CASE NO. PP 85-15 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of August, 1985, hold a duly noticed public hearing to consider the request of AL JOHNSON for approval of a precise plan of design to allow construction of a three unit apartment complex in R-3 20,000 (3) S.P. zone located on the east side of Ocotillo Drive, approximately 125 feet north of Verba Santa Drive, more particularly described as: LOT 1, BLOCK F, PALM DESERT UNIT NO. 3 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project is a class 1 categorical exemption and no further documentation is necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said precise plan of design: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Construction of the total development shall be done in one phase. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith: 6. In lieu of undergrounding existing distribution lines as a part of construction, an agreement approved by the city attorney shall be recorded guaranteeing that the property shall voluntarily be a part of any undergrounding district formed. This shall not apply to service lines that lead directly to the building. 7. Six foot high block wall along the rear property, and six foot high block wall (or height mutually acceptable between applicant and Mr. Bibby) along the north side. 8. Installation of sidewalk shall be required, subject to city council clarification. Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. -3- PLANNING COMMISSION RESOLUTION NO. 10%q f - 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master 1 Drainage Plan, to the specifications of the Director of Public Works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 4. Landscaping maintenance on Ocotillo shall be provided by the property owner. 5. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 6. Size, number and location of driveways to public works specifications with only three driveway approaches to be allowed to serve this property. 7. The total widths of all three (3) driveways shall not exceed 50% of property frontage of Ocotillo Drive. City Fire Marshal: The following fire protection requirements are in accordance with the Uniform Fire Code and Life Safety Code standards. 1. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-15 is in accordance with the requirements prescribed by the fire marshal." -4- i PLANNING COMMISSION RESOLUTION NO. Per plans submitted, conditions of approval would include dead bolt locks on exterior doors, upgraded security on sliding aluminum frame windows inhibitating vertical and horizontal movement as desired by tenant, heavy duty hasps on garage doors, and .security lighting (ex: Malibu) built into landscape design. Chairman Crites onened the public testimony and asked the applicant to address the commission. MR. HAROL.D HOIISLEY, 74-091 Larrea - project engineer, concurred with the additional condition with the stipulation that, if determined not necessary by city counril that the condition be deleted. Commission conriirred. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed parcel map. There being no one, the public testimony was closed. Chairman Crites opened the public testimony and asked the applicant to address the commission. 9 MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 MR. BERNARD INf F _L _t �, architect, 73 960 El Paseo, explained that three owners wished to construct this three unit apartment complex for their residences. Mr. Leung requested deletion of the 24 foot bark uP area behind garages with landscaping. Commission concurred with the deletion of condition #7. Commissioner Downs asked Mr. Patterson about a possible conflict of interest . Mr. Patterson indicated that he felt there was no conflict. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed project. MR. HOWARD BIHBy, an adjacent resident, requested that the wall height be lowered next to his residence. Mr. Leung indicated that the site would have to be looked at to determine the amount the wall could be reduced on that one side only. Commission concurred that the wall height be mutually acceptable between Mr. Leung and Mr. Bibby. Chairman Crites closed the oublic testimony and requested commission action. PREVIOUS CASE: VAR 08-80 - Bob and Gordana Sipovac - A variance for a two story triplex was denied by the planning commission on November 5, 1980. B. DESCRIPTION OF SITE: The 16,400 square foot site is irregular in shape and slopes downward from south to north. Presently the site is vacant with power poles running along the rear property line. A new fence has been recently constructed along the easterly portion of the rear property line abutting the R-1 residences. A curb has been put in along Ocotillo Drive. C. ADJACENT ZONING AND LAND USE: North: R-3 20,000 (3) S.P./Apartment South: R-1 12,000/Single Family East: R-1 12,000/Single Family West: R-3 18,000 (3) S.P./Vacant D. GENERAL PLAN LAND USE DESIGNATION: Low density residential 3-5 dwelling units per acre. STAFF REPORT CONTINUED AUGUST 6, 1985 H. PROJECT DESCRIPTION: A. GENERAL: The project would be a one story triplex with attached garages. A swimming pool and spa would be provided in the rear yard area. One garage would face Ocotillo Drive, while the other two would be side-in garages near the north property line. A modified circular driveway is proposed to tie in with the front garage. B. ARCHITECTURE: The architectural style of the project is somewhat spanish with exterior materials consisting of tile roofing, stucco walls, wood garage doors, and a little slump block. The one story complex would be 18 feet high (limited to one story because adjacent to R-1 zoned property). Clerestory windows would be provided facing east and south. Unit No. 1 would be a 3 bedroom 2 bath unit with 1851 square feet and units 2 and 3 would be 2 bedroom with a den, 2 bath and contain 1854 and 1841 square feet. Each unit would have direct access to its two car garage. C. LANDSCAPING/SETBACKS: Landscaping is provided throughout the site including around the perimeters. The plans show landscaping along the north property line behind the garages. By doing this the backup area is reduced below 24 feet which is the minimum required. Therefore, this will need to be corrected. The setbacks, as provided, comply with the minimum code standards. Presently, there are good fences along the east and south property lines. There is no fence along the north property line. Staff recommends that a six foot high masonry wall be constructed along the north property line for separation and to buffer the adjacent units from the proposed garages. As previously mentioned, a circular driveway is proposed in the front yard, tying in with the driveway fronting on to the street. A three foot high block wall would screen the circular drive from view of the street. D. PROPERTY OWNERS ASSOCIATION: The plans have been given preliminary property owners association approval on May 22, 1985. -2- STAFF REPORT CONTINUED AUGUST 6, 1985 M. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and compatible with other uses existing in the vicinity and has been approved by the property owners association. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land, nor would they be negatively impacted by traffic due to limited access to existing residential areas. 3. The precise plan will not endanger the public peace, health, safety, or general welfare. Justification: The project is designed in a manner that will not endanger the public peace, health, safety or general welfare due to compliance with existing and code requirements. Staff feels the findings for approval can be justified for this precise plan. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project is a class 1 categorical exemption and no further documentation is necessary. IV. RECOMMENDATION: Staff feels the project is acceptable with minor changes and recommends: A. Adoption of the findings; B. GENERAL: The project would be a one story triplex with attached garages. A swimming pool and spa would be provided in the rear yard area. One garage would face Ocotillo Drive, while the other two would be side-in garages near the north property line. A modified circular driveway is proposed to tie in with the front garage. B. A CR HITECTURE: The architectural style of the project is somewhat spanish with exterior materials consisting of tile roofing, stucco walls, wood garage doors, and a little slump block. The one story complex would be 18 feet high (limited to one story because adjacent to R-1 zoned property). Clerestory windows would be provided facing east and south. Unit No. 1 would be a 3 bedroom 2 bath unit with 1851 square feet and units 2 and 3 would be 2 bedroom with a den, 2 bath and contain 1854 and 1841 square feet. Each unit would have direct access to its two car garage. C." LANDSCAPING/SETBACKS: Landscaping is provided throughout the site including around the perimeters. The plans show landscaping along the north property line behind the garages. By doing this the backup area is reduced below 24 feet which is the minimum required. Therefore, this will need to be corrected. The setbacks, as provided, comply with the minimum code standards. Presently, there are good fences along the east and south property lines. There is no fence along the north property line. Staff recommends that a six foot high masonry wall be constructed along the north property line for separation and to buffer the adjacent units from the proposed garages. As previously mentioned, a circular driveway is proposed in the front yard, tying in with the driveway fronting on to the street. A three foot high block wall would screen the circular drive from view of the street. D.
