REQUEST:
Approval of plans to add two additional apartment units to an existing six
unit complex located on the west side of San Rafael Avenue, 300 feet,north
of San Gorgonio Way.

I. BACKGROUND:
A. ADJACENT ZONING AND LAND USE:
NORTH: R-2/Vacant
SOUTH: R-3/Vacant
EAST: R-2/Apartments
WEST: R-2/Vacant
B. GENERAL PLAN LAND USE DESIGNATION:
High density residential 7-18 d.u./acre.
C. SITE DESCRIPTION:
The 20,560 square foot site is developed with six older multiple family units
in three single story buildings with substandard parking.
D. CASE HISTORY:
The existing units were constructed some time prior to incorporation and
adoption of the current city zoning map. Approximately one year ago Mr.
Little requested and received a zone change from R-2 to R-3 which allowed
him to request an additional two units on the property. The applicant had
plans prepared at that time but since staff was recommending denial of the
zone change, a precise plan was not processed due to the uncertainty of the
builder's right to have the additional units.
II. PROJECT DESCRIPTION:
There are currently six units on the site with six substandard (lack of back up
space) parking spaces. The code requirement would be that the new units created
must meet all current standards which would include four new spaces, two of which
must be covered. In these regards the applicant proposes to reconstruct the
parking area and install some front fencing, a carport, and landscaping.
The existing units are all single story as will be the proposed duplex. The new units
are designed to match the existing units of the property.
III. ANALYSIS:
A. FINDINGS:
1. The design will not depreciate but rather increase property values in
the vicinity by screening the parking area and increasing landscaping.
2. The plan will not interfere with the use or enjoyment of property in
the vicinity by its occupants since the traffic increase will be only
negligible.
3. The public peace, health, safety or general welfare will not be
endangered through compliance with all applicable Mode
requirements.

B. ENVIRONMENTAL REVIEW:
The project is a class 3 categorical exemption for CEQA purposes and no
further documentation is necessary.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A PRECISE PLAN OF DESIGN TO ALLOW
CONSTRUCTION OF AN ADDITIONAL TWO UNITS TO
AN EXISTING SIX UNIT APARTMENT COMPLEX ON THE
WEST SIDE OF SAN RAFAEL AVENUE, 300 FEET NORTH
OF SAN GORGONIO WAY.
CASE NO. PP 85-16
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 2nd day of July, 1985, hold a duly noticed public hearing to consider the request of
FRANK LITTLE for above mentioned matter.
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project is a class 3 categorical exemption for CEQA purposes.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, of all interested persons desiring to be heard, said commission did find the
following facts and reasons to exist to justify the granting of said precise plan of design:
1. The design of the precise plan will not substantially depreciate property
values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or enjoyment
of property in the vicinity by the occupants thereof for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety or
general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That approval of Precise Plan 85-16 is hereby granted for reasons subject to
the attached conditions.

CONDITIONS OF APPROVAL
CASE NO. PP 85-16
Department of Environmental Services:
1. The development of the property shall conform substantially with exhibits on file
with the department of environmental services, as modified by the following
conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
3. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Palm Desert Architectural Commission
Coachella Valley Water District
Public Works Department
Palm Desert Water and Services District
City Fire Marshal
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
City Fire Marshal:
5. Install a water system .capable of delivering 2500 GPM fire flow from any fire
hydrant for a two hour duration in addition to domestic supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement. Fire flow
requirements will depend on built-in fire protection provisions of buildings.
6. Install Riverside County super fire hydrants so that no point of any building is more
than 250 feet from a fire hydrant measured along approved vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each hydrant.
C. hydrants shall not be located closer than 25 feet to any building.
7. Prior to issuance of a building permit, the developer shall furnish the original and
three copies of the water system plan to the fire marshal for review. Upon
approval, one copy will be sent to the building department and the original will be
returned to the developer.
8. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the design
of the water system in PP 85-16 is in accordance with the requirements prescribed
by the fire marshal."
9. Prior to delivery of combustible materials to the building site, the required water
system shall be installed, operating and delivering the required flow.
10. Additional fire protection requirements may be necessary when the applicant
submits specific plans for consideration and approval. ,

Department of Public Works:
11. S'ignalization fund fees, as required by city ordinance, shall be paid prior to building
permit issuance.
12. Storm drain construction shall be contingent upon a drainage study by the private
engineer that is approved by the department of public works.
13. Landscaping maintenance on San Rafael shall be provided by the property owner.
14. Complete grading plans and specifications shall be submitted, as required by
ordinance, to the city engineer for checking and approval prior to issuance of any
permits.
15. Offsite improvement plans to be approved by public works department and a surety
posted to guarantee the required offsite improvements prior to permit issuance.
16. Size, number and location of driveways to public works specifications with only one
driveway approach to be allowed to serve this property.
17. Dedication of five feet of right-of-way.
18. Installation of curb and gutter at twenty feet from centerline and matching paving.
Sheriffs Department:
19. Illuminate parking area and provide security for apartments as specified in letter.

Dear Mr. Diaz :
In response to your letter regarding the above referenced
project, we would like to make the following comments :
1. The District provides service to the existing property
through a 5/8 inch meter which will have to be upgraded.
2 . If there are any walls or fences , existing or proposed
along the west property line, the owner shall execute
an agreement that provides that if at .any time in the
future the water main requires repair; the owner shall
pay for all costs related to the repair including removal
and replacement of the wall and any improvements in the
vicinity of the required repair.
3 . There is an existing fire hydrant 220 ' north of Lot 3
along San Rafael Avenue. The addition of any new fire
hydrants or the relocation of any existing, if required by
the City Fire Marshall would be completed at the owners
expense. The cost of any hydrant improvements would be
furnished by the District upon request.
4 . The District requests to review the plans to upgrade
the developed property in order to make further comments .

April 26 , 1984 .

This area is protected from stormwater flows by a system of channels and dikes,
and may be considered safe from stormwater flows except in rare instances.
This area is shown to be subject to shallow flooding and is designated Zone AO,
depth one foot on Federal Flood Insurance rate maps which are in effect at this
time. However, we expect the maps to be revised due to the construction of the
Palm Valley Stormwater Channel.
The District will furnish sanitation service to this area in accordance with the
current regulations of this District. These regulations provide for the payment
of certain fees and charges by the subdivider and said fees and charges are
subject to change.
This area shall be annexed to Improvement District Nos. 54 and 80 of Coachella
Valley Water District for sanitation service.

Per plans submitted, the following recommendations are made. The fencing
around the project should be maintained and continued around the north
edge of the property, to reduce the vulnerability of the rear of the
apartments. The proposed 5 ft. wall around the parking area would effec-
tively eliminate any visibility of the vehicles from the apartments thus
enhancing the possibility of thefts from vehicles. To offset this, Low
Pressure Sodium or similar lighting should be installed. For personal
safety of the residents, the existing ground lighting should be main-
tained and repeated throughout the proposed addition. A condition of
approval is to upgrade security on existing structures to include dead
bolt locks on all external doors and additional window security in the
form of pinning devices on all existing windows. Dead bolt locks and
window security is required on new buildings.

In response to your letter regarding the above referenced
project, we would like to make the following comments :
1. The District provides service to the existing property
Lhrough a 5/8 inch meter which will have to be upgraded.
2 . If there are any walls or fences , existing or proposed
along the west property line, the owner shall execute
an agreement that provides that if at any time in the
future the water main requires repair; the owner shall
pay for all costs related to the repair including removal
and replacement of the wall and any improvements in the
vicinity of the required repair.
3 . There is an existing fire hydrant 220' north of Lot 3
along San Rafael Avenue. The addition of any new fire
hydrants or the relocation of any existing, if required by
the City Fire Marshall would be completed at the owners
expense. The cost of any hydrant improvements would be
furnished by the District upon request .
4 . The District requests to review the plans to upgrade
the developed property in order to make further comments .

April 26 , 1984 .

E. CONSIDERATION OF ANNU ASSESSMENT FOR LANDSCAPING
AND LIGHTING ASSESSMENT! DISTRICT NO. 2 (CANYON COVE -
TRACT 11636). (Continued fro the Meetings of June 14 and June 28,
1984.)
Mayor Snyder noted that this wa a continued public hearing and asked for
Staffs report.
Mr. Altman reporte that litigation involving this district was resolved
by dissolution of , e annexation to the district which took place last
year. Various ternatives for landscaping are now being reviewed and
it is not kn 'n at this time which alternative will be selected;
therefore, i is not possible to determine the annual assessment
requiremen for the district. It is Staff's recommendation that the
Council d -Tare that no assessments be levied for this assessment
district du ing fiscal year 1984/85 and any adjustments be made next
year.
Mayor Snyder invite ' put in FAVOR of this request, and none was offered.
He invited input in OP ITION to this request, and none was offered. He
declared the public hearing sed.
Councilman Wilson quest ned whether a nominal amount should be
assessed in case there are expenses over the year so that it does not
look like there is an aband ment. Mc McClellan responded that he had
asked the City Attorney ' a token amount was necessary, and he had
advised that it was not.
Councilman Wilson moved , by Minute Motion, declare that no assessments
will be levied for this district durin iscal year 1984/85. Motion was seconded by Puluqi
and carried by unanimous vote o e Council.

Mayor Snyder declared the public hearing open and asked for Staff's report.
Mr. Diaz reviewed the staff report in detail and recommended that
Ordinance No. 384 be passed to second reading.
Mayor Snyder invited input in FAVOR of this request.
MS. MARGE PAINE, 44-457 San Rafael, Palm Desert, addressed the
Council and stated that she owned property adjacent to the property
being discussed. She stated that this street runs from San Gorgonio to
Catalina and that half of the block is zoned R-3 and the other is R-2
zoning. She felt affordable housing should be allowed here.
MS. HOLMBERG, 73-289 Ridgecrest, Palm Desert, stated she felt the
location is ideal for this type of zoning.
MR. STAN LITTLE, 72-668 Bel Air, Palm Desert, the applicant, stated
that the rents in this area are $200 - $325 per month and noted that an
additional duplex is desirable to make the property economically
feasible.
Mayor Snyder invited input in OPPOSITION to this request, and none was
offered. He declared the public hearing closed.
Upon motion by Wilson, second by Kelly, Ordinance No. 384 was passed to
second reading by unanimous vote of the Council.

whether or not a restaurant should be built on that property. He felt
the issue tonight was whether to approve the restaurant or change the
zoning of the property. He also noted that this is the 5th public hearing
on this matter and he felt a decision should be made one way or the
other.
Councilman Puluqi questioned whether a restaurant could be built at
the base of the hill. Mr. Diaz responded that there would not be enough
room to build any sizeable building in that area. Councilman Puluqi
stated he felt that if that is the case, then by denying the request the
Council would be denying. Mr. McMillan the right to build on his
property.
Mayor Snyder invited REBUTTAL.
MR. 13ILL WARE stated he had no problem with Mr. McMillan building a
restaurant at the base of the mountain because no one would be able to
see it.
Councilmember Jackson questioned Councilman Wilson relative to his
feelings about an EIR being done. Wilson responded that he felt the
least the Council can do is to require that an EIR be done.
Councilman Puluqi reiterated his feelings that the matter of building on
hillsides should be given to the voters and not just this project.
Councilmember Jackson stated that she felt a decision is owed to the
applicant and agreed with Councilman Puluqi that the entire hillside
building matter should be given to the voters to decide.
Councilmember Wilson stated that he felt that a restaurant on this
particular site was a violation of the General Plan.
Councilman Wilson moved to deny the request for a CUP and instruct Staff to
prepare a resolution of denial to be put before the Council at its August 9, 1984, meeting.
The motion was seconded by Kelly. With Wilson and Kelly voting YES, Puluqi and Jackson
voting NO, Mayor Snyder called a 5-minute recess at 8:30 p.m. in order to ask the City

Councilman Puluqi moved to place the hillside overlay issue on the November

ordinance the Council could rescind all commercial development on hillsides.
He then asked staff to come up with a recommendation and proper wording for
the next meeting. City Clerk Sheila Gilligan stated that in order to place this
on the November ballot, it would have to be advertised by August 3, 1984;
therefore, it would have to be given to the newspaper by noon on Monday, July
30, 1984, at the latest.
I Councilman Puluqi moved to place this on the November ballot to read as
follows: "Should development, whether residential or commercial, be allowed west of the
Palm Valley Flood Channel and south of Painters Path".
MR. BOB DOWNS, 43-155 Portola, Palm Desert, a Planning Commissioner,
addressed Council and stated that he felt the motion should include "from the
general line of demarcation".
Councilman Wilson seconded the motion by Puluqi. Councilmember Jackson
stated her feeling that a measure like this would have to be very detailed on the ballot in
order to make it understandable. Doug Phillips suggested that he and Mr. Diaz get
-ding. Council concurred, and motion carried by

NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of plans for an addition to
an existing commercial facility.
LOCATION: North side of El Paseo at the rear of Jensen's Market, west of Larkspur
Lane.
ZONE: C-1, S.P.
BACKGROUND:
April 12, 1983, commission received a two fold application for the subject property. The
first part of the application involved remodel of the existing facility which has been
completed. The second part of the request proposed the construction of three identical
5640 square foot single story commercial buildings fronting onto E1 Paseo. This proposed
addition was given preliminary approval subject to the usual conditions.
DISCUSSION:
The plans as submitted are in substantial conformity with those given preliminary
approval. A landscape plan has not been provided but will be required.
RECOMMENDATION-
That the commission review the final plans for Case 182 C, Metro and Dunham, to
determine acceptability. If the commission decides to grant final approval, it should be
subject to the following condition:
1. That a landscape plan be reviewed and approved by the commission prior to issuance of
building permit.
