Case Nos. PP 84-44 and PMW 84-16 - WILLIAM SPENCER, Applicant Request for approval of a precise plan of design, negative declaration of environmental impact, and parcel map waiver to consolidate the site into one lot to allow construction of an eight unit apartment.project (utilizing 25% density bonus allowed by state law) in the R-2 zone located on the north side of Santa Rosa Way, 200 feet west of San Pascual. Mr. Diaz reviewed the salient points of the staff report. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes.in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within twelve months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission Riverside County Department of Health City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. The four foot high slump block wall facing Cook Street shall be set back five feet further from the street to provide additional landscaping. 7. A minimum four foot high slump block wall shall be provided along north property line between existing chainlink fence and wall along Cook Street. 8. Prior to issuance of a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for the undeveloped area for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquisition of land for a lizard preserve in the Coachella Valley. 9. That the applicant shall pay fees into the fire protection fund as established by city ordinance for fire site apparatus and equipment acquisition. 10. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are on or adjacent to the property being developed shall be installed underground, if practicable, as a part of development from the nearest existing pole not on the property being developed. Department of Public Works: 11. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 12. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the Director of Public Works. -2- PLANNING COMMISSION RESOLUTION NO. 1011 13. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 14. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 15. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final. 16. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 17. Landscaping maintenance on Cook/Eclectic shall be provided by the property owner. 18. Existing utilities on Cook Street shall be undergrounded per each respective utility district's recommendation. 19. Traffic safety striping on Cook Street shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of publi works before placing pavement markings. 20. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 21. Dedication of 11 feet of right-of-way on Cook Street shall be done prior to issuance of any permits and approval of plans. 22. Installation of curb and gutter, matching paving and sidewalk on Cook Street. 23. Waiver of access to Cook Street except at approved locations shall be granted by separate instrument. 24. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to issuance of the building permit. 25. Installation of one-half landscaped median in Cook Street or cash payment for one- half the cost of landscaped median at the option of the director of public works. 26. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. City Fire Marshal: 27. Install a water system capable of delivering 3500 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 28. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. -3- PLANNING COMMISSION RESOLUTION NO. 1011 29. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 30. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-45 is in accordance with the requirements prescribed by the Fire Marshal." 31. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 32. Any building over 12,000 square feet will require a monitored fire sprinkler system. 33. Fire lanes will be required. 34. (service industrial district with a scenic preservation overlay) zone located on the west side of Cook Street, approximately 650 feet north of 42nd Street. APPLICANT: COACHELLA VALLEY TV 74-175 El Paseo . Palm Desert, CA 92269 ARCHITECT: MR. JOHN OUTCAULT, AIA 74-133 El Paseo, #11 Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE: The property is a rectangular 2.92 acre site with street frontage on Cook Street and Eclectic Street. The westerly two acres of the site has been developed with a 14,000 square foot one story metal building. The balance of the site is presently vacant. The site is relatively flat and slopes from north to south. B. ADJACENT ZONING AND LAND USE: North: S.I. S.P./Vacant South: S.I. S.P./Mini Warehouse East: S.I. S.P./Vacant West: S.I. S.P./Vacant C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial. D. PREVIOUS PERTINENT CASES: 124 C - COACHELLA VALLEY TV - Design review case for 14,000 square foot service and construction facility approved on March 19, 1980. Facility has been built. II. PROJECT DESCRIPTION: A. GENERAL: The proposal is to construct a two story building for the administrative, marketing and production services of Coachella Valley TV. These facilities are presently located on El Paseo near Highway 111. This building would supplement the service and construction facilities that presently exist on the westerly part of the site. B. SITE DESIGN, CIRCULATION AND PARKING: The new building would be placed near the Cook Street frontage with parking located around the structure. The parking lot would tie in with the PP 84-45 Continued existing lot which has access to Eclectic Street. A new vehicular access is proposed to Cook Street in approximately the middle of the site. The required parking for the entire site is 109 spaces. One hundred and fourty-six (146) spaces are being provided which exceeds the code requirements. Staff notices a temporary trailer located in the existing parking lot area. This will need to be removed with the proposed construction. C. ARCHITECTURE: The architectural style of the two story building would be contemporary and utilize exterior plaster, some tile, and glass. The building would be a maximum 27 feet tall and have a flat roof. This building is not particularly compatible with the first building, but because of their respective locations on different streets, they would appear to be on separate parcels. D. LANDSCAPING: Landscaping is provided throughout the parking lot with a landscaped area adjacent to Cook Street. A short screen wall is provided six feet behind the property line. Staff is recommending that the wall be moved five feet to the west in order to increase the visual amount of landscaping exposed to the street. A wall of at least four feet in height is recommended along the north property line, between the existing fence and street. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and has been designed to be compatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for a compatible type of use and owners would not be deprived the use of their land, nor would they be negatively impacted by traffic due to improvements to adjacent streets and ability to handle increased traffic. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The project is designed in a manner that would not endanger the public peace, health, safety, or general welfare due to compliance with code requirements and compatibility with surrounding properties. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse impact on the environment and a Negative Declaration of Environmental Impact has been prepared. -2- PP 84-45 Continued IV. RECOMMENDATION: Staff feels that with minor modifications the proposed project would be acceptable. Therefore, we recommend: A. Adoption of the findings; B. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within twelve months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission Riverside County Department of Health City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. The four foot high slump block wall facing Cook Street shall be set back five feet further from the street to provide additional landscaping. 7. A minimum four foot high slump block wall shall be provided along north property line between existing chainlink fence and wall along Cook Street. 8. Prior to issuance of a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for the undeveloped area for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquisition of land for a lizard preserve in the Coachella Valley. 9. That the applicant shall pay fees into the fire protection fund as established by city ordinance for fire site apparatus and equipment acquisition. 10. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are on or adjacent to the property being developed shall be installed underground, if practicable, as a part of development from the nearest existing pole not on the property being developed. Department of Public Works: 11. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 12. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the Director of Public Works. 13. Install a water system capable of delivering 3500 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Staff notices a temporary trailer located in the existing parking lot area. This will need to be removed with the proposed construction. C. ARCHITECTURE: The architectural style of the two story building would be contemporary and utilize exterior plaster, some tile, and glass. The building would be a maximum 27 feet tall and have a flat roof. This building is not particularly compatible with the first building, but because of their respective locations on different streets, they would appear to be on separate parcels. D. L`ANDSCAPING: Landscaping is provided throughout the parking lot with a landscaped area adjacent to Cook Street. A short screen wall is provided six feet behind the property line. Staff is recommending that the�wall-b -moved fexposed X-f� o the west in order to increase the visual amount of landscaping Po the street. A wall of at least four feet in height is recommended along the north property line, between the existing fence and street. JIL �ANALYSLS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 84-45 is .in accordance with the requirements prescribed by the Fire Marshal . " 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Any building over 12,000 square feet will require a monitered fire sprinkler system. 7. Fire lanes will be required. 8.
