Commissioner Downs indicated that he was in favor of the time extension. Chairman Crites indicated that time extensions had been turned down for exactly the same reasons in the past and felt that a master plan change did not warrant granting time extensions. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, to approve the one year time extension by minute motion. Vote: 2-2-1 (Chairman Crites and Commissioner Erwood voting no, Commissioner Richards abstaining.) After noting that this was not a passing vote, Commissioner Richards changed his vote in favor. Carried 3-2 (Chairman Crites and Commissioner Erwood voting against.) B. Case No. TT 19074-1 - GFB & ASSOCIATES, Applicant Request for approval of a one year time extension of a tentative tract on behalf of San Pablo Properties. Action: Moved by Commissioner Downs, seconded by Commissioner wood, to approve the one year time extension by minute motion. Carried 5-0. VIL PUBLIC HEARINGS A. Continued Case N�6 - NICK JORGENSEN, Applicant Request for approval of a precise plan of design to allow construction of three residential apartment units on an 8925 square foot lot on the south side of Driftwood Street 340 feet west of Deep Canyon. Mr. Smith outlined the salient points of the staff report and indicated that the project was a class 3 exemption and that the findings could be met. He noted that the plans would undergo considerable architectural review and recommended approval. Commission and staff discussed potential parking and traffic hazards as well as clarification on the CEQA section of the staff report. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. NICK JORGENSEN, applicant, indicated that he would do a good job and that the project would be beneficial to the city and that he could see no problems with parking and that no one would be sorry if the project was approved. Chairman Crites asked if anyone present wished to speak in FAVOR of OPPOSITION to the project. Hearing no one, the public testimony was closed. The development of the property shall conform substantially with exhibits (Case No. PP 84-49) on file with the department of environmental services, as modified by the following conditions. 2. Construction of a portion of said project shall commence within 12 months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null, void and of no effect whatsoever. 3. The computation - shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire Marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-6 is in accordance with the requirements prescribed by the fire Marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. Install one "2AIGBC" fire extinguisher in courtyard area. Mr. Smith outlined the salient points from the staff report. He explained that after the writing of the report the applicant agreed to comply with the recommendations of staff and would like a continuance to adjust his plan. Chairman Crites opened the public testimony. MR. NICK JORGENSEN, indicated that he had been a long time resident of Palm Desert and that he wanted to comply with all standards of the city. He noted that he would also like to develop additional lots in the future. He explained that his nephew would be doing most of the work on the case. Chairman Crites asked Mr. Jorgensen if a one month extension would provide adequate time to revise his plans. Mr. Jorgensen concurred. MR. JOHN JORGENSEN, 27-520 Avenida Terrazo in Cathedral City, explained that they were willing to comply with code. He stated that he would like to begin as soon as possible. Chairman Crites indicated that a two week continuance could be granted to May 21, 1985. Mr. Smith noted that revised plans would have to be turned in by next Monday. MR. JOHN JORGENSEN indicated that he would like to reduce the side setback from between six to ten feet. Mr. Smith noted that the applicant would have to apply for a variance. APPLICANT: NICK JORGENSEN 48-596 Oakwood Way Palm Desert, CA 92260 I. BACKGROUND: May 7, 1985 commission reviewed the plans for the proposed three apartment units. Staff delineated the areas of non-compliance with city code as follows: 1. West side yard deficiency 2. Site coverage exceeded 50% limit 3. Minimum garage dimension was substandgr 4. Group usable open space of 300 square feet per unit was deficient Revised plans have been received which address each of the above concerns. The following staff report reflects the changes contained in the revised plans. A. DESCRIPTION OF SITE: The property is located on the south side of Driftwood Street and 340 feet west of Deep Canyon. The property is vacant. B. ADJACENT ZONING AND LAND USE: North: R-3/multi-family South: R-1/SFD East: R-3/multi-family 4 units West: R-3/vacant C. GENERAL PLAN LAND USE DESIGNATION: Residential High Density 7-18 du/acre D. ENVIRONMENTAL REVIEW: Construction of three (3) apartment units is a class 3 categorical exemption for the purpose of CEQA. No further documentation is necessary. II. PROJECT DESCRIPTION: A. GENERAL The project consists of three (3) two bedroom apartment units in a single story (17 foot high building). The three units would have 905, 1021 and 1140 square feet of floor area respectively. The project is to include 6 covered parking spaces. The R-3 (3) zoning permits one unit for every 3,000 square feet of lot area. This 8925 square foot lot is entitled to a maximum of 3 units in that the third unit is within 90% of the required amount pursuant to section 25.56.160 "c". B. CIRCULATION/PARKING: The six garage spaces are located directly off of Driftwood with a 15 foot setback from the property line. The development of the site in this fashion with 6 parking spaces backing onto Driftwood Street is undesirable however, given the relative narrow width of the lot, 85 feet, it may not be possible to redesign the site and still result in 3 units. PP 85-6 Continued C. RECREATION FACILITIES: None III. ANALYSIS: A. CONCERNS: The property is immediately adjacent to R-1 zoned property to the south. This results in the development being limited to single story as per code. The size of the lot (8925 square feet) is close to the absolute minimum which would permit 3 units. When the code was established it is unlikely that the intent was to permit 3 units on a minimum sized lot where development is limited to single story. The other factor which adds to the problems on the site is the relatively large unit sizes (ie: 2 bedroom units having 905, 1021 and 1140 square feet respectively). B. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Response: The project as designed conforms to all the code requirements relating to R-3 developments. If the precise plan is approved then the applicant must obtain architectural commission approval of the plans which should assure a quality development. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Response: The surrounding land in the vicinity is zoned for similar types of uses as proposed, except for the R-1 zoned property to the south. The proposal is for three apartment units from which the city will not receive any park fees or dedication. This could impact city recreational facilities. The plan provides adequate .area for quality planting and recreational features. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Response: The precise plan complies with all code requirements. Subsequently the applicant will require architectural commission approval. With the subsequent architectural commission approval the project should not be detrimental to the public peace, health, safety or general welfare. IV. STAFF RECOMMENDATION: Staff feels the project should not be incompatible with adjacent uses. Therefore, staff recommends: 1. Approval of the findings 2. DESCRIPTION OF SITE: The property is located on the south side of Driftwood Street and 340 feet west of Deep Canyon. The property is vacant. B. ADJACENT ZONING AND LAND USE: North: R-3/multi-family South: R-1/SFD East: R-3/multi-family 4 units West: R-3/vacant C. GENERAL PLAN LAND USE DESIGNATION Residential High Density 7-18 du/acre D. ENVIRONMENTAL REVIEW Construction of three (3) apartment units is a class 3 categorical exemption for the purpose of C.E.Q.A. No further documentation is necessary. II. PROJECT DESCRIPTION: A. GENERAL The project consists of three (3) two bedroom apartment units in a single story (17 foot high building). The three units would have 917, 1125 and 1200 square feet of floor area respectively. The project is to include 6 covered parking spaces. The R-3 (3) zoning permits one unit for every 3,000 square feet of lot area. This 8925 square foot lot is entitled to a maximum of 3 units in that the third unit is within 90% of the required amount pursuant to section 25.56.160 "c". B. CIRCULATION/PARKING: The six garage spaces are located directly off of Driftwood with a 15 foot setback from the property line. The development of the site in this fashion with 6 parking spaces backing onto Driftwood Street is undesirable however, given the relative narrow width of the lot, 85 feet, it may not be possible to redesign the site and still result in 3 units. C. RECREATION FACILITIES: None III. ANALYSIS: A. CONCERNS The property is immediately adjacent to R-1 zoned property to the south. This results in the development being limited to single story as per code. The size of the lot (8925 square feet) is close to the absolute minimum which would permit 3 units. When the code was established it is unlikely that the intent was to permit 3 units on a minimum sized lot where development is limited to single story. The other factor which adds to the problems on the site is the relatively large unit sizes (ie: 2 bedroom units having 917, 1125 and 1200 square feet respectively). B. PROBLEMS The site plan as submitted has several deficencies as follows: 1. West side yard must be increased from 6 feet to 10 feet minimum. 2. Site coverage must be reduced to a maximum of 50% (presently 51%). 3. Must increase garage dimensions to minimum 20' x 20' clear inside measurement. 4. Group usable open space of 300 square feet per unit must be provided in a usable 900 square foot area in addition to the individual unit patios. C. FINDINGS FOR APPROVAL OF PRECISE PLAN 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Response: The project as designed does not conform to all the code requirements relating to R-3 developments. In addition the general quality of this proposed development leaves much to be desired. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Response: The surrounding land in the vicinity is zoned for similar types of uses as proposed, except for the R-1 zoned property to the south. The proposal is for three apartment units from which the city will not receive any park fees or dedication. The plan as submitted provides no on site recreational amenities. This could impact city recreational facilites. It has been planning commission's position in apartment developments that at least minimal recreational facilities on site be provided. This was the case even in low income housing developments. 3. The precise plan will not endanger the public peace, health; safety or general welfare. Response: The precise plan does not comply with all code requirements. With'.appro-' priate amendments the plan could be brought into conformity. Subsequ- ently the applicant will require architectural commission approval. With the appropriate amendments to the plan and the subsequent architectural commission approval the project should not be detrimental to the public peace, health, safety or general welfare. The plan as submitted does not comply with all code requirements and in the opinion of staff represents an inferior development proposal. In discussion with the applicant prior to and at time of submittal staff was repeatedly told that this was the plan which the applicant wished to process. Staff can not recommend that planning commission adopt the findings because the findings necessary to grant approval can not be made. IV. RECOMMENDATION: If the applicant indicates a willingness to redesign the development, commission could decide to continue the matter to June 4, 1985 to allow revised drawings to be submitted and reviewed.
