4, 1984, with preliminary architectural approval on December 11 ,
1984.

The applicant is requesting approval of a one year time extension of his
project. The applicant indicates that the delay in beginning the project
has been due to his search for adequate financing and other constraints.
This would be the first extension for this project.

C. Case No. PP 84-12 - P.D. PARTNERS, Applicant
Request to change building locations and modify a
development agreement of an approved precise plan of
design for 104 apartment units at the corner of Hovley
Lane and Beacon Hill.
Mr. Joy reviewed the staff report and suggested recommending the development to
the city council.
Commissioner Richards felt that the change in the design and architecture was
better and that staff did a good job.
Mr. Diaz explained that the architect was very cooperative.
Chairman Crites opened the public testimony and asked the applicant to address
the commission.
MR. STEVE SULLIVAN, 73-730 Highway 111, architect, concurred with
staff's presentation.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to this project. Hearing no one, the public testimony was closed.
Action:
Moved by Commissioner Downs, seconded by Commissioner Erwood, to approve the
findings as presented by staff. Carried 4-0.
Moved by Commissioner Downs, seconded by Commissioner Erwood, to adopt
Planning Commission Resolution No. 1015, recommending approval of PP 84-12
Amendment #1, and DA-4 accompanying development agreement to the city
council. Carried 4-0.
Mr. Diaz noted that the previous plan was now void.

Request for approval of a negative declaration of
environmental impact and precise plan of design to allow
construction of a 10,800 square foot industrial building in
the S.I., S.P. zone on the west side of St. Charles Place,
approximately 145 feet north of Mediterranean.
Mr. Sawa reviewed this case and recommended approval of the project subject to
the conditions.
Chairman Crites opened the public testimony and asked the applicant to address
the commission.
MR. SVEN PUELICKE, 74-804 Vellie Way, offered no comment.
Commissioner Downs asked if the building would be waffle crete. Mr. Sawa replied
yes.
Chairman Crites asked if anyone present wished to speak in FAVOR or

E. Case No. PP 84-47 - LAWRENCE AND CAMILLE TODD, Applicant
Request for approval of a Negative Declaration of
Environmental Impact and a precise plan of design to allow
construction of a 5000 square foot commercial building
within the C-1 zone located at the north west corner of
DeAnza Way and the north side of Palm Desert Drive.
Mr. Drell reviewed the staff report and recommended approval, subject to the
conditions.
Chairman Crites opened the public testimony and asked the applicant to address
the commission.
MR. STAN POLOWSKY, architect, agreed with staff recommendation.
Chairman Crites asked if anyone present wished to speak in FAVOR or
OPPOSITION to this project. Hearing no one, the public testimony was closed.
Commissioner Downs noted that this is the fifth building built where there is two-
way traffic, and only one building has been built on the other one-way side.
Action:
Moved by Commissioner Erwood, seconded by Commissioner Downs, to approve,the
findings as presented by staff. Carried 4-0.
Moved by Commissioner Erwood, seconded by Commissioner Downs, to adopt
Planning Commission Resolution No. 1017, approving PP 84-47 and a negative
declaration of environmental impact, subject to conditions. Carried 4-0.

A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF A 10,800 SQUARE FOOT
INDUSTRIAL BUILDING ON THE WEST SIDE OF ST.
CHARLES PLACE, APPROXIMATELY 145 FEET NORTH
OF MEDITERRANEAN.

WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 4th day of December, 1984, hold a duly noticed public hearing to consider the request
of GORDON VAN DER BOOM for approval of a precise plan of design and negative
declaration of environmental impact to allow construction of a 10,800 square foot
industrial building in the S.I., S.P. (service industrial district with a scenic preservation
overlay) zone, located on the west side of St. Charles Place, approximately 145 feet north
of Mediterranean, more particularly described as:

WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have an adverse impact on the environment and a negative declaration
of environmental impact has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 84-46 is hereby granted for reasons subject to
the attached conditions.
3. That a Negative Declaration of Environmental Impact has been approved.

CONDITIONS OF APPROVAL
Case No. PP 84-46
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes in force, or which hereafter may be in
force.
3. Construction of said project shall commence within twelve months from the date
of final approval unless an extension of time is granted by the planning commission;
otherwise said approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
Riverside County Department of Health
City Fire Marshal
Evidence of said permit or clearance from the above agencies shall be presented to
the Department of Building and Safety at the time of issuance of a building permit
for the use contemplated herewith.
5. Detailed exterior parking lot lighting plan in compliance with applicable standards
to be submitted to the city prior to issuance of building permits, for approval;
lights to be down-shining box type to minimize glare.
6. All roof-mounted mechanical equipment shall be screened from all sides with
materials similar to building walls.
7. Westerly end of southerly parking area to be provided with turnaround area for
space no. 19.
8. Parking lot area to be screened from street by 42 inch high wall.
9. Walls along south and west property lines shall be six feet in height.
10. Prior to issuance of a building permit, the applicant shall provide mitigation
measures in the form of fees of $750 per acre for the undeveloped area for a
Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to
be placed in a fund to be used for acquisition of land for a lizard preserve in the
Coachella Valley.
11. That the applicant shall pay fees into the fire protection fund as established by city
ordinance for fire site apparatus and equipment acquisition.
Department of Public Works:
12. Storm drain construction shall be contingent upon a drainage study by the private
engineer that is approved by the department of public works.
13. Landscaping maintenance on St. Charles Place shall be provided by the property
owner.
14. Complete grading plans and . specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.

15. Size, number and location of driveways to public works specifications with only two
driveway approaches to be allowed to serve this property.
City Fire Marshal:
16. Install a water system capable of delivering 3000 GPM fire flow from any fire
hydrant for a 3 hour duration in addition to domestic supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement. Fire flow
requirements will depend on built-in fire protection provisions of buildings.
17. Install Riverside County super fire hydrants so that no point of any building is more
than 200 feet from a fire hydrant measured along approved vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each hydrant.
C. hydrants shall not be located closer than 25 feet to any building.
18. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the Fire Marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
19. The water system plan shall be signed by a registered civil engineer and approved
by the water company, with the following certification: "I certify that the design
of the water system in PP 84-46 is in accordance with the requirements prescribed
by the Fire Marshall'
20. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
21. Additional fire protection requirements may be necessary when the applicant
submits specific plans for consideration and approval.

I. BACKGROUND:
A. DESCRIPTION OF SITE:
The site is nearly retangular in shape and contains approximately 20,564
square feet of area. The site is vacant and while raised slightly above the
street, level and flat.
B. ADJACENT ZONING AND LAND USE:
North: S.I., S.P./VACANT
South: S.I., S.P./VACANT
East: S.I., S.P./VACANT
West: S.I., S.P./VACANT
C. GENERAL PLAN LAND USE DESIGNATION:
Service industrial.
II. PROJECT DESCRIPTION:
A. GENERAL:
The proposed project consists of a 10,800 square foot industrial building near
the rear portion of the site. Three possible suites are shown on the plan.
B. PARKING:
Parking is shown in front of the building and on the south side of the
building. Nineteen parking spaces are required and provided.
C. ARCHITECTURE:
The architectural style of the building is contemporary with exterior
materials consisting of plain waffle crete walls. Vertical fluting will be
used as bands around the building and adjacent to the main entry which will
have additional architectural treatment. The building will be 24 feet in
height.
D. LANDSCAPING:
Adequate landscaping will be provided throughout the site including in the
front setback area.

III. ANALYSIS:
A. FINDINGS FOR APPROVAL OF PRECISE PLAN:
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
Justification:
The design of the use is attractive and will be compatible with other
industrial uses existing in the vicinity.
2. The precise plan will not unreasonably interfere with the use of and
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
Justification:
The surrounding land in the vicnity is zoned for the same type of use
as proposed and owners would not be deprived the use of their land.
3. The precise plan will not endanger the public peace, health, safety, or
general welfare.
Justification:
The precise plan complies with all code requirements and will not be
detrimental to the public peace, health, safety or general welfare.
Staff feels the findings for approval can be justified for this precise plan.
C. ENVIRONMENTAL REVIEW:
The director of environmental services has determined that the proposed
project will not have an adverse environmental impact on the environment
and a negative declaration of environmental impact has been prepared.
IV. STAFF RECOMMENDATION:
Staff feels the proposed project is acceptable. Therefore; we recommend:

It has been determined that the Coachella Valley Fringe-Toed Lizard (UMA
INORNATA) exists on the property. This lizard has been designated as a
threatened species by the U.S. Fish and Wildlife Service and endangered by
California Department of Fish and Game.
Mitigation Measures:
Prior to issuance of a building permit, the applicant shall provide mitigation
measures in the form of fees of $750 per acre for the Fringe-Toed Lizard (UMA
INORNATA) habitat preserve. Any fees collected are to be placed in a fund to
be used for acquisition of land for a lizard preserve in the Coachella Valley.
17. PUBLIC SERVICE (FIRE PROTECTION):
A. The property is currently outside the five (5) minute fire department
response area as established by the fire department. This could provide
unsatisfactory fire and emergency medical response for employees.;
Mitigation Measures:
The applicant shall pay fees into the fire protection fund as established by city
ordinance for fire site,apparatus and equipment acquisition.
23. LIGHT AND GLARE:
There will probably be exterior parking lot lighting provided in the new parking
lot area.
MITIGATION MEASURES:
Detailed exterior parking lot lighting plan in compliance with applicable

and windows. Attention should be paid to installing quality
locking devices on all openings, especially the large warehouse
type doors. All openings should have crime preventive level
lighting (approximately 5fc minimum maintained) from two sources.
Since the northern exterior wall is publicly accessible, it
should be lighted with roof top vandal-proof light fixtures to
deter vandalism. If the building is to be used at night, parking
lot lighting is suggested.
The Sheriff's Department appreciated the opportunity to review
plans for new construction. As additional plans for P.P. 84-46

The following fire protection requirements are in accordance with the Uniform Fire
Code and Life Safety Code standards.
1 . Install a water system capable of delivering 3000 GPM fire flow from any fire
hydrant for a 3 hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement. Fire flow require-
ments will depend on built-in fire protection provisions of buildings.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 200 feet from a fire hydrant measured along approved vehicular travel ways .
