Action: Moved by Commissioner Downs, seconded by Commissioner Wood, to adopt the findings as presented by staff. Carried 4-0. Case No. ZOA 84-2 - CITY OF PALM DESERT, Applicant Request for approval of an amendment of Section 25.86.050 of the zoning ordinance pertaining to appeals of planning commission decisions. Mr. Diaz explained that the amendment would make the appealing procedure in- line with recent judicial procedures. Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to this amendment. Hearing none, Chairman Crites closed the public testimony and asked for a motion. MISCELLANEOUS ITEMS Commissioner Downs indicated that he would like a bell to notify anyone outside when a recess is over. Also, he suggested that ash trays be placed in the lobby to prevent cigarettes being scattered over the grass and sidewalk. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within twelve months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null, void and of no effect whatsoever. 4. If lights are to be used, detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Provide 3.5 foot high decorative masonry wall, berming and landscaping or combination thereof, in front of parking lot areas and exposed to streets (except driveways). 7. All roof mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 8. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 9. That the applicant file a parcel map application to consolidate the two lots into one lot. 10. Applicant shall provide payment of Fringe-Toed Lizard Habitat fee of $682.50 (i.e. $750 per acre at .91 acres). Department of Public Works: 11. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 12. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 13. Landscaping maintenance on St. Charles and Boardwalk shall be provided by the property owner(s). 14. Size, number and location of driveways to Public Works specifications with only a maximum of three driveway approaches to be allowed to serve this property. City Fire Marshal: 16. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 17. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 18. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 19. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-42 is in accordance with the requirements prescribed by the Fire Marshal." 20. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 21. Fire lanes will be required. 22. All buildings 12,000 square feet will require an approved fire sprinkler system. 23. DESCRIPTION OF SITE: The property is located in the industrial park immediately south of Hovley Lane and east of Cook Street. The property is vacant. B. ADJACENT ZONING AND LAND USE: North: S.I., S.P./Vacant South: S.I./Vacant East: S.I., S.P./Industrial Building West: S.I., S.P./Vacanty� C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial. II. PROJECT DESCRIPTION: A. GENERAL: The two story office/industrial building would contain 16,000 square feet of floor area and be located along the west and north part. The north wing of the building will be four (4) two story office suites. The westerly wing will be primarily shop area and office area on the first floor and office area above. Total office area would be 8200 square feet and about 7800 square feet of industrial shop area. B. SITE DESIGN, PARKING, AND ACCESS: The building has been located toward the streets and access driveways are located toward the interior property lines. The driveway and parking is located behind the building with access to both Boardwalk and St. Charles Place. The setback area in front of the building is to be totally landscaped and should present a pleasing appearance. C. ARCHITECTURE: The 27 foot high buildings are conventional in style with stucco walls and tile roofs, with office/storefront entrances. PP 84-42 Continued D. ARCHITECTURAL REVIEW: Upon approval by the planning commission, the applicant will have to make any required changes prior to application to the architectural commission. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse on the environment and a Negative Declaration of Environmental Impact has been prepared. IV. RECOMMENDATION: Staff feels with minor modifications the proposed project would be acceptable and recommends: A. Adoption of the findings. B.
