DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN FOR CONSTRUCTION OF A 7,000 SQUARE FOOT KIDNEY DIALYSIS FACILITY AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT IN A SERVICE INDUSTRIAL ZONE LOCATED AT THE SOUTHWEST CORNER OF HOVLEY LANE AND CORPORATE WAY. CASE NO. PP 85-19 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of August, 1985, hold a duly noticed public hearing to consider the request of FREDERICK WEISS for above named project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implement of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have a significant negative impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify recommending approval of said precise plan: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. The development of the property shall conform substantially with exhibits . on file with the department of community development, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null , void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Coachella Valley Water District Public Works Department Palm Desert Water and Services District City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Six foot wide meandering sidewalk required along Hovley Lane. 6. Parking lot spaces to be minimum 20 foot with a maximum 2 foot overhang. 7. Payment of fringe-toed lizard fees required prior to issuance of grading permit. 8. Sidewalk shall be installed along Corporate Way, subject to city council clarification. PLANNING COMMISSiUN RESOLUTION NO. 1070 , Department of Public Works: 9. Signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 10. Landscaping maintenance on Corporate Way and Hovley Lane shall be provided by the property owner. 11 . Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 12. Size, number and location of driveways to public works specifications with only two (2) driveway approaches to be allowed to serve this property. 13. Any permit issuance shall be subject to parcel map 17452 first being approved and recorded. 14. Complete parcel map shall be recorded as required by ordinance to the city engineer for checking and approval and be recorded before issuance of any permits. City Fire Marshal : 15. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 16. Install Riverside County super fire hydrants so that no point of any building is more that 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 17. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. PLANNING COMM M—UN RESOLUTION NO. 1070 18. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "[ certify that the design of the water system in PP 85-19 is in accordance with the requirements prescribed by the fire marshal ." 19. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 20. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 21 . All buildings over 5000 square feet require an approved fire sprinkler system. Sheriff's Department: 22. Installation of audible perimeter alarm system. 23. Installation of an interior alarm trap ( i .e. motion detector or pressure sensitive pad) . 24. Each exterior entrance lit by two sources with additional perimeter illumination to deter burglary. /tm MINUTES PALM DESERT PLANNING COMMISSION AUGUST 6, 1985 MR. BERNARD LELING, architect, 73-960 El Paseo, explained that three owners wished to construct this three unit apartment complex for their residences. Mr. Leung requested deletion of the 24 foot bark up area behind garages with landscaping. Commission concurred with the deletion of condition #7. Commissioner Downs asked Mr. Patterson about a possible conflict of interest . Mr . Patterson indicated that he felt there was no conflirt. Chairman Crites asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed prn_iert. MR. HOWARD B1HBY, an adjacent resident, requested that the wall height be lowered next to his residence. Mr. Leung indicated that the site would have to be looked at to determine the amount the wall could be reduced on that one side only. Commission concurred that the wall height be mutually acceptable between Mr. Leung and Mr. Bibby, Chairman Crites closed the oublic testimony and requested commission . action. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, approving the findings as presented by staff. Carried 5-0. Case No. PP 85-20 - LEPAN-LEVY, Applicants Request for approval of a precise plan of design and negative declaration of environmental impact to allow 28 apartment units on an 87,250 square foot. property in the R-3 18,000 (3) S.P. zone located north of Verba Santa between the Frontage Road and Ocotillo. Mr. Diaz outlined the salient points of the staff report and added the condition of installation of sidewalks. Chairman Crites expressed concern regarding street size, the double car garages, parking standards, and the quality of the overall plan. Mr. Diaz concurred that the design could be improved. Chairman Crites opened the public_ testimony and asked the applicant to address the commission. MR. RRANKO LEPAN, explained that the road width was 15 feet in two or three places and the rest was 30 feet. Mr. Lepan also discussed the road exits and frontage roads. ADJACENT ZONING AND LAND USE: NORTH: PR-4/VACANT SOUTH: S. I ./VACANT EAST: S. I ./VACANT WEST: O.S./VACANT B. GENERAL PLAN LAND USE DESIGNATION: Service industrial . C. PROPERTY DESCRIPTION: The 28,000 square foot site is within the industrial subdivision developed by George Berkey. Presently a six foot wall (a subdivision improvement) borders the site to the west. il. PROJECT DESCRIPTION: The project has been before the commission previously as a discussion item at study session for use clarification where it was felt that it would be acceptable in a service industrial zone. The building is located adjacent to the intersection with the parking in back, having access to both Hovley Lane and Corporate Way. The entrance to the structure is also located in back towards the center of the parking area. The elevations indicate a flat roof structure 19 feet in height which will be reviewed by the city's architectural commission. A condition of approval from the parcel map was for no direct vehicular access to this STAFF REPORT CONTINUED AUGUST 6, 1985 parcel from Hovley Lane. However, staff feels that a driveway on Hovley will provide much better parking lot circulation for the site and feels the request is acceptable in that the eventual center median will not have a break at the driveway location. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF PRECISE PLAN: I . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The design of the use is attractive and will be compatible with other industrial uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use of or enjoyment of property in the vicinity of the occupants thereof for lawful purposes. Justification: The surrounding land in the vicinity is zoned for the same type of use as proposed and owners would not be deprived the use of their land. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The precise plan complies with all code requirements and will not be detrimental to the public peace, health, safety or general welfare. Staff feels the findings for approval can be justified for -this precise plan. 8. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the proposed project will not have an adverse effect on the environment and a negative declaration of environmental impact has been prepared. Install a water system capable of delivering 3oaq GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings. .2. Install Riverside County super fire hydrants so that no point of any building is more than 20o feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than ,25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PIP 95-19 is in accordance with the requirements prescribed by the Fire Marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over S 000 square feet require an approved fire sprinkler system. We would like to establish a Dialysis Center in Palm Desert. Palm Desert and the Coachella -Valley is a growing and dynamic region. Over the past two years the patient population requiring dialysis facilities has grown significantly. We foresee a continued growth in the valley' s need for such service. Palm Desert is a centrally located area in the valley. At the present the only dialysis center is in the west end of Palm Springs. We feel that Palm Desert is the ideal location for a new dialysis center. We feel a dialysis center would be a major addition to Palm Desert. It would fulfill an important medical service gap. It is a clean service industry which would provide employment to a significant number of people. The center would provide services to 25-40 clients per day. At any one time 10 employees would be on the premises as well as 10-12 clients. Our experience shows that 60% of clients (6-8) do not drive to the facility, but either use Medi-Van services or drivers who transport them to the center for dialysis and pick them up when they are through. . Dialysis scheduling allows all clients from one shift to leave before the next shift begins. Thus, we envision the need for 16-20 parking spaces at the Palm Desert Dialysis Center. We have dialysis facilities in other industrial areas. They have proven to be very compatable with light industrial uses.
