WITOLD MULLER, 167 Carrousel Lane, Huntington Beach, explained that he was asking for approval of the construction of three separate triplex residential units. Commissioner Downs asked the applicant if he was aware of the possibility of what the change to R-3 would allow him if the zone were changed in the specific plan. The applicant replied yes. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this project. Commissioner Downs inquired if there would be any problem if this project were approved and the specific plan were adopted; how would it effect potential developers adjacent to this project. Mr. Diaz replied that it would not present a problem. Commissioner Wood felt that the applicant should utilize the full potential of his land. Mr. Drell explained the relation between the one and two story zones in relation to this area. MR. MULLER stated that his was a quality project and that he was not worried about what would be developed adjacent to him. Chairman Crites closed the public testimony and asked for a motion. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, to approve the findings as presented by staff. Carried 4-1. (Commissioner Wood voting no.) Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1025, approving PP 84-48, PP 84-50, and PP 84-51, subject to conditions as modified. Case No. PP 84-52 - INI-MAX SELF STORAGE, Applicant Request for approval of a 150,000 square foot two story mini storage facility on 3.4 acres in a service industrial zone located at the southwest corner of Cook Street and Hovley Lane. Mr. Joy outlined the request and recommended approval. Mr. Cablay stated that the assessment district originally planned for that area would not take place. Commissioner Downs questioned the need for an eight foot meandering sidewalk. Mr. Cablay indicated that Marriott set a precedent by using the eight foot meandering sidewalk. Chairman Crites felt that the eight feet was too wide. Mr. Cablay replied that the sidewalk would be for pedestrians and bicycles. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. RICHARD SINGLETON, 28910 Rancho California Road, Temecula, concurred with the presentation of the staff report. Commissioner Wood asked the applicant if he was prepared to install the eight foot sidewalk. Mr. Singleton replied yes. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to this project. -5- MINUTES PALM DESERT PLANNING COMMISSION JANUARY 15, 1985 Mr. Cablay noted that the following conditions should be added: 1. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 2. Dedication of appropriate right-of-way on Cook Street/Hovley shall be done prior to issuance of any permits and approval of plans. 3. Installation of curb and gutter, matching paving and sidewalk on Cook Street. 4. Sidewalk to be eight feet and meandering. Mr. Joy stated that the a condition relating to the payment of the fringe-toed lizard fees would also be added. The applicant concurred with all added conditions. Chairman Crites closed the public testimony and asked for a motion. Action: Moved by Commissioner Erwood, seconded by Commissioner Richards, to approve the findings as presented by staff. Case No. CUP 84-13 - PROTECTION SERVICES, INC., Applicant Request for approval of a conditional use permit to allow a commercial parking lot for use by PROTECTION - SERVICES (74-214 Highway 111) located in an R-3 (4) (multiple family, one unit per 4000 square feet of area) zone located on the north side of Alessandro Drive, approximately 140 feet west of Santa Anita Avenue. Mr. Sawa reviewed the staff report and recommended approval. He indicated that the applicant would place a wood fence on the north side of the property because of the Palm Desert Water and Services District water line. Commissioner Wood suggested offsetting that portion by a block wall. Mr. Diaz stated that the commission could require a block wall and leave the option that staff had commission approval to put in a wood fence, if necessary. Chairman Crites suggested placing the wall in front of the property line and leaving the area between walls blank. Commissioner Erwood noted that this might create a maintenance problem. Commissioner Downs asked if this would be similar to the Ace Hardware Store. Mr. Sawa replied yes. Chairman Crites noted that the gate design would be reviewed by the architectural review commission. Mr. Sawa confirmed this. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. LEONARD HENDERSON stated that he would have to place a block retaining wall five feet high because of drainage and noted that the back portion of the parking lot could extend eight feet. He felt that there might be a problem with the end of the retaining wall. He informed the commission that the building of a safety exit could be landscaped. Mr. Diaz indicated that landscaping would not be necessary. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 23. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 24. Prior to issuance of a building permit, the developer shall furnish the original and 2 copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 25. SITE DESCRIPTION: The site area is 3.4 acres and has recently been graded as part of parcel map 17452, of which the site is part of. The site does slope from north to south in the area but not the the extent where it will make a difference in building plans. The site is also bounded by Eclectic Street which borders it on the west side. B. GENERAL PLAN LAND USE DESIGNATION: Service industrial. H. PROJECT DESCRIPTION: This is the first project submitted within parcel map 17452, which is an industrial subdivision on the west side of Cook Street, south of Hovley Lane. The map is not recorded as of yet, so any approvals the project receives will be subject to recordation of the map. A. SITE PLAN: Prior to application, staff worked with the applicant to adjust the site plan to increase the setbacks adjacent to Cook Street similar to the other mini- warehouse facility on Cook Street at 42nd Avenue. In both cases, then, the applicant proposes a 20 foot setback from property line or a 30 foot area from curbline that includes an eight foot wide meandering sidewalk along both Cook and Hovley. The building locations consist primarily of four rows of building running east to west across the site. The exception would be a row of buildings parallel and adjacent to Cook Street and Eclectic Street, which borders the site to the west. B. CIRCULATION/PARKING: The access to the site is from Cook Street. A condition of approval of PM 17452 is that the access to this site be provided from Eclectic Street. This was placed as a condition to eliminate access across the street from residentially zoned property on the north side of Hovley Lane. The access to Cook Street was restricted so that a large volume of traffic would only have access directly onto a major thoroughfare (Cook Street). It was PP 84-52 January 15, 1985 anticipated that the site would procude a large volume of traffic due to its size (3.4 acres). The justifications for amending this condition would be three factors: 1. The use (entirely warehouse) will not produce a high volume of traffic. 2. If the site had only access onto Eclectic then the traffic may impact the residential property to the north since Eclectic meets Hovley similar to the way the subject property is restricted from using Hovley. 3. The project is designed so that it has a better appearance on the end where the entrance is located (i.e. more landscaping, 70 foot setbacks to the two story structures). Since the project presently fronts onto Cook Street, which is designated a scenic highway. Staff would therefore feel that the lower building heights and increased landscaping would be better located along Cook Street. On site circulation is provided for by 25 foot wide aisles throughout the site. Currently the code section pertaining to parking for this type of use reads as follows: 2 for each 3 employees, but in no event less than 1 for each one thousand square feet of gross floor area for the first twenty thousand square feet; 1 for each two thousand square feet; 1 for each two thousand square feet of gross floor area for the second twenty thousand square feet; I for each four thousand square feet of gross floor area for areas in excess of the initial forty thousand square feet of floor area of the building. Using this formula the application would require 58 spaces. To address this concern the applicant has agreed to eliminate some square footage to comply with code requirements. This will be achieved by eliminating the front 40 foot second story from 'Building D" in relation to Cook Street and 25 feet of the northernmost section of 'Building G" to provide emergency access to this section of the site. C. ELEVATIONS: All buildings with the exception of 'Building H" are proposed at two stories. The materials proposed include a plaster finish, tile roof and metal doors. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in vicinity by the occupants thereof for lawful purposes. -2- PP 84-52 January 15, 1985 Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and has received preliminary architectural commission approval and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified in this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse environmental impact on the environment and a Negative Declaration of Environmental Impact has been prepared. Install a water system capable of delivering 3,000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply . The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. - Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal For review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in P.P. 84-52 is in accordance with the requirements prescribed by the Fire Marshal . " 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may-be necessary when the applicant submits specific plans for consideration and approval .
