Commissioner Erwood indicated that he had no problems with the site plan. Chairman Crites spoke regarding access at Cook Street and visibility problems, and asked the applicant if he was requesting a continuance. Mr. Strozier clarified that the commission wanted to see an entire project with a tentative map filed and asked if he could get back within two weeks. Mr. Diaz replied that readvertisement would be necessary and that if the applicant submitted a map to staff within one week, he could come back in 30 days. Commissioner Downs noted that this would not need to go back to city council unless it was called up and that Councilmember Wilson had the swing vote when approving, which he did because of the mix. Commissioner Downs indicated that the was not what the city council approved. Mr. Strozier requested that he be given four weeks to resubmit. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the project. No one came forward. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, continuing Case No. TT 20817 four weeks (June 18). Carried 5-0. C. Case Nos. PP 85-10 and PP 85-11>BERNIE SOLOMON, Applicant Request for approval of a negative declaration of environmental impact and a precise plan of design to allow construction of two industrial buildings (total 24,815 square feet) in the S.I., S.P., service industrial with a scenic preservation overlay zone on 1.1 acres located on the west side of Corporate Way, 261 feet south of Hovley lane. Mr. Smith outlined the salient points of the staff report and recommended approval. Commission and staff discussed parking design and ingress and egress problems. Commissioner Richards felt that the mutual access agreement did not need to be required and that the project did not need to be tied together with driveways. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. BERNIE SOLOMON, 73-185 Irontree Drive, stated that he would not agree to any conditions with neighbors to the south. He indicated that the project had a good, functional design and that he was not interested in creating a frontage road. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the project. There being none, the public testimony was closed. Chairman Crites indicated concern regarding the zero lot line next to open space, as well as open space next to industrial. Commissioner Richards indicated that public works condition no. 11 relating to mutual access agreements should be deleted. Action: Moved by Commissioner Richards, seconded by Commissioner Wood, adopting the findings as presented by staff. Mr. Bernie Solomon spoke as a resident regarding Deep Canyon Grove and the action of the commission at that time. The commission was not prepared to discuss the project at that time. 2. Mr. Sandy Baum, thanked the commission for the approval of his requested variance at the last meeting in his absence. 3. Mr. Jim Swartz, explained that he was planning to reconstruct a car wash on Highway Ill and San Marcus if the commission would permit the structure to be rebuilt. The commission indicated that they would be in favor of improvement at that site. 4. Ms. Pam Smallwood, indicated that she came to the meeting late and asked what action was taken regarding agenda item B. Chairman Crites explained that it was continued. X. COMMENTS Chairman Crites expressed displeasure on behalf of the commission at the lack of legal counsel in attendance. XI. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the I restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within twelve months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission Riverside County Department of Health City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at 'the time of issuance of a building permit for the use contemplated herewith. 5. If lights are to be used, detailed exterior 'parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down-shining box type to minimize glare. 6. Provide 3.5 foot high decorative masonry wall, berming and landscaping or combination thereof, in front of parking lot areas and exposed to streets (except driveways). 7. All roof mounted mechanical equipment shall be screened from all sides with material similar to building walls. 8. Trash provisions shall be approved by applicable trash company and city prior to issuance of building permit. 9. Payment of Fringe-Toed Lizard Preserve fee of $750 X 1.1 acres = $825.00. 10. That sidewalks as specified by the public works department be installed across the frontage of these two lots as per council policy. 11. That prior to issuance of any building permit for this project all streets provided in PM 17452 be installed and in place to the satisfaction of the department of public works and that PM 17452 be formally recorded prior to issuance of any building permit. 12. That following the recordation of parcel map the applicant file a subsequent parcel map to consolidate the two lots (lots 26 & 27) into one lot prior to issuance of building permit. Department of Public Works: 1. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 2. Landscaping maintenance on St. Charles Place shall be provided by the property owner. 3. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 4. Size, ,nu nber and location of driveways to public works specifications with only one driveway approach to be allowed to serve this property. 5. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. Fire Marshal Conditions: 1. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply., The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-10 & 85-11 is in accordance with the requirements prescribed by the fire marshal'. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. All buildings over 5000 square feet will require an NFPA 13 fire sprinkler system. APPLICANT: BERNIE SOLOMON 74-700 Highway III Palm Desert, CA 92260 I. BACKGROUND: A. DESCRIPTION OF SITE: The property is located in the industrial park immediately south of Hovley Lane and west of Cook Street. The property is vacant. B. ADJACENT ZONING AND LAND USE: North: S.I./vacant South: S.I./vacant East: S.I. S.P./vacant West: O.S./vacant C. GENERAL PLAN LAND USE DESIGNATION: Service Industrial II. PROJECT DESCRIPTION: A. GENERAL: The applicant will acquire title to two lots (26 & 27) in the proposed industrial park. The streets are nearly complete. When the necessary improvements are installed the parcel map can then be recorded. Once the lots have been formally created the applicant will then file another parcel map to consolidate the two, lots into one. The application indicated that an additional application to create 8 industrial condominiums will follow. The office/warehouse buildings will both be 24 feet in height. The northerly building will be one story in height and have a total of 10,833 square feet. The southerly building will be 13, 982 square feet of which 3,424 square feet is located in mezanine area of two suites. B. SITE DESIGN, PARKING AND ACCESS: The northerly building is tucked into the northwest corner of the lot with zero setback from the north (side yard) and west (rear;yard). Parking is located in front of the building and in the central area between the proposed buildings. Two access points from CorporateWay are proposed and loop around the central parking area. The southerly building is tucked into the southwest corner of the property is zero setback from the side (south) and rear (west) property line. Parking is located in front of the building and in the central area between this building and the northerly one. The parking as designed and layed out is acceptable and the number of on-site spaces complies with code. The proposed zero setbacks on the side and rear are permitted by code when the site is not adjacent to residential. These lots are adjacent to property zoned open space (O.S.). PP 85-10 & 11 Continued C. ARCHITECTURE: The architecture of the proposed building will have to be reviewed and approved by the architectural commission. The elevations provided show an attractive office/warehouse facility. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses exisitng in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof forllawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse on the environment and a negative declaration of environmental impact has been prepared. Mitigation Measures Prior to issuance of building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for a Fringe-Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquistion of land for a lizard preserve in the Coachella Valley. 16. TRANSPORTATION/CIRCULATION This type of development typically generates 5.5 - 7.0 trips per day per 1000 gross square feet. The proposed development could generate up to 175 trips per day. This number of trips can be handled once the street system, required as a condition of the parcel map approval, is in place. In order to guarantee that the streets are installed, a condition will be imposed to require that prior to issu- ance of any building permit the streets must be improved to city standard and the map recorded. Mitigation Measures Imposition of the condition stating that no building permit will be issued until all streets are in place to the satisfaction of public works department and the recordation of the map should adequately address this environmental impact. 17. PUBLIC SERVICE (FIRE PROTECTION) a. The property is currently outside the five (5) minute fire department response area as established by the fire department. This could provide unsatisfactory fire and emergency medical response for residents.
