Environmental Impact and a precise plan of design to allow construction of an industrial building with 6000 sq.ft. in the S.I., S.P. (Service Industrial with a Scenic Preservation Overlay) zone on .34 acres located on the south side of Mediterranean, just east of Boardwalk. Mr. Sawa reviewed the staff report and recommended approval. Chairman Crites asked for any questions. Commissioner Downs asked if this was the same contractor who built Ace Hardware. Mr. Sawa replied that he did not have that information. Chairman Crites opened the public hearing and asked for the applicant's presentation. MR. BILL O'KEEFE, representative, asked for clarification of condition #6, regarding the option of using a berm in place of a wall. Commissioner Downs asked if the walls of the building would be waffle-crete. Mr. O'Keefe answered that it would. Mr. Diaz explained that the applicant would need to apply to the Architectural Review Commission for approval of a berm. Chairman Crites asked if there were any additional questions; hearing none, the public hearing was closed. Action: Moved by Commissioner Wood, seconded by Downs, to approve the findings as presented by staff. Carried 4-0. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 7. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. S. Encroachment permits and Hold Harmless Agreement, if determined necessary by the department of public works, shall be obtained prior to issuance of a building permit. 9. In lieu of undergrounding existing utility distribution lines at rear of property as a part of construction, the applicant shall record an agreement guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by.the city including the property in question. Department of Public Works: 10. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 11. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 12. Landscaping maintenance on Palm Desert Drive North shall be provided by the owners. 13. City Fire Marshal: 16. Install a water system capable of delivering 3000 GPM fire flow from any fire I ydrant for a three (3) hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 17. Install Riverside County super fire hydrant: a. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. b. Exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. C. Curbs shall be painted red 15 feet in either direction from each hydrant. d. Hydrants shall not be located closer than 25 feet to any building. 18. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 19. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-25 is in accordance with the requirements prescribed by the fire marshal." 20. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 21. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. DESCRIPTION OF SITE: The property is located on the north side of the frontage road between Cabrillo Avenue and DeAnza Way. The site also has frontage on Alessandro Drive to the rear. The site is vacant except for several trees. Overhead utility lines run along the rear property line parallel to Alessandro Drive. B. ADJACENT ZONING AND LAND USE: North: R-3 (4)/Multiple family South: C-1, S.P./Commercial East: C-1, S.P./Vacant West: C-1, S.P./Commercial C. GENERAL PLAN LAND USE DESIGNATION: Core Area Commercial II. PROJECT DESCRIPTION: A. GENERAL: The proposed building would contain 5000 square feet of floor area and have the parking lot to the rear with vehicular access to Alessandro Drive. The building would be one story in height and contain a maximum five suites. The project is a double of the applicant's other project, 100 feet to the west and presently under construction. B. PARKING/CIRCULATION: Required parking is 17 spaces and 18 spaces are provided. Due to the width of the lot the parking layout is not ideal but does maximize the number of spaces. A screen wall is provided facing Alessandro Drive to screen the cars. A planter/trash island will be located in the middle of the parking lot. C. Staff would suggest that there be some variety to the front and rear elevations due to the close proximity of the applicant's other project. D. ARCHITECTURAL COMMISSION REVIEW: The architectural commission will review the preliminary plans after the project is approved by the planning commission. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other commercial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse on the environment and a Negative Declaration of Environmental Impact has been prepared. IV. STAFF RECOMMENDATION: Staff feels the proposed project is acceptable. Therefore, we recommend: A. Adoption of the findings. B.
