The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval , the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null , void and of no effect whatsoever. 4. The total widths of all driveways shall not exceed 50% of the effected property frontages of Highway 74 (Frontage Road) , Verba Santa and Ocotillo Drive. City Fire Marshal : 1 . Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of j measurement. Fire flow requirements will depend on built-in fire protec- tion provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. i I b. curbs shall be painted red 15 in either direction from each hydrant. i 1 C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for i review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 85-20 is in accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over 5,000 square feet require an approved fire sprinkler system. Mr. Smith explained that the applicant had addressed the concerns raised at the August 6 meeting and recommended approval . Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. BRANKO LEPAN explained that the site plan had been revised to reflect the 25 foot width of driveway accesses as required by the fire marshal . Commissioner Erwood inquired if the amendments changed the 50% effected properties or number of driveways. Mr. Smith replied that the number of driveways would remain at eight and indicated that the director of public works could address the issue of percentages of affected property, but had not seen the revised plan. Commissioner Erwood asked if Mr. Folkers would like a few minutes to study this. Mr. Folkers concurred. Chairman Crites expressed concern regarding street size, the double car garages, parking standards, and the quality of the overall plan. Mr. Diaz concurred that the design could be improved. Chairman Crites opened the public testimony and asked the applicant to address the commission. MR. BRANKO LEPAN, explained that the road width was 15 feet in two or three places and the rest was 30 feet. Mr. Lepan also discussed the road exits and frontage roads. PP 85-21 and PMW 85-15 - WILLIAM ALEXANDER, Applicant Request for approval of a 48,000 square foot two story office/warehouse building and negative declaration of environmental impact located in a service industrial zone on the west silo of Corporate Way, 260 feet north of 42nd Avenue. Mr. Joy outlined the staff report and suggested the addition of conditions for an additional 25 foot setback, sidewalks along Corporate Way, and the requirement of a parcel map waiver if consolidation occurs. Mr. Joy also indicated that the applicant would like to shift the huilding southward to eliminate building in the storm drain easement area. Commissioner Richards clarified that there was a zero lot line and asked about adjoining parcels. ' Mr. Joy indicated there were no structures at the present time. Chairman Crites peened the public testimony and asked the applicant to address the commission. MR. ALEXANDER felt that the installation of sidewalks could be a problem for the safety of patrons. APPLICANT: Lepan-Levy 72-956 Bursera Way Palm Desert, CA 92260 1. BACKGROUND: A. DESCRIPTION OF SITE: The property is a sloping from south to north vacant site on the north side of Verba Santa between the Frontage Road and Ocotillo. 8. ADJACENT ZONING AND LAND USE: North: R-3 18,000/ South: R-2/ East: R-3 & R-I/Vacant/single family dwelling West: Across Hwy 74 PR-6/multi family C. GENERAL PLAN LAND USE DESIGNATION: Low density residential 3-5 du/acre 11. PROJECT DESCRIPTION: The property is composed of five lots located south of Verba Santa between the Frontage Road and Ocotillo. A. GENERAL: The applicant is proposing to construct 28 apartment units along with a pool and spa area. The 28 units are contained in 4 buildings. Two buildings have 8 units each while one has 7 and one 5. B. SITE DESIGN, CIRCULATION AND PARKING: The 28 units are oriented around a central courtyard area (pool & spa) which complies with the required 300 square feet of group usable open space provision of the code. Each of the four buildings then is oriented inward to the courtyard and outward to the 3 streets which provide access and a driveway which is to be created along the north property line. Rather than have units exist directly onto the public streets the applicant has chosen to create in effect a series of 3 additional frontage roads parallelling the public streets. These onsite streets result in problems relative to the city parking standards. These streets will provide for two way traffic movements. These streets are 20 feet wide and narrow to 15 feet in certain areas. PP 85-20 CONTINUED City standards prescribe a minimum 24 foot driveway and backup area from garages. In addition in the case of building 1 , adjacent to Verba Santa, the eight (8) double car garages have been designed in pairs each one at 90 degrees to the other. This is a potentially very hazardous situation. The Palm Desert Property Owner's Association has reviewed and granted preliminary approval to the plans. The city's parking standards are established by Planning Commission Resolution No. 725. Therefore, should commission wish to approve this site plan then the parking standards can be altered as a result of the precise plan approval . If the site plan is approved with the inclusion of the "frontage roads" then perimeter walls, 36-42 inches in height should be required adjacent to the roads. C. ARCHITECTURE: The project architecture will be spanish in nature with exterior materials consisting of stucco walls, wood trim and tile roofing. The plans as submitted have been preliminarily approved by the Palm Desert Property Owner's Association. In addition to this approval the applicant will be required to obtain approval of the city architectural commission. D. UNIT TYPE AND MIX The development will be one story structures with a maximum height of 15 feet. There will be 9 one bedroom, 1137 square foot units and 19 two bedroom, 1400 square foot units. E. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is not unattractive from a design aspect and not incompatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Existing uses in the immediate area are multi family developments. Residential apartments are permitted in the R-3 zone. Development of the type proposed should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The project, as conditioned, is designed in a manner that should not endanger the public peace, health, safety or general welfare. Staff feels these findings can be justified in this case. F. ENVIRONMENTAL REVIEW: PP 85-20 CONTINUED Several environmental impacts were identified in the initial study. It is felt that adequate means are available to mitigate these environ- mental impacts. Appropriate conditions will be imposed on the develop- ment to mitigate any adverse environmental impacts. With the imposi- tion of these conditions the project will not have a significant impact on the environment and a negative declaration of environmental impact has been prepared. IV. CONCLUSION: The project is designed in a manner which is not unacceptable provided the conditions as recommended by staff are implemented. V. STAFF RECOMMENDATION: Staff recommends: A. Rather than have units exist directly onto the public streets the applicant has chosen to create in effect a series of 3 additional frontage roads parallelling the public streets. These onsite streets result in problems relative to the city parking standards. These streets will provide for two way traffic movements. These streets are 20 feet wide and narrow to 15 feet in certain areas. PP 85-20 CONTINUED City standards prescribe a minimum 24 foot driveway and backup area from garages. In addition in the case of building 1 , adjacent to Verba Santa, the eight (8) double car garages have been designed in pairs each one at 90 degrees to the other. This is a potentially very hazardous situation. The Palm Desert Property Owner's Association has reviewed and granted preliminary approval to the plans. The city's parking standards are established by Planning Commission Resolution No. 725. Therefore, should commission wish to approve this site plan then the parking standards can be altered as a result of the, precise plan approval . If the site plan is approved with the inclusion of the "frontage roads" then perimeter walls, 36-42 inches in height should be required adjacent to the roads. C. ARCHITECTURE: The project architecture will be spanish in nature with exterior materials consisting of stucco walls, wood trim and tile roofing. The plans as submitted have been preliminarily approved by the Palm Desert Property Owner's Association. In addition to this approval the applicant will be required to obtain approval of the city architectural commission. D. UNIT TYPE AND MIX The development will be one story structures with a maximum height of 15 feet. There will be 9 one bedroom, 1137 square foot units and 19 two bedroom, 1400 square foot units. E. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1 . The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is not unattractive from a design aspect and not incompatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. Justification: Existing uses in the immediate area are multi family developments. Residential apartments are permitted in the R-3 zone. Development of the type proposed should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, health, safety or general welfare. Justification: The project, as conditioned, is designed in a manner that should not endanger the public peace, health, safety or general welfare. Staff feels these findings can be justified in this case. F. ENVIRONMENTAL REVIEW: PP 85-20 CONTINUED Several environmental impacts were identified in the initial study. It is felt that adequate means are available to mitigate these environ- mental impacts. Appropriate conditions will be imposed on the develop- ment to mitigate any adverse environmental impacts. With the imposi- tion of these conditions the project will not have a significant impact on the environment and a negative declaration of environmental impact has been prepared. IV. Install a water system capable of delivering2.5oo GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow require- ments will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 25o feet from a fire hydrant measured along approved vehicular travel ways . a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 2.5 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in P.P. 8 5-Z o is in accordance with the requirements prescribed by the Fire Marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. DSP f � . .A AGREEMENT OF FUTURE PARTICIPATION IN LANDSCAPE INSTALLATION AND MAINTENANCE ALONG HIGHWAY 74 This agreement is made and entered into this day of December, 1987 , by and between CITY OF PALM DESERT, a munici- pal corporation, (hereinafter referred to as "City") , and BRANKO LEPAN, (hereinafter referred to as "Property Owner") . I . RECITALS 1 . Property Owner is the owner of five (5) parcels of real property situated in the City of Palm Desert, County of Riverside, State of California, more particularly described in Exhibit "A" attached hereto and made a part hereof. 2 . Property Owner presently has applied to the City of Palm Desert for precise plan approval in order to develop a 28-unit apartment complex on the property described in Exhibit "A" , Case No. PP85-20 . 3 . City desires to establish a plan for landscaping the 12-foot wide dirt strip between Highway 74 and the Frontage Road in the City of Palm Desert, a portion of which strip lies on Property Owner ' s property described in Exhibit "A" . A map describing said 12-foot wide dirt strip between Highway 74 and Frontage Road, which is the subject of this agreement, is attached hereto as Exhibit "B" , and made a part hereof. In consideration of the mutual promises , covenants and conditions contained herein and, further in consideration of the entitlements which Property Owner will receive from the City as part of Case No. PP85-20 , and as a condition of approval of Property Owner ' s application in Case No. PP85-20 to develop the 28-unit apartment complex, Property Owner agrees to participate in and not object to the formation of an assessment district for the purpose of landscaping installa- tion and maintenance of said landscaping in the 12-foot wide dirt strip between Highway 74 and the Frontage Road. Property Owner hereby agrees to participate on an equal basis with other property owners in the assessment district or other financing district if and when the City establishes a plan for landscaping the 12-foot wide dirt strip between Highway 74 and the Frontage Road. 2 . At the option of the City, this agreement shall be recorded. At such time as this agreement is recorded, it shall become a lien against the property of Property Owner. 3 . In the event suit is brought to enforce the terms of this agreement, reasonable attorney' s fees and costs shall be awarded by the Court to the prevailing party in said action.
