AND MRS. ROBERT PICKING. f WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of environmental services has determined that the project should be certified for a negative declaration of environmental impact. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which ark in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Property Owners Association Palm Desert Architectural Commission Coachella Valley Water District Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. Department of Public Works. 5. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to issuance of building permit. 6. Landscaping maintenance on El Paseo shall be provided by the property owners. 7. Complete grading plans and specifications shall be submitted as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 8. Installation of 6-foot PCC sidewalk on El Paseo for the complete frontage of property per City of Palm Desert Drawing No. 105. -2- MINUTES PALM DESERT PLANNING COMMISSION AUGUST 21, 1984 Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. Hearing none, the public hearing was closed. Action: Moved by Richards, seconded by Wood, to continue this case to the September 4 meeting. Carried unanimously 3-0. C. Case o. PP 84-30 MR. & MRS. ROBERT PICKING, Applicants Allow construction of a 4000 square foot single story commercial building on the north side of El Paseo, 180 feet west of Sage Lane. Mr. Sawa reviewed the staff report. Chairman Crites opened the public testimony and noted the applicant was not present. Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to this project. Hearing none, the public testimony was closed. Action: Moved by Commissioner Wood, seconded by Richards, to approve the findings as presented by staff. Carried unanimously 3-0. Moved by Wood, seconded by Richards, to adopt Planning Commission Resolution No. 982, approving PP 84-30, subject to conditions. Carried unanimously 3-0. VIll. MISCELLANEOUS ITEMS Mr. Diaz explained to the commission that the August 7 minutes would show a correction in the oral report to the effect that 20% of the units are affordable, not 25%. DISCUSSION: The commercial project proposed by the applicant will coordinate existing parking to rear of the site with existing parking and will be designed to provide through pedestrian access from El Paseo to the parking area. The project site is within the jurisdiction of the Palm Desert Property Owners Association area and has received their approval. III. ANALYSIS. A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and compatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Surrounding land to the north and south in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land, nor would they be negatively impacted by traffic or structures. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. - 1 - f PP 84-30 MR. & MRS. ROBERT PICKING August 7, 1984 Justification: The project is designed in a manner that will not endanger the public peace, health, safety, or general welfare due to compliance with existing code requirement. Staff feels these findings can be justified in this case. B. ENVIRONMENTAL REVIEW: The director of envionmental services has determined that the proposed project should be certified for a negative declaration for purposes of CEQA and, therefore, no further documentation is deemed necessary. Justification: The use is attractive and acceptable from a design aspect and compatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Surrounding land to the north and south in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land, nor would they be negatively impacted by traffic or structures. 3.
