CASE NO. PP 84-29 and ADJ 84-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of August and 4th day of September, 1984, hold a duly noticed public hearing and continued public hearing to consider the request of CHARLES GARLAND for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project is a Class 3 categorical exemption for CEQA purposes. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. 4. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinances. 5. There are exceptional circumstances or conditions applicable to this property not applicable to other properties in to same zone. 6. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. 7. The granting of an adjustment will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein in addition to all municipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of approval unless an extension of time is granted; otherwise said approval shall become null and void and of no effect whatsoever. _ 4. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permits or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. The front setback shall be 10 feet, the rear 12 feet and entirely landscaped. Department of Public Works: 6. Drainage and signalization fund fees, 4s required by city ordinance, shall be paid prior to recordation of the final map. 7. Drainage facilities shall be provided, per Ordinance No. 218, and the Master Drainage Plan, to the specifications of the director of public works. 8. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 9. Landscaping maintenance on Portola Avenue shall be provided by the homeowners. 10. Existing utilities on Portola Avenue shall be undergrounded. 11. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 12. Mr. Diaz explained that the applicant was requesting a continuance. Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to the case. Chairman Crites closed the public testimony. Commissioner Downs asked how long the applicant wished to continue the case. Mr. Diaz replied 30 days. Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, to continue this case until the meeting of October 2, 1984. C. Continued Case No. TT 19503 - GEORGE FOX, Applicant Request for approval of a 58 lot Tentative Tract Map and Negative Declaration of Environmental Impact for 97 acres within the HPR,D zone located west of the Palm Valley Storm Channel, north of the Palm Desert Community Center. Mr. Diaz reviewed the action of the commission at its last meeting and explained the concerns of staff. Mr. Diaz noted an agreement from the city attorney had just been received. The agreement was not legally wrong, however, staff found planning problems with it (i.e. Page 2, Item 4). Mr. Diaz felt that at this time, he would need to have more time to review a staff recommendation or recommend denial of the map. Chairman Crites explained that commission and staff had not had an opportunity to consult with the city attorney. Chairman Crites opened the public testimony and asked the applicant to address the commission. Commissioner Downs asked if legal counsel for the city was present. Mr. Diaz replied no. MR. ALAN PERRIER, representative of Mr. Fox, addressed the commission indicated that he understood that the public hearing was closed. Chairman Crites explained that the meeting had been continued and was, therefore, still open. Mr. Diaz indicated that during study session, staff explained to the applicant that drainage plans were needed. Mr. Perrier replied that the plans requested were very expensive and that the applicant did not wish to occur this expense and then be met with a denial. Commissioner Downs suggested deleting the section on the 20 units. Commissioner Richards explained that the commission wants to be able to view the placement of the units on the hillside and that the commission was trying to come up with an acceptable agreement. MR. PERRIER asked for a two week continuance to allow him to consult with the applicant. Commissioner Downs asked if this would create any time limit problems. Mr. Perrier replied no. -2- City of Palm Desert Department of Environmental Services Staff Report TO: Planning Commission DATE: September 4, 1984 CASE NO: PP 84-29 REQUEST: Allow construction of a duplex with a front and rear setback adjustment for property in an R-2 zone located on the west side of Portola, 230 feet south of Shadow Mountain Drive, also described as APN 627-351-038. APPLICANT: CHARLES GARLAND 33-163 Cathedral Canyon Drive Cathedral City, CA 92234 I. BACKGROUND: A. ADJACENT ZONING AND LAND USE: North: R-2/Vacant - Approved Duplex (PP 26-83) South: R-2/Duplex East: Public/Church West: R-1/Single Family Residential B. GENERAL PLAN LAND USE DESIGNATION: Medium or low density residential (borderline). II. DISCUSSION: The project is similar to the duplex approved to the south. At that hearing, residents were opposed to the project due to the drainage patterns in the area and the patio overhang. This project is not affected by the "hidden" drain pipe since the pipe was on the other side of that site. The applicant has also agreed to eliminate the patio overhangs and sliding glass doors of this project. The setback adjustments are justified due to a street dedication of 14 feet and the irregular shape of the lot (dimensions reversed; 100 feet width, 86 feet depth). The front adjustment also allows side-in garages which are better in terms of aesthetics from the street elevation. The structure is 16 feet in height and single story with the rear portion sloping to the west so that the building's peak is located in the middle of the property. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. That the design of the use is compatible with adjacent uses and those in the vicinity. Justification: The design of the use is compatible with other residential uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for similar types of uses as proposed and owners would not be deprived the use of their land. CASE NOS. PP 84-29 and AJD 84-1 CONTINUED 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and has received architectural review approval and will not be detrimental to the public peace, health, safety, or general welfare. B. FINDINGS NEEDED FOR APPROVAL OF THE ADJUSTMENT: 1. The strict or literal interpretation and enforcement of the specified regulation would result in unnecessary physical hardship inconsistent with the objectives of the zoning ordinances. Justification: The strict application of the twenty and fifteen foot setbacks would result in a decrease of the usable amount of building space. 2. There are exceptional circumstances or conditions applicable to this property not applicable to other properties in the same zone. Justification: The development of this property requires a 14 foot dedication creating a nonconforming lot. 3. The strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same vicinity and zone. Justification: Other multifamily structures in the neighborhood were built with reduced setbacks due to being processed by the county prior to incorporation. 4. The granting of an adjustment will not be detrimental to the public health, safety, welfare, or be materially injurious to properties or improvements in the vicinity. Justification: The granting of the adjustment does not relieve the applicant from obtaining all other necessary permits and meeting all other development standards. C. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a Class 3 categorical exemption for purposes of CEQA and no further documentation is necessary.
