He addressed the issues of concern from Indian Wells and stated that no evidence had .been presented to the planning commission or city council that would indicate that an environmental impact report was necessary. He stated that the proposed project would have less of an impact on air quality, noise, energy, and would provide employment, housing, and have the lowest rate of traffic. PP 85-3 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of April, 1985, hold a duly noticed public hearing to consider the request of the DESERT CITIES BAPTIST CHURCH for approval of a negative declaration of environmental impact and a precise plan of design to allow construction and operation of a church facility (and use of temporary modular structure for church services) on five gross acres in the PR-5 zone (planned residential, maximum five dwelling units per acre), located on the east side of Portola Avenue, approximately 700 feet north of Country Club Drive, more particularly described as: APN 620-200-007 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project would not have an adverse impact on the environment and a negative declaration has been prepared. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. If parking lot lighting is to be installed, detailed lighting plan in compliance with applicable lighting level standards shall be submitted to city for approval; lights to be downshining box type with recessed light source with light standards a maximum of 20 feet high. 6. An approved trash enclosure shall be provided to satisfaction of city. 7. Thirty foot by sixty foot (30' x 601) modular structure may be used for temporary church sanctuary and office. Adequate permanent parking and landscaping shall be provided; construction of permanent sanctuary shall begin within one year from operation of church with modular to be used maximum of three years. 8. Twenty foot (201) aisle shall be provided adjacent and parallel to Portola Avenue to connect driveways to satisfaction of city. 9. Combination 3 to 3.5 foot high wall and shrubs shall be provided adjacent to Portola Avenue to screen parking lot; with hedge provided along north and south boundaries of parking lot to satisfaction of city. 10. Six foot high block wall shall be provided with phase I along east property line for extent of proposed construction. 11. Future construction in undeveloped area shall be approved by the planning commission. 12. Prior to issuance of a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for the southern 2.5 acres for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquisition of land for a lizard preserve in the Coachella Valley. 13. Applicant shall pay fees per city ordinance to provide fire suppression facilities; fees to be paid upon issuance of building permit. -2- PLANNING COMMISSION RESOLUTION NO. 1034 Department of Public Works: 14. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 15. Landscaping maintenance on Portola Avenue shall be provided by the property owners. 16. Size, number, and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. 17. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to permit issuance. 18. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 19. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 20. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final. 21. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 22. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 23. Dedication of 50 feet of right-of-way on Portola Avenue shall be done prior to issuance of any permits and approval of plans. i 24. Installation of curb and gutter, matching paving and sidewalk on Portola Avenue. 25. A 30 foot wide easement for vehicular and utility purposes shall be granted adjacent to entire south property line, with an irrevocable offer to dedicate said 30 feet, to the satisfaction of the director of public works. City Fire Marshal: 26. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 27. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 28. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. -3- PLANNING COMMISSION RESOLUTION NO. 1034 29. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-3 is in accordance with the requirements prescribed by the fire marshal." 30. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 31. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. i -4- I MINUTES PALM DESERT PLANNING COMMISSION APRIL 2, 1985 A FIVE MINUTE RECESS WAS CALLED AT 10:40 P.M. Case No. P DESERT CITIES BAPTIST CHURCH, Applicant Request for approval of a negative declaration of environmental impact and precise plan of design to allow construction and operation of a church facility (and use of temporary modular structure for church services) on five gross acres in the PR-5 zone (planned residential, maximum five dwelling units per acre), located on the east side of Portola Avenue, approximately 700 feet north of Country Club Drive. Mr. Diaz outlined the salient points from the staff report and recommended approval. Commissioner Erwood asked for clarification regarding the construction of the six foot wall. Mr. Diaz indicated that the wall would be constructed with phase I along the easterly property line as a condition of approval. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. AL BRAUN, 51-730 Avenida Juarez in La Quinta, pastor of the church, indicated that he was present to answer any questions. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSTION to the proposal. Seeing no one, Chairman Crites closed the public testimony. Action: Moved by Commissioner Erwood, seconded by Commissioner Richards, to adopt the findings as presented by staff. Carried 3-0. Continued Case No. ZOA 84-3 - CITY OF PALM DESERT, Applicant Request for approval of an amendment to the Municipal Code, Chapter 25.68, concerning the regulation of signs. Mr. Diaz indicated that two concerns were expressed at the joint city council/planning commission tour: internally illuminated signs and height of ground mounted signs. Mr. Diaz felt that the present ordinance section regarding illuminated signs remain. Mr. Diaz outlined the regulations regarding ground mounted signs and indicated that he, felt no change should be made to the code at this time. Chairman Crites opened the public testimony and asked if anyone present wished to speak in FAVOR or OPPOSITION to this item. MR. JIM ENGLE, 46-120 Calhoun, Indio, of Imperial Sign Company spoke in favor of the present ordinance. MR. JERRY BOON, Golden State Sign Systems, also agreed with present regulations. MR. ROBERT GEORGE, indicated that the commission might wish to change the code to allow for special circumstances. Mr. Diaz indicated that Mr. George was referring to additional signage for the Town Center along Highway 111. Mr. George concurred. The phased complex would consist of a sanctuary (phase I) with seating for approximately 150 persons, an office wing to the north (phase II) and a sunday school wing to the south accommodating four classrooms (phase III). The applicants are also asking for approval of a 30 foot by 60 foot modular to facilitate the congregation for Sunday services while the sanctuary is being constructed. Upon completion of the sanctuary the applicant wishes to use the modular for offices and class room space until phases II and III are completed. Attached is a letter from the applicant discussing the proposal. B. SITE DESIGN, CIRCULATION, PARKING, AND ACCESS: The church would be located on the southern half of the property near the back of the lot. Parking would be located in front of the building with access through two driveways to Portola Avenue. The plan presently shows a "C" shaped circulation pattern. The parking standards require circulation to be kept on-site. Therefore, a 20 foot wide aisle will need to be provided adjacent and parallel to Portola Avenue, connecting the driveways. PP 85-3 Continued Based on seating for 150 persons, 50 parking spaces are required, and 54 spaces are shown which complies with the requirements. Presently, the properties to the east are made up of five acre parcels, the majority of which are land locked. In order to provide future public access to the lots to the east, the city is recommending that a 30 foot wide easement for access and utilities with a irrevocable offer to dedication be granted by the applicant adjacent to the south property line. This would not impact the plan as designed since they have provided a 58 foot setback along that side. The temporary 30 foot by 60 foot modular which would be used for church services is proposed to be located on the south side of the parking lot 55 feet back from Portola Avenue. C. ARCHITECTURE: The architectural style of the one story structure would be spanish with exterior materials consisting of stucco walls, some brick veneer and fiberglass tile roofing. The height of the highest point of the roof would be 21.5 feet. D. LANDSCAPING: The plan indicates a large rectangular landscaped area in the parking lot area in front of the sanctuary. Additional landscaping would be provided on each side of the sanctuary. No perimeter walls are indicated at this time on the plan. Staff would recommend a six foot high perimeter wall be constructed to the east of the church complex. Along the north and south boundaries of the area of construction six foot high walls need not be constructed. However, short walls or hedge landscaping will need to be provided to screen the parking lot area. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the project is acceptable although architectural commission approval is needed. The project would meet applicable code requirements for this type of facility. 2. The precise plan will not unreasonably interfere with the use of and enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Adjacent property owners would not unreasonably interfere with the use or enjoyment of their property. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The project is designed in a manner that will not endanger the public peace, health, safety, or general welfare due to compliance with code requirements and compatibility with surrounding properties. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared. This lizard has been designated as a threatened species by the U.S. Fish and Wildlife Service and endangered by California Department of Fish and Game. Mitigation Measures: Prior to issuance of a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve.
