Carried 4-0. Vil. PUBLIC HEARINGS Moved by Commissioner Wood, seconded by Commissioner Richards, to suspend the agenda to consider Public Hearing Item B first. B. Case Nos. CUP 84-8 and C/Z 85-1 - CITY OF PALM DESERT, Applicant Request for approval of a change of zone from R-1 to public and a conditional use permit to allow construction of a 15,000 square foot youth center located at the southwest corner of Rutledge Way and Magnesia Falls Drive. Mr. Diaz explained that staff was requesting a continuance to address some of the issues presented by the adjacent residents. He stated that the youth center and area residents could hold a separate meeting to help resolve any problems prior to the recommended continuance date of March 5, 1985. Mr. Diaz suggested that the . residents meet with staff representatives in a separate conference to discuss some of the issues. Chairman Crites inquired of counsel if the public hearing needed to be opened at that time. Mr. Patterson recommended a motion of continuance without opening the public hearing. Mr. Diaz indicated that he and Mr. Joy would accompany the residents to the, community services conference room. Action: Moved by Commissioner Wood, seconded by Commissioner Richards, to continue this item to the meeting of March 5, 1985, at 7:00 p.m. Carried 4-0. A FIVE MINUTE RECESS WAS CALLED AT 7:16 P.M. JOHNSON, Applicant Request— four approval of a negative declaration of environmental impact and a precise plan of design to allow construction of an industrial building (two story) with 7,930 square feet in the S.I., S.P. (service industrial with a scenic preservation overlay) zone on .56 acres located on . the north side of St. Charles Place. Mr. Smith reviewed the salient points of the staff report and recommended approval. Chairman Crites opened the public testimony and asked if the applicant wished to address the commission. Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the public testimony was closed. Action: Moved by Commissioner Richards, seconded by Commissioner Erwood, to approve the findings as presented by staff. Carried 4-0. . -2- l 1 PLANNING COMMISSION RESOLUTION NO. 1028 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION OF AN INDUSTRIAL BUILDING LOCATED ON THE NORTH SIDE OF ST. CHARLES PLACE. CASE NO. PP 85-1 WHEREAS, the Planning Commission of the City of Palm Desert,. California, did on the 5th day of February, 1985, hold a duly noticed public hearing to con- sider the request by M.B. JOHNSON for approval of a negative declaration of environmental impact and precise plan of design to allow construction of an in- dustrial building with 7,930 square feet in the S.I. S.P. (service industrial with a scenic preservation overlay) on .56 acres located on the north side of St. Charles Place, more particularly described as: Lot 24, Tract 13915 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-8911, in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testi- mony and arguments, of all interested persons desiring to be heard, said commi- ssion did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoy- ment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are .true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 85-1 is hereby granted for reasons subject to the attached conditions. Approval is subject to the following conditions: 1. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3 PP 85-1 CONTINUED 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building depart- ment and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-1 is in accor- dance with the requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. (service industrial with a scenic preservation over- lay) zone on .56 acres located on the north side of St. Charles Place. APPLICANT: M.B. JOHNSON 74-140 El Paseo, Suite #3 Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE: The property is located in the industrial park immediately south of Hovely Lane and east of Cook Street. The property is vacant. B. ADJACENT ZONING AND LAND USE: North: PR - across Hovely Lane South: S.I./Industrial Building East: S.I. S.P./vacant West: S.I. S.P./vacant C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial II. PROJECT DESCRIPTION: A. GENERAL: The two story office/industrial building would contain 7,930 square feet of floor area. The two story office portion of the building is located to the front of the site and has a total of 3,430 square feet. To the rear (north) of the site is the single story, 4,500 square foot warehouse section. The two story portion will be 21 feet in height while the single story warehouse section will be 14 feet. B. SITE DESIGN, PARKING AND ACCESS: The building extends along the west side of the lot and has parking along the east side of the site. Staff typically does not encourage the creation of dead end parking aisles. In this case it is felt that a dead end aisle is not unacceptable considering the short length of the aisle and low number of parking spaces. The front setback area is to be extensively landscaped and should provide a pleasing appearance. The rear yard (25 feet deep) is to be closed off and gated. This would contain the trash bin and probably other items which could be stored outside. Code Section 25.34.150 permits outside storage provided it does not exceed the height of the actual perimeter screening. The north side of the wall has been landscaped between the curb and the wall with grass and shrubs against the wall and a variety of trees including eucalyptus, planted 18 feet on center. These trees have been installed for a couple of years or more and some are getting quite large (20-30 feet). Should the commission wish, it could direct that the northerly 5 or 10 feet of the rear yard, that area immediately inside the 6 foot block wall, be landscaped and ask the Architectural Commission to require the installation of materials which would pro- vide significant vertical growth. -1- PP 85-1 ;Continued C. ARCHITECTURE: The architecture of the proposed building will have to be reviewed and approved by the architectural commission. The elevations pro- vided show an attractive office/warehouse facility. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety, or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse on the environment and a negative declaration of environmental impact has been prepared. IV. RECOMMENDATION: Staff feels the proposed project is acceptable and recommends: A. Adoption of the findings. B.
